Mr*** came to Westford Auto Sales in December of to look for a truck for his landscape business. At the time we didn't have any trucks in his $10,price range. A previous customer of ours came by and said he had an older dump truck in the 10,price range that he wanted to
sell. We took it on consignment with Mr*** in mind. At the end of December Mr*** purchased the dump truck. At the time of purchase Mr*** asked if it would pass N.Hinspection, which we told him we would check it out, and see. One of our technicians is a licensed New Hampshire inspector, so he looked at it, and said it would need ball-joint, so we replaced it. Mr*** also asked if the truck came with the standard 30-day used vehicle warranty, which we explained that this vehicle did not qualify, because it is a commercial vehicle used for business. We did offer him an extended warranty, which he declined. Mr*** called us the first week in January and said the truck wouldn't start. After describing the symptoms to us it sounded like it was possibly flooded. We thought this a possibility, because when Mr *** test-drove the truck he pumped the gas a few times before starting it, which you shouldn't do, because it fuel injected, and if you pump it you could flood it. The next day Mr*** called and the truck still wouldn't start. We told him to get the truck down to us, and we would take a look at it. We felt even though the truck didn't qualify for the mass warranty it would be good business to look at it, because he only had it a few days, and he shouldn't be responsible for that. He had it towed to us. The next day our technicians checked the common things when a vehicle wont start, fuel, and spark. The technician determined there was no fuel, so he put in gallons, and the truck fired right up ! At the same time the technician noticed the transfer pump which moves fuel from one end of the gas tank to the other wasn't working, so we installed one at no charge to Mr***. Mr*** came down, and picked up the truck, and expressed dissatisfaction, because it cost him $to have it towed to us. The next time we heard from Mr*** was the week of May 9th (months later). he called, and said he was coming down to talk about trading it in. He didn't show up when he said, but did come in a few days later. He said the year old dump truck was nickle, and diming him. He also said the truck wouldn't pass inspection when he first got it. We asked him why he didn't call, and at first he said he did, and we told him no one hear had heard from him in four months, he then said he didn't call about it because he figured hed have to spend another $to tow the truck to us again. He then stated he wanted his money back on the repairs, which he had done, which we told him after months we were unable to do, but we did offer to reimburse him for the ball joint that caused the truck not to pass inspection, which we would have done in the beginning if we had heard from him. In the past few months we have sold late model dump trucks with low miles, and we offered to find him one, and take his chevy back in trade. He declined

I have reviewed the response submitted by the business and have determined that the response does not satisfy or resolve my issues and/or concerns in reference to complaint # [redacted]. Please add your rejection comments below.  I stopped at Westford Auto Sales and spoke to a salesman named [redacted] and told him I was looking for a dump trunk in the range of 10,000. He told me that he had a friend that had a truck in that price range perfect for your needs I will contact you in a few days to look at it. I went down December 31st 2105 to look at the truck and took it for a test drive and it was shaking all over the road. [redacted]'s response was it was most likely from the truck sitting so long and then I asked him about the warranty on the vehicle. He replied on a commercial vehicle there is no warranty but I guarantee there won't be any issues with the truck there was a new crate motor put in and I can give you a list of the rest of what was put in. When I took it home the following day the truck would not start and called [redacted] and he said you must have pumped the gas you probably flooded it and I said I pumped the gas when I saw you do it to initially start the truck. His advice was  to let it sit and then open the hood and try putting starter fluid in it. When I tried to pop the hood the hood fell off. I called [redacted] back again telling him how the hood fell off at that point he said you will have to have it towed into the shop and had to pay 300$ for a tow fee when I just bought the truck the day before. I had it towed to his establishment where he told me the car was out of gas. I asked him why the gas gauge showed it had 3/4 of a tank of gas and his response was that the transfer pump needs to be replaced. I told him that I didn't want a truck that the gas gauge doesn't work and he told me I should keep a can of gas in the truck in case I run out. I then took the vehicle back to find out that the transfer pump still didn't work. When I took it to get it inspected it failed due to gas leaking, headlight failure, and upper and lower passenger side ball joints. When I called him back again he said he had replaced one of the ball joints previously and everything else was working fine and should pass inspection yet the other problems were still occurring. I then told him I wanted him to take the truck back due to the plethora of issues and he refused. I then proceeded to resolve the  issues with money out of  my own pocket by towing to my personal mechanic where he advised me to get rid of the truck and have them take it back because it was nothing but problems due to its numerous issues. Again [redacted] declined. I paid to have my mechanic fix the multitude of issues just to pass inspection but my mechanic insisted that there would only be more issues to come even after him looking over the truck. I called [redacted] once again and he still refused to take the truck back or even reimburse me any of the money that I had put into fixing the truck I had just purchased simply to get it to pass inspection.  Not even two weeks later numerous additional fuel problems including the transfer pump still not working, that he said were fixed, arose. My mechanic drained the rear tank in attempt to fix issue and discovered there was water in the tank and multiple switches that needed to be replaced in regards to the fuel issue. He fixed what needed to be done to get the truck running but it broke down two weeks later from further problems as my mechanic originally predicted. This time it was due to the starter of the truck and further fuel issues. I then personally stoppped into Westford Auto Sales and asked for [redacted] who was not available, and when trying to talk to the other salesperson who was available, said I needed to talk to [redacted] who did not get back to me. After getting the starter fixed, again money I dished out of my own pocket, I got the truck running a third time only to have it break down for a third time due to fuel issues. Once again I left a message for [redacted] and there was no response. I brought it to a second mechanic to see if he could figure out the fuel issues for over 900$ who said that there are so many fuel issues and the wiring on top of it is messed up and I should send the truck back because it was a lemon. He got the truck running after two weeks of working on it and three weeks later the truck broke down once again. When I had it towed to a third mechanic close to where it broke down in Lexington, MA where he replaced an additional starter and a fuel switch which cost an additional 400$. The third mechanic advised me that I should try to get the truck taken back because it was just a lemon. Once again I called [redacted] and he just kept saying there is no warranty on commercial vehicles there was nothing he would about it. The last communication I had with [redacted] and then the owner at the end said he would be willing to reimburse me for the ball joint but not the full value of the truck. I then at least tried to get the money back I had put into it which was several thousand dollars and he refused but merely offered 400$ to me back which was the cost of the ball joint. I require a truck for my landscaping business which is why I told him I wanted a truck that would pass inspection with no issues in my price range. He sold me his friend's truck and ripped me off for 10,000 for a truck that was not even worth half of that. I went through three mechanics each one telling me that I got a lemon and was only able to use it for my business two weeks out of the three months since I had purchased it. Not only has this cost me money by attempting to fix the issues with the truck but I have lost business due to my inability to use the truck and the time I took off to get it fixed. I am flexible person and was willing to either get my money back from what I had put into it or take the truck back. I am now seeking legal action at Ayer district court to resolve the issue.
