To whom it may concern.I am writing this document in response to Revdex.com complaint number ***.On 6/29/Mrs*** came to my business to look at and subsequently enter into a purchase agreement to buy a Mercury Mariner from us.(a copy of the used vehicle order was Supplied by Mrs
***. Prior to entering into this agreement the ***'s were advised that the vehicle had been through a Missouri Safety and Emissions Inspection ,performed by *** *** of Wentzville, and had passed the emissions inspection but had failed the safety for a few items(copy attached)Those items were: All four brake hoses were cracking2.The rear muffler flange gasket needed replacingThe vehicle had tint on the front windshield that was too low.After being made aware of the inspection deficiencies, and the fact that the dealer would correct those issues prior to delivery, The ***'s took the vehicle for a test driveupon returning from the test drive The ***'s expressed the desire to go ahead and purchase the vehicle, Through negotiation a price of $was reached, which included the dealer making the required repairs to pass inspection, getting the re inspection completed, as well as providing an extra keyAll of this is evidenced by the used vehicle order presented by Mrs ***Also evidenced by this document is the first of three signatures acknowledging that the vehicle was sold WITHOUT WARRANTY.I advised the ***'s that I used *** in Ofallon to do my repair work and would likely have the vehicle ready for delivery the next dayThey said they too knew of *** and they knew the owner ***. On 6/30/the vehicle had the required repairs completed by *** in OfallonIt was then taken back to *** *** for re inspectionWhile at *** *** the vehicle also received an oil changeReceipts for all are includedAt this point the vehicle has passed all required MO State Inspections, had a fresh oil change and was running fine. At this point I'd like to highlight three points.1.The inspections on the vehicle were performed by a national franchise,*** ***, not by the dealerThe inspections that were performed appear thorough, as they determined deficiencies that require considerably more than a passing glance to uncoverAll the deficiencies were corrected and re inspected by two separate national franchises, *** and *** ***.Contact was made with the customers and arrangements were made to finalize the transaction.At the closing table the customer was shown copies of the receipts for the work that was performed. It was deemed satisfactory and we began to sign documentsthe list of documents include:Missouri Bill of SaleMissouri Title applicationFederal Buyers Guide (as displayed in the vehicle)As Is Dealer Warranty Disclaimer Copies of all these documents were provided to the Revdex.com by the customer.The first two documents require little explanation, they are simply instruments to convey ownership of the vehicle.The 3rd document is the Federal Buyers Guide that is displayed in all cars on all dealer lotsThe purpose of this document is to make perspective buyers aware if the vehicle they are looking at comes with or without a warrantyIn this case the box is clearly marked that the car in question comes without any warranty from the dealerThe fourth documentthe Dealer Warranty Disclaimeris very adamant that the vehicle is "as is"It further goes on to record the date and mileage of the vehicle at the time of signingIn this case the mileage is and the date was 6/30/2016.So to recap the transaction thus far, The ***'s came out and saw the car on 6/29, they were aware it needed a few items corrected, they drove the car and liked it, they negotiated a price for purchase that included repairs being made and NO WarrantyOn 6/they approved the repairs that were made, they consummated the sale, and had signed at least THREE documents stating the vehicle they were buying had no warranty.Now fast forward months and miles.On 9-28-I received a disgruntled call from Mrs ***She Introduced herself by citing the vehicle she boughtThen she went on to state that I had sold her daughter a piece of junk that was poorly maintained according to her mechanic, and that I had illegally had the car inspected and passed by *** at ***After pulling out the deal file, I advised her of the facts of the matter and how it actually transpiredI expressed sympathy for her situation and asked her some questions to try to determine what was going on with the vehicleShe said the car was making a loud noise and that *** Enterprises had advised her not to drive the car on the highway.I asked if she had the number for the shop, she said no, so I said I'd find it and I'd contact them to inquire what was wrongI located the number for *** and tried to make contact but they were closedI called the customer back to advise what I found and committed to get more info and call her backThe next day I contacted Thomas at ***,he advised the car was emitting lower engine noise, and was presented with a check engine light that was for code p0128. This code pertains to some sort of thermostat malfunctionI asked what the mileage was and he stated He and I had further discussion regarding potential causes of the problem and remedies 10-1-I left a message for Mrs *** that went unreturned.On 10/24/I received a random text stating "We never heard back from youI am going to file a complaint with the attorney general and the Revdex.com". After inquiring to the identity of the person textingThe Response was" we bought the Mercury Mariner from you in June".At this point I called her and advised her I had in fact left her a message to which she responded they were on vacationthat weekend. So I advised her that I had spoken with her mechanicThat he confirmed the engine noise, I advised her that he denied saying anything regarding poor maintenance, if fact he and I discussed that without tearing apart the engine there was no way to definitely determine what was actually bad or what caused it(potentially over heating due to driving with a problem with the thermostat) He did state and I concurred that if it was truly lower engine noise that a replacement engine was the likely course of actionI further explained that given the time and the miles that were on the car since the date of purchase, and the fact that the car was sold without warranty, that the Dealer would not be bearing the burden of any repairsI did however advise her that I had sourced a replacement motor with good miles and a warranty for $and she could have it installed at a shop I use for what my cost was approximately $ this option was considerably below the price of what her shop had quoted her. She said she did not know if they wanted to sink another $into the car and she would think about it. In summary,I have given the details of the transactionThese details are supported not only by the documents I am supplying to you, but also by the documents the complainant has submitted. It is completely preposterous and unfounded for this customer to claim Westplex Auto Group LLC did anything illegalThe fact that we did not perform the inspection precludes the dealership from liability for the inspectionI find this claim both defaming and libelous As to her claim to about business practices, I can only refer you to the details of this transaction, and the supporting documentsI believe Westplex Auto Group LLC went above and beyond in its treatment of this customerWe were straight forward about the vehicle from the beginning, I advised the customer up front about the issues relating to the inspection, upon completing the repairs we provided a free oil change to the customer, and even when the dealership was no longer responsibleI still went out of my way both reaching out to her shop and locating a replacement motor, to try to help the customer deal with the problem. While I concede this situation is unfortunate, the fact is the customer was very much aware that the vehicle was sold without warranty. Therefore the request for a refund is denied Respectfully,*** ***WESTPLEX AUTO GROUP *** cell
