Initial Business Response /* (1000, 5, 2014/06/03) */
first and foremost the transaction occured between mr. [redacted] and westpointe. [redacted] is not on any contractual agreement but westpointe has reached an agreement for mr. brown.mr. [redacted] signed for an automobile purchase and...

his finance terms were not approved as originally submitted. according to all motor vehicle delivery receipts in the state of oklahoma all loans are subject to lender approval. when the original loan was turned down then westpointe obtained a secondary approval which mr. [redacted] then agreed and signed to. mr. [redacted] was not obligated to sign but chose to do so because he wanted to keep the automobile in his name. westpointe approached the customer to see if he had own financing or another co-signer to help his financial situation but [redacted] declined to help. westpointe then reached an agreement to reimburse customer $900.00 to help pay for his tag and tax which he and [redacted] agreed to. westpointe was under no obligation to help financially but wanted to keep customer goodwill. all parties were satisfied with this result on june X XXXX. mr. Brown seemed very satisfied and happy with his purchase.
Initial Consumer Rebuttal /* (3000, 7, 2014/06/04) */
(The consumer indicated he/she DID NOT accept the response from the business.)
My son did purchase the car under the preconception that his car payment was going to be $380.00 which is affordable as he should of considering he signed the loan papers and the car was released to him. on the loan revision that took place on X-XX-XX my son 20 year old son first time car buyer was presented the papers with two men in the room with him he felt pressured and snowballed into signing the paperwork. He has never purchased anything of this caliber and he was completely taken advantage of. As for the statement that I would not help him with the finance of the car that is false its not that I wouldnt help because I would do anyhting for my son it's that my credit will not support co-sigining for him as I went through a very bad divorce which effected my credit tremondously. Paying the $900.00 Tag,title and tax was a nice gesture which I agreeded to on the stipulation that I would discuss that with Daulton and we would decide to go from there. Paying $900 still does not resolve the fact he has been stuck with a car payment that is not affordable and will be a long term finanical burden. We have since contacted a attorney who is reviewing the loan papers, contacted the bank where the loan is being processed and have stopped that and we are also filing a complaint with the OKlahoma Motor Vehicle Commission. If this is any indication of how this dealership promotes their business they all need a crash course in Honesty. As for his statements that all parties were happy obviously that is a false statement or we would not be going throuh such drastic measures to return the car. We were told if we returned the car at this point it would be a repo on his credit which is a false statement. There is a statue of limitations in a return of a car and if new loan papers were signed on 5-31-14 then when I called Monday morning on6-2-14 that was still in effect. also the extended warranty that was not on the first loan but added to the second loan without my sons knowledge was not addressed, that incresaed the payment as well and there is no need for a extended warranty on a 2013 when it still has a factory warranty. We want the loan reveresed by West Point and to return the car and be refunded the $4000.00 cash down payment, $704.00 for Insurance down payment and $2000.00 for the stress and strain this has put on my son and I.

Our warranty cancellation policy states "Allow 90 days" not we will pay in 90 days. We returned phone calls to...

voicemail and paid the warranty claims as to the amount that was due and owed the [redacted]'s. The checks issued have cleared our bank.
Neither Mr. nor Mrs. [redacted] contacted a member of management (no one could confirm speaking to them) to discuss their concerns and privacy laws prohibit me discussing any particulars. We wish we would have had a chance to have a dialogue to discuss their concerns, but they chose to file this complaint instead.
We consider the matter closed.
Initial Consumer Rebuttal /* (3000, 7, 2015/11/23) */
(The consumer indicated he/she DID NOT accept the response from the business.)
The statement "Allow 90 days" leads a costumer to believe that it will only be a maximum of 90 days before a refund is issued. In addition to this the person in finance who we spoke with the day we signed the cancellation papers stated it could "be up to 90 days."
In response that no one remembers talking to us, and I agree with that statement. We left multiple message, and no one ever returned our calls. So that is why no one remembers talking to us. You can't remember something that never happened. We did receive a phone call at the beginning of November 2015 stating that we would receive our checks in the mail. This phone call was received after my complaint was filed.
In response to the checks that have been issued we received two checks. One check for $3, 627.16 and the second for $3,678.88 totaling $7,351.04. I do not understand how that is the correct amount when the original purchase price for both warranties was $8,949.00. I understand that there is a $50.00 per vehicle cancelation fee. My concern is that the bill of sale statement say that what we purchased was an extended warranty. Since, the Durango is still under factory warranty how it could have prorated to a loss of almost $1,000.00. The same is a concern on the Jeep. However, we did expect a slight proration since the Jeep was no longer under factory warranty. If what we purchased was not an extended warranty, but instead a supplemental warranty it should have been sold and documented as such.

westpointe has reached out to roger brenz by leaving several messages to call the salesman ([redacted]) on Friday the 16th and Monday the 19th- we would like to know if we could trade into another vehicle what would be his terms- we cannot issue full refunds but if customer wants that then the...

only route to take is to pursue with Chrysler corporation and wait for their resolution-we will await the outcome and be happy to assist with the customer and factory resolution-[redacted]

Initial Business Response /* (1000, 5, 2015/02/20) */
The check is being sent in the mail on Monday.
