Initial Business Response /* (1000, 8, 2015/12/11) */
This is the first time in any correspondence with Ms*** that I have heard of any repair to her ceiling that hasn't been completedThe property has a small area that is posted as "Guest Parking"Homeowners are parking in this areaThe
only way I can enforce it is if I am notified when a homeowner is parked in this area and then we can call the tow truckI am not notified until the next day or even the next couple of daysWe do not have an on-site manager at this property as it is a homeowners association
Initial Consumer Rebuttal /* (3000, 10, 2015/12/14) */
(The consumer indicated he/she DID NOT accept the response from the business.)
We have contacted them many times about the ceiling repair, and I have all the emails to show this
The same vehicles are parked in guest parking all the time, and one of them has a flat tire and exhaust pipe hanging downI also sent multiple emails regarding this with photos and the vehicle is still thereThey have not ever called a tow truck, or even notified the homeowners that they are violating a rule

Initial Business Response /* (1000, 5, 2015/06/19) */
[redacted] originally replied to an ad about a studio apartment we had for rent. Upon getting to the building she said she would be more interested in a one bedroom. I told her we had one available but it was in horrible condition. She opted...

to see it anyway. I did show her the vacant studio to show her what the unit would look like when completed. We discussed the possibility of new flooring in the bathroom if we weren't able to find replacement tiles, which we did find. I told her we were pricing out new cabinets, not that we were for sure going to be putting them in. The owner decided to have them painted instead of replaced. The unit was painted from ceiling to floor along with the cabinets, received new carpet and padding, new blinds, a new faucet and new light fixtures. It was cleaned. [redacted] showed me pictures indicating that the pipe behind the toilet wasn't clean, the shower curtain rod wasn't clean and the shelves in the closet had been wiped but not scrubbed clean. I told her I pay cleaners $10 per hour and that I would give her $100 off of her rent, which was ten hours, to compensate for her frustration. When they continued to state how unhappy they were I told them they could move out without any penalty and have their deposit refunded back to them, which they declined. As of today I have not heard that they are moving out of the apartment. The $70 they paid was paid directly to the screening company to perform the background checks. I am okay with refunding their deposit in full, however we are not willing to pay for a moving truck or paper to line the cabinets.
Initial Consumer Rebuttal /* (3000, 7, 2015/06/21) */
(The consumer indicated he/she DID NOT accept the response from the business.)
Yes, Jessica is correct - I did view the Studio apartment on Thursday May 7, 2015. This apartment was in great condition and Jessica stated that the apartment would be in this condition when we move into the 1 bedroom that would be available for the 1st of June. However, that was not the case.
The 1 bedroom when we moved in was absolutely filthy. I have additional individuals including family and caretaker of the building who all were shocked with how gross this property was. The caretaker stated that she would be angry and disgusted if she had to move into an apartment. Scrubbing the closets? I have a video of my mother just wiping the shelves and so much filth came off them...so the shelves in any of the closets were not cleaned at all, along with the doors (both inside and out).
I am still requesting the $70 Application Fee back regardless of it going to Westport or a 3rd party vendor and the $80 for a moving truck. We would have never applied for this apartment if we knew that the work wasn't going to be done as discussed and promised by Westport.
As you can see from the attachment - the email from Jessica does not state at all that the bathroom floor might be replaced, but in fact it will be. After another email from her it states that she will be contacting the landlord to confirm, however we rang her and she did not say anything about the tiles possibly being replaced, but in fact that they will be. It was not until we moved in, signed the lease and complained and questioned this with her that she then changed her statement.
I agree that the walls have been painted however the bathroom ceiling was not painted. From Jessica's email again it states that all ceilings will be painted.
Though I agree that most of the things Westport stated were replaced, the light fixtures have not been. I have evidence that it's the same one as before, just cleaned. However, Westport have replaced the switch covers - but left the switches and outlets absolutely filthy.
In Jessica's email it also states that the cabinets will be relined. They failed to do this, therefore I'm asking for the $20 back in the liner as well.
When it got cool one evening in June, we were very cold and tried to turn the heat on - we did not know that they shut our heat off. When I questioned Westport it took me 3 days to get a response back from the management and it was a very rude statement that it gets shut off in the summer months. That is something Westport should have explained to us. We also still do NOT have our intercom set up despite various emails to the Westport asking them to do this for us. It's under our impression that they do not know how to do this - and still we are waiting for a response from them.
We are not only disgusted with the lack of professionalism this team have shown us, but the disgusting property that we were told would be in a much cleaner, nicer shape.
Yes on Friday May 29th at 1:45pm Jessica offered to let us end our rental agreement by the Monday May 30th at 12pm and be out. Although we tried contacting several rental apartments within the area we heard the same response which was, our application process would take between 3-5 business days to be completed before we could move -in. Therefore we were 'stuck' with this place until we found something.
Thank you for agreeing to provide us our full deposit but I am still continuing to request the rest reimbursements as described. We moved into this place with the understanding of what Jessica/Westport told us - but now need to move out again because they have not adhered to their agreement, and it wasn't until after the fact that they told us the work wasn't done and they can change their mind after we signed the contract?! If this is Westport's policy they need to be upfront with customers ahead of time so that they are aware of this T&C. I can only continue to state if we didn't take this property we would not have spent the $70 for the application fee, but also the additional $80 for the moving truck and the $20 for the lining on top of it.
Thank you.
[redacted] and [redacted].

Initial Business Response /* (1000, 12, 2016/02/03) */
First we apologize if the manager missed any calls with [redacted]. This was so long ago he doesn't recall any conversations he had with [redacted]. In replacing the garage door panels the manager was following the direction of the board. The board...

decided what doors needed to be replaced. They chose doors/panels needing replacement on the amount of damage there was to the door. [redacted] stated the garage door company stated they were going to use the undamaged panels on another door. They are not our employees and we have no control over what they say to our clients. The board had a meeting on July 16th and voted to replace damaged garage doors (see attached). On September 16th a letter was sent to [redacted] and other members that needed panels replaced letting them know that the board would be replacing her door, what the cost would be and that the owner needs to contact Great Garage Door and schedule the work, [redacted] contacted them and scheduled the work to be done. There were approximately 90 doors that were replaced. [redacted] states her door had cracks in two panels. All the panels needed to be replaced at that point or they would not look uniform with the other doors that had their panels replaced as Scott McKay stated. As the agent for McKnight Townhomes it is our job to follow through with the directives of the board of directors which is what we did. As she said Lance was on vacation and if he missed her call we are extremely sorry about this. At the same time the association has a board meeting the third Thursday of every month and all members are welcome. [redacted] was welcome to attend a meeting and express her concerns but she did not do that. Again, we apologize for any problems this may have caused her and she is welcome to attend a board meeting to express her concerns. Any adjustments made to the bill must be approved by the board of directors, management does not have the authority do make this call. Thank you for hearin gus out.
