I am rejecting this response because:If Westwood was truly interested in resolving many of these
issues they would have allowed their subcontractor to come out and try to fix
the kitchen floorThe subcontractor never got the opportunity to work on our
floorThey were waiting for Westwood to scheduled them last April but Westwood
never scheduled them and they would not come out without Westwood’s approval
If Westwood spent five minutes to remove the nail left in
our carpet and finish the job on our upstairs floor, these would not be issues
Instead of taking the easy and high road, Westwood wants to fight to make a
point
If Westwood made a little honest effort on these issues, we may
not have made a complaint
Westwood should receive a failing grade for 1) not repairing
issues they promised to fix when we purchased the home; 2) withholding vital
information defects with the house might not be repairable until it is too late for a
homeowner to file a claim; 3) not fixing damage they created while trying to make
repairs and 4) trying to use their "warranty" to get out of work they promised to perform 5) lying and misrepresenting the facts when trying to defend their
actions to the Revdex.com
Westwood has been clear they would prefer to litigate
knowing the cost and time is a much greater burden for consumers then on a
large company with attorneys on contractIf they didn’t, they would have taken
the simple steps above
Westwood has not disputed any of our claims and we have all the
evidence on our sideWhen they could not lie and misrepresent the facts, they
try to deflect the issues with their one sided “warranty”
Westwood knew the problem with our kitchen flooring was far
more extensive then they disclosed to usThey promised to fix it as part of
the one-year warranty fix upWe lived with the defective floor for a year
believing they would repair it as they promisedBy the time they disclosed the
problem would not be fixed, we were past our one-year limit to file a warranty
claim or complaint with the CCBIt is no wonder they have not lost a warranty claim if this
is how they operateThey promise work will be done and fail to disclose information until the homeowner is past their filling date
Westwood agrees they damaged our ceiling and are trying to
hide under their “warranty” to avoid fixing their damageUnder their
interpretation of their “warranty” they can burn our house down making a repair and not be
accountableThey are still responsible for fixing the damage under Oregon law
as any other contractor would be.If Westwood refuses to act responsibly to repair the harm they caused, we will make our case to the Attorney General

In the warranty manual (attached) the coverage for the home is clearly defined, and the builder’s obligations for each covered item are clearly defined.? We purchase a warranty that was created by an unbiased third party with the intent of maintaining a reasonable set of expectations between us and our customers.? ? This warranty also provides avenues for binding dispute resolution that follows industry standards that we are obligated to adhere to when a dispute arises.? ? To date, we have not been to a single warranty arbitration.? ? ? Once the warranty expires it is the home owners obligation to maintain their home.? ? ? We have worked in good faith to try and please the buyer of this home and regret hearing that they remain unhappy.? ? We have been back to address items long after the warranty expired, and feel we have gone above and beyond to try and find an amicable solution for the homeowners and that the home was properly constructed? We strive to please all of our home buyers, and we build a high quality home.? ? This is our final response on this matter ? ?

Below corresponds to their numbered grievances:? We visited this home twice while we were taking care of the warranty punch list and was not shown anywhere that plumbers putty was used to repair drywall.? We have sent the drywall company to this house twice to make repairs.? The
second time was a courtesy beyond the warranty to appease the homeownersThe home is out of warranty and none of this was brought up during the warranty.? We are not aware of any wet beams in the home.? Expanding and contracting is a property of wood.? Drywall cracks are and after the first year are considered a homeowner maintenance item.? A squeak free floor cannot be guaranteed and was never guaranteed to the homeowner.? On multiple occasions we told the homeowner that we will do our best to try to eliminate floor squeaks but that it cannot always be accomplished.? We have had our framer out times to try to fix the floor squeaks.? Our framer says that the homeowner, ***, gave his approval of the floors at the end of his last visit? We have gone above and beyond here and will do no more.? The homeowner claims we installed a nail in a high traffic area but he never mentioned it until after the warranty was expired.? The septic electrical box that the homeowner claims we broke was not broken at the walk-through and was not noted on as an item needing repair.? We also had a separate meeting with the homeowners and the septic system installers to give a rundown of the system and the box was in fine shape at that time tooObviously, the homeowner caused this damage.? The fireplace vent is built to code and installed per manufacturers specifications.? This homeowner has also filed a complaint with the CCB? The CCB denied their claim? This homeowner is not happy and our efforts above and beyond have clearly not been enough for them? We have honored the warranty and have gone above and beyond it on several occasions.? I am rejecting this response because:MrB***’s response is more of the same lies and manipulations Westwood Homes has been usingWe have at least seven examples where they are intentionally deceitful or manipulating the facts.MrB*** states “Our framer says that the homeowner, ***, gave his approval of the floors at the end of his last visit.” Please review our email correspondence with Westview from April 20, at 10:AM and his employee’s response proving MrB***’s statement an outright lie.Westwood’s framer and assistant left by exiting our crawlspace and walked right past me while avoiding eye contact and continued to their truck without saying a single wordThey left our crawlspace access door open and lights on as if they were coming back with another toolThey drove off and never returned.Westwood’s framer was scheduled to repair our upstairs subfloor and remove a nail during the same visitAnother contractor was upstairs waiting for themThe framer never spoke to me, I never gave my approval and if I had spoken to the framer after the kitchen floor repair, I would have asked why he was leaving before repairing the upstairs.? When we inspected the house before closing, the kitchen floor made a very loud noise far beyond standardsWestwood’s agent and employee both agreed the floor was beyond any standards and needed repairThey told us Westwood would repair the floorThey sold us on their “Warranty” that at the very least it would be repaired when they do their one year fix up.Westwood failed to disclose they knew the floor was far worse than their agent and employee told us going into closingOnly after we waited a year for their warranty fix up did they disclose their framer independently inspected our floor before our closing and informed Westwood he could not repair itWestwood was obligated to inform us of their findings before we closed and failed to do soWe would have requested funds be held in escrow until repairs were completed if we had known the information Westwood withheld from us.MrB*** is lying about us complaining about a minor squeakNot only did his employee and agent inform Westwood the noise is far beyond standard but Westwood’s own subcontractor called them from our house and spent minutes explaining to Westwood how the subfloor creates a very abnormally loud noiseThe subcontractor held out his phone to demonstrate how loud the noise was over the phone(the call was made on February 17, at 12:pm if MrB*** wants us to back that statement)Nowhere in Westwood's file does anyone who has seen the problem call this a floor squeak.We invited Westwood’s manager multiple times to see the problem first hand, he refusedOnly by filing with the CCB did Westwood’s manager agree to personally inspect the floorAfter rearranging our schedules to meet with Westwood, they had the audacity to cancel by email minutes before our meeting was to take place.Westwood’s management is in no position to comment on the extent of the problem when they refuse to come out and personally examine the problemTheir own employee, agent and subcontractor all agree the noise is beyond any standardOur floors have plenty of other squeaks we never complained about.? The ONLY reason the CCB did not act was because Westwood’s deceit caused us to delay filing timelyIf Westwood properly disclosed their framer’s original findings, we would have made timely filings with the CCBTheir deceit and stalling tactics prevented us from taking timely actionWe are 100% certain we would have won if we filed timelyIf MrB*** believes the CCB would have sided with him if we filled timely, he should be able to state his case.? Westwood’s portrayal their framer came out three times to make repairs is disingenuousWe were not aware of the first trip before our closing because Westwood failed to disclose that visit or their framer’s findings.Westwood’s framer visited us just after we moved in to fix another abnormally loud noise in the middle of a high traffic area in our master bedroomWestwood said nothing about this visit ending their warranty obligation to repair additional areas of our floorsThe framer put some nails through our carpet to secure the master bedroom subfloorWe briefly discussed repairing other parts of the upstairs flooring and the kitchen floorThe framer suggested we wait until the one year fix up to see if other floors start acting up and they can repair everything at onceThat was the visit when they left a nail sticking up in our carpet.Westwood also lied in their rebuttal stating that nail was not included in our list of items to be repairedAttached is our list of items submitted to Westwood for repairIt includes the nail and fixing a floor squeak in a second bedroom.After the flooring subcontractor told Westwood how bad noise was, Westwood agreed to send the framer out and coordinate repairs in the kitchen and upstairs subfloor with the flooring subcontractorThe subcontractor’s carpet installers were at our house to pull back the carpet for the framer so nails would not need to be pounded through the carpetThis was the visit when the framer abruptly left and never returned.The upstairs repairs would probably take minutesThey were included in our repair list from the beginning and included in their warranty (see attached)Westwood is just intent to force us to spend time and energy to fix these minor issues.? The damage to our ceiling was caused when Westwood sent their painters to make their one-year repairAttached are pictures of the damageTheir painting crew forgot to bring spackleI was on the phone when they asked if they could use spackle they found in our garageThey were already in our garage to get the house paint and our spackle was on a shelf in plain sight with some painting itemsThe plumber’s putty was on a different shelf with some plumbing itemsThe containers look similar and they grabbed wrong containerSince they are professional painters, they should have known what they grabbed once they opened the jar.Their painters went upstairs, made repairs and leftWe know they used plumbers putty instead of spackle because they left the plumber’s putty on top of the paint they used when they returned everything to our garage.We asked Westwood to repair the ceiling and their head painter came outHe was not with the crew when they worked on the ceilingHe found further repairs could not be made because Westwood’s drywall installer left too large of a gap between the edge of our skylight and the gypsum board in the ceilingWestwood’s drywall installer taped over the large gap to hide itThe head painter told Westwood over on the phone the repair area was too soft and required installing a strip of gypsum board that should have installed during construction.Westwood agreed it was their painters who caused the damage and agreed to repair the damageThey delayed sending someone to fix the drywallAfter a couple of weeks, they turn around and said they would not do anything.? A couple of months after we moved in, the frame in our master bedroom wall shifted down leaving a half inch gap between the frame and joist and a corresponding crack in the drywallWestwood came out to inspect the wall and informed us it was due to a wet beam that shrank as it driedWe were told once the moisture is out of the beam everything will stabilize and be fineThey repaired the dry wall and we trusted everything would be as they told us.However, the wall continued to move and the crack reopenedWe are concerned there is a different underlying issue then a wet beam and we will need to repair the wall every year due to a defect from construction of the houseWe want the reopened crack repaired at the very least.? The electrical septic box is another example of Westwood pointing fingers without mentioning other pertinent factsWe believe Westwood used the same box that came with the house they tore down before building this houseThe crack is consistent with the end of a small scrap piece of 2xlanding on top of the box during tear down or construction.There was a hairline crack in the top of the box that went unnoticed during the inspection at the end of August after a dry summerThe crack is just enough for rain water to into our electrical box and drip on the components insideWe only detected it after rains intruded the electrical system.We would gladly to testify we did absolutely nothing to the box that could have caused the crackThis was something we were not going to complain about when Westwood ignored our request to repair itThis is on the table because Westwood failed to handle any of the major issues correctly.We attached copies of the emails we referred to, the repair list submitted to Westwood and pictures of the ceiling damageWe can also send you video of the floor noise.We will be very happy to send you additional emails to support our facts.Thank you for your consideration.Sincerely,
