Westwood Sierra Apartments

My friend and I each paid a $15.00 application fee to try and get an apartment at Westwood Sierra Apartments. The application fee was submitted roughly right around Christmas. We were informed by the man (I forgot his name, but he is the one that answers the phone all the time) that the owners were out of the country and he didn't know when they would be back so our application could not be processed. He said he thought they would be back after the New Year. I had my mom call and speak with that guy to find out what was going on. He had informed my mom of the same thing. He also informed my mom he would give the application fee back. I called after the New Year to see whether or not if the owners had gotten back and whether or not or application was accepted. That guy told me well your mom called and said you were going to look for another apartment so I already rented the apartment to somebody else. Now he will not give us our application fees back. He never processed that application.Desired SettlementI want my $15.00 back. Business Response [redacted] & friend came to Westwood Sierra looking to rent an apartment. They paid a non-refundable $15 application fee. A few days later his application was approved and I called and told him it was ok'd, however the apartment wasn't ready and that maintenance was off until after the 1st of the year. His mother then called, I advised her the same. She argued with me, raising her voice, I then told her I would refund the fee and they could look elsewhere. Then I asked what they wanted to do. She then stated they would look elsewhere. [redacted] called back approx. 10 days later, asking when they could move in, I advised that I rented the apartment to someone else. The friend called and got very abusive. Approximately 1 month later [redacted] comes to the office requesting that his application fee be refunded, I was unable to give him his refund as I do not keep cash in the office. Mother then called became abusive, I told her to send [redacted] back to my office and I would write him a personal check. On 1/28 I started receiving harassing/abusive phone calls (approx 16 calls) regarding this matter. (I have several of these calls saved on my answering machine.) On the last call I told the caller that I was going to call the police and I had their phone number. They then hung up.
