A***'s April 20th email and his letter to the Revdex.com, MrA*** admitted fault
MrA***'s April 20th email follows:

As discussed, we had an issue with our octane gasoline tank
last week
We believe we had some ground water seep into the underground
tank through a faulty gasket on a monitoring port
Because gasoline now contains 10% ethanol only a very small
amount of water will cause a condition called phase separation whereas the
ethanol gets separated from the gasoline and will not burn correctly in some
vehicles
We shut down the tank last week and remedied the problem but you
may have received some residual contaminated product when you fueled your car
today
Please have your vehicle repaired at a shop of your choice and
submit the repair bill to me and we will reimburse you for all costs due to the
gasoline
If you need a rental car while yours is being repaired you may
submit that bill also

In addition to admitting fault, MrA***'s email explicitly
states: "Please have your vehicle repaired at a shop of your
choice and submit the repair bill to me and we will reimburse you for
all costs due to the gasoline. If you need a rental car while yours is
being repaired you may submit that bill also."
Furthermore, as noted in MrA***'s letter to the Revdex.com, I
informed MrA*** the repair costs and rental car fees would be substantialMr
A*** and I had a long discussion regarding the estimateHe of course accused
me of "being fleeced and scammed" and said I was
"ridiculous" or something to that effectIn any case, at the end of
the discussion, MrA*** did assure me I would be repaid, either by him
directly, or if the bill were as high as estimated, by his insuranceWe
discussed the estimate at length and the time it would take to get all the
parts to repair my carI was forward with MrA*** and very clear about
wanting my car returned to its original state before MrA***'s negligence
damaged my car. MrA*** authorized my repair and the car rental
Unfortunately for me, I made the mistake of stopping at Mr
A***'s station and getting fuel contaminated with a substantial amount of
water and organic particulatesUnfortunately for MrA***, he had the
misfortune of damaging a car that was mechanically sound, having only recently
been restoredHe also had the misfortune of damaging a car owned by someone
whose father not only restored the car but specialized in German and Italian
car repair for over yearsI went through a great deal of trouble and
expense to bring my car up to a certain standardI am not from this area, nor
from this climateI created a reliable car that would require nothing more
than routine maintenance and tire changes during my time hereI spent a lot of
money and time on my car because I did not want anyone other than my father
ever working on my car while here and because I simply do not have the time to
fret about car repairsAs it stands, I am in clinic quickly typing out this
note because I worked nights and days last week and straight through the
weekendI am exhausted and dismayed that my time and attention are being
taken away from patients for what I consider nonsenseI have two OB patients
to see in the next few minutes followed by elderly patients with chronic,
serious problemsI simply do not have any time to deal with car repair, much
less MrA***'s objections and abuseI am frazzled, upset, and distracted
because of MrA***'s negligence and unprofessional conductHe has had
plenty of time to handle my claim in a fair and objective manner, yet he
refusesI do not appreciate being accused of dishonesty, nor do I appreciate Mr
A***'s abuse and bullying. MrA***
ruined my car, encouraged me to pay for repairs and rental car fees out of my
pocket, authorized the repairs with the assurance I would be repaid in full and
now is simply trying to get out of paying by claiming fraud I have a fair and accurate invoice and rental
car receipts and stand behind both. MrA*** has defrauded me out of my time and several thousand
dollars

In response to your letter of complaint received from *** ***, our response is as follows:Wever Petroleum Inc does not dispute the fact that we had water contamination on the date notedWehad a seal fail on a monitoring probe which allowed a small amount of ground water to enter
theunderground tank which caused a condition called phase separationWhen we became aware of theproblem we shut down the tank and remediated the issueUnfortunately we had some customerspurchase the contaminated fuel which caused them to have issues with their cars running properly.We were in contact with all customers, explained the situation and asked them to have their vehiclerepaired and we would reimburse them for any damages caused by the gas contaminationEveryonehad their vehicles repaired in about a week, submitted their repair bills to us and we paid themimmediately along with a gift card for their inconvenienceAll repair costs were between $and$approximately.*** *** however claimed that her car was destroyed and her repairs would be well over $8000dollars, I responded that if the repairs were reasonable Iwould submit them to my insurance companyfor paymentThirty-six days later *** contacted me and sent her repair bill totaling $alongwith rental car receipts totaling over $The repair bill was hand written on a generic repair orderform with no information at all of who or what business repaired vehicleI forwarded it to my insurancecompany and discussed the fact that the receipt looked suspect as to validityThey assured me theywould follow up on the claim and submit it for payment as long as it was legitimateThey contacted*** for further information about the repair shop and they found that it was a shop located in Texasthat is closed for business and upon further investigation found that it was owned by Jaime's fatherSheresponded that he drove up from Texas to repair her carThe insurance company sent an adjuster out tolook at repairs and request old parts and receipts for items supposedly installed on vehicle*** hasrefused to supply receipts and stated that all old parts were discardedAt this time the insurancecompany is waiting for final report from the inspector/adjuster which should be completed this week,but has stated that they are holding back any payment until supporting documents are submittedIagree with their decision.Further, *** has been next to impossible to work with during this issueI have always returned hercalls and repeatedly suggested that if she would supply the information that the insurance company islooking for they will respond to her claimShe has repeatedly told me she hopes I burn and rot in hell,called me names, called the adjuster that went to look at her car a "little twerp": who know nothing andrefuses to work with them in any wayWe have, in no way, hidden the fuel problem as she stated andhave been more than upfront with everyone involvedIf anyone is being dishonest it is *** whorefuses to cooperate with any legitimate requestsI personally feel that this is a fraudulent claim at best,trying to take advantage of the situation.Thank you for the opportunity to submit our side of the issuePlease feel free to contact me with anyquestions or if you need any further information.Thank you,Michael A***Wever Petroleum IncS Hudson StreetMechanicville NY 12118###-###-####
