Dear Ms [redacted],

We are troubled to hear about your situation. I do see that you applied for a loan, but never took it out to the best of my knowledge; therefore we have no reason to be contacting you. Unfortunately, someone may be cloning our phone ID to call you. We never threaten people and we would never call you and ask you for your social security number. We have a process in place for our customers to protect them from scams of people calling and pretending to be us. Our customers are to ask the caller for their security code and if the called doesn't know it the customer should hang up. Please let us know if we can do anything to help. Should they leave you a number to call, we will be more than happy to report the caller.

Sincerely,

Dear Mr. [redacted],

Please be advised that your account was settled per you agreement with [redacted] on 8/31/13. Up until then your were paying the loan off per your loan agreement, based on the fact that you did not pay the loan off in full on your first payday. Again as a courtesy, $442 was waived on your account to settle it out.

Should you require a copy of the loan agreement, please advise and I will have one sent to you as soon as possible.

Review: Signed agreement with White Hills cash. Was charged more than agreed amount by a company they gave my account to without my knowledge or consent.

I signed an agreement with White Hills Cash for $550. I was told my first payment would be $125 (discounted 25%) plus $10 for the wire transfer fee. This morning my account was debited $173 by [redacted] Cash. I called White Hills and they could not tell me why I was charged more nor could they credit me for approximately a week. On top of that, I was not informed that my loan would be handled by a company that I did not authorize. So my checking account was debited more than agreed on by a company I did not know about and now my checking account is going to overdraft and they won't do anything for about a week. I have used this service before and payed far too much interest charges. I thought long and hard before using it again knowing because of the charges incurred but emergency situation came up and I had to do something. I should have stuck with my gut because I got violated by more than just their usual over-the-top fees.Desired Settlement: I request that my account be canceled and no more debits be taken by White Hills Cash or [redacted] for failure to notify me of changes to my account and for over charging me causing my checking account to overdraft. After this payment I feel that it is more than fair that they terminate my account as satisfied and cease marketing or contact with me. I have also paid them in enough in the past to more than make up for the remainder of my loan amount.

Response:

Dear Ms. [redacted],

I have reviewed your file and in response to your complaint, I so see the following:

You requested and received a loan for $550.00 on 1/7/14. Shortly after that your account was assigned to [redacted], which we have permission to do via the contact you signed. Unfortunately there was a system glitch and your account was debited $173.73 in error. I see that once you made the company aware of the error, you received a $40 credit into your bank account. Your account now reflects the 25% discount off the first finance charge and a courtesy discount of $10 off the principal.

Should you fax me your bank statement of any over drafts, that were caused because of the system glitch, I will be more than happy to work something out in your favor. As of right now I have stopped any automatic debit from your account. Your balance with [redacted] as of today is $540. I will be happy to request [redacted] to reduce that balance by $130, if you call and set up some type of pay back arrangements. As I am working in concert with their manager to help resolve this issue.

Review: In October 2012 I received $330.00 from White Hills Cash. Since then I have paid $510.00 and only $41.00 has been applied toward the principle. I have a lot of medical issues and a lot of medical bills. I find it difficult to keep up with the payments. I have tried to explain the situation to them but they show no compassion and are unwilling to make a settlement.Desired Settlement: I would like White Hills Cash to accept what I have paid and close my account.

Review: I missed a payment. The company charged me late fees, collection fees, and interest in addition to my missed pmt. My principal did not decrease.

I missed a payment. The company charged me late fees, collection fees, and interest in addition to my missed pmt. My principal did not decrease, it increased. The representative informed me that all of the fees are separate from my principal payments. She could not explain practice. She said I needed to pay $155 in collection fees and $90 for the current month payment.Desired Settlement: Eliminate the excessive fees.

Review: Hello I have made an agreement with this company in regards to a $400.00 loan. My agreement was to pay them back 120.00 a month with interest involved but they're trying to make me pay them back over $3400.00. Their interest rate is over 800%. That does not sound right or legal. I want to see what they can actually charge me so that I can pay off this loan and be done with them. I am not even sure if they are licensed to do that kind of business in Colorado but I need to know what my rights are and if we can address this complaint with them asap? Please assist me with this complaint and any recourse that you can? Thank youDesired Settlement: I just want to get this loan off my record and settle on a payment to them that is reasonable. I have already made 5 payments of $120.00 which I can provide proof for. That is $500.00. How much more are they wanting that is reasonable to get this loan off my accnt and my bank account.

Dear Ms. [redacted],

Review: Whitehill cash has been charging my checking account with [redacted], on the strenght of an application that was placed on a closed account, with [redacted]. They have charged my account roughly $475 on a supposively $500 cash advance. When I spoke with the customer service representive,[redacted] of Whitehill cash, she indicated that I needed to let them see that the account number they claim to have funded does not agree with my current account and they would refund the money. Whitehill cash still claims to this and is preparing to charge my account once again on 6/14/2013, some $125. I would like for my funds to be refunded and them to stop charging my account.Desired Settlement: I would like for my funds to be refunded and them to stop charging my account, immediately!

Review: A coworker informed me on 4/30/14 that she had received a phone call for me at work. The call was from "[redacted]" with White Hills Cash, and I was supposed to return his call ASAP at

###-###-####. Several extended family members have also received phone calls for me at their residences recently. Although I don't know or sure, I suspect these calls may also have been from White Hills. I called the number later that evening, and spoke to a representive. She said that I had an account with them that was over 300-plus days delinquent, and they were trying to collect payment. I have used White Hills Cash in the past, but my accounts were paid in full and I informed her of this. She said that I had a payment agreement with them (over a year ago, apparently) and that my last arranged payment did not clear my bank. I have not heard from this company at all during the past year, and told her this. She said there have been multiple phone calls and e-mails sent to me, which I have NOT received. She said that one had in fact been sent that day. I had her hold while I checked my e-mail account, and there was none from them. I even checked my spam folder at her suggestion. She said she would report this issue to her supervisor. I told her that if they could provide me with some record of my previous loans and payments via mail or e-mail, that I would review it, but as far as I was concerned I didn't owe them anything. I don't understand why I am hearing from them now after supposedly owing this money for over a year. The bank account that I had while I did have loans with them is now closed, so I don't have any records of what I received or paid. I DO know without question, though, that with their ridiculous interest rates I paid them back what I originally borrowed and much, much more! I have done some research on this company, and have found that they are not licensed nor even legally allowed to operate in Ohio, over the internet or otherwise. I also have read the numerous complaints from others through your agency.Desired Settlement: I want White Hills to clear my account and stop contacting me immediately at home and at my workplace.

Revdex.com,

I have reviewed the response made by the business in reference to complaint ID [redacted] and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.

As I stated before, I believe that my balance was paid in full. I recall initially borrowing an amount in the range of $300-$400 from them. I know the loan was carried over for several months and I was charged $90-$100 every two weeks. I am certain that I paid back the money that I borrowed plus much much more in exorbitant interest fees. I have asked the company to send me an overview of any loan and payment activity they have so that I can review it. I am not simply going to "settle" and make a payment on a loan that I do not owe. Also, the e-mail address they have for me is incorrect, which explains why I never received any e-mails from them. Furthermore, since dealing with this company in the past, I have found that they are not even legally allowed to operate or make loans in the state of Ohio, which should make any contract I had with them null and void. However, they did not address this issue in their reply.

Review: In July 2013 I borrowed $305, since then White Hill has dedeucted bi weekly $91.50, which shouwl have paid this loan off. As per my conversation with this company I haven't even been paying on the principal. This wasn't disclosed to me in the contract. As a result I have defferred all ACH withdrawals. This company has been paid over $600 for this loan. Additionally, this company is harrasing references supplied to them. They have called me at work to collect this debt several times per day. I have been written up due to this and may lose my job for allowing them to contact my agency. Please refrain from further contact unless via snail mail. As a consumer, I'm prepared to fight this battle in court if a resolution cannot be made by both parties. This company has collected on this debt way over.Desired Settlement: Zero balance my account due to terms no fully explained. Additionally,I've been harrased and threaten by representatives calling me. Latest call on 10/21/13 rep refused to provide her name and suggested that she will continue to call me and references.

Review: I applied for a payday loan thru a company called [redacted]. The loan was suppose to be for $1000 to $1500. I never heard back from the approval for [redacted]. However, I did get an email from White Hills Cash stating that I had a payment due. Because they had deposited $255 into my account. I tried calling and emailing them several time in regards to the loan. I got know response back. Finally they sent me another payment notice in July and I sent another email back to them asking to explain about the paying back the $250, they replied back and said they had no record, so I replied back and pasted the email that they had sent me (I still have the correspondence). I called and spoke to a collection agent about the loan and they transferred me to the loan department. I then spoke with a Jovana Martin; I asked her about the loan, and I explained to her that I never put in a loan with them. She began to explain about a contract and I told the I never signed a contract with them. I asked her to send it to me. So she emailed me the contract, and it was the contract for the $1500 that I had done for the Pick The Loan.com. These people are doing business under another company name and passing off contract to them. I am not a dumb man or ignorant, and I would never consent or sign an agreement to payback $1,722 to borrow $250 at 675.75 interest rate.Desired Settlement: I have paid them $459 dollars to date and I want my account closed and settled.

I do apologize that is has taken me so long to respond. My email if filled daily and somehow this was

overlooked.

We do not know [redacted]. It could possibility be a site of one of our

lead providers. That may be the reason

you never heard back from them. I do

show that we receive an application filled out by you and that received a $305

loan on 5/7/13 and that this particular loan was paid Off by 5/31/13. Then you requested another loan for $330 on

6/4/13. We spoke with you several times

when you called in to check on balances, as to whether or not you qualified for

another loan and when you wanted us to move you due date of 5 days. We did accommodate your request to move your

due date on 6/26/13 and have not been able to reach you since.

If you were emailing [redacted] we would not have

received it. I do show that you

completed two separate agreements one for #305 and one for $330. None of the

numbers you refer to in your complaint refer to any of our loans, outstanding

balance or interest rate for you.

Your balance due is $588 as of now, as a courtesy, we will

waive all your fees and settle your account for the $330 in principal that you

owe. We will also be happy to offer you

interest free payment arrangements to help you with this situation.

Please let us know if you want us to email you copies of

your agreements.

I do apologize that is has taken me so long to respond. My email is filled daily and somehow this was overlooked. To respond to your claim that we do not work under the name [redacted] nor do I know [redacted]. It could possibility be a site of one of our lead providers. That may be the reason you never heard back from them. I do show that we receive an application filled out by you and that you received a $255 loan on 5/23/13. I also see that you called in to have your paydays re-set from semi-monthly to bi-weekly this month. The Truth In lending Disclosure which is part of the contact you provided an e-signature on does provide a schedule that shows that if you chose not to pay your loan back in full and you follow the payment schedule on it, that you APR would be 675.57% and that your total payments would be $1722. This is why we send emails and encourage our customer to pay the loan in full on the first due date.

As a courtesy, we are waiving the balance of your loan and considering it settled.

Review: I have received several payday loans from White Hills Cash in the past - and never had a problem. I've settled several of my loans with them. However, this current loan is horrible. I've no idea what's going on with their systems, however, I received an email stating that there was a problem with their system, and that they were unable to process the payments via ACH - and they were requesting my debit card information. I thought this was odd, because looking at my bank account, they are still taking funds out via ACH. So I did not give them my debit card information. Every payday, they withdraw money from my account, however, I keep getting several telephone calls from them both on my cell phone and my work phone (I'm not allowed to get calls at work, which has also caused issues). I also get emails stating that they are marking my account as "refusal to pay" and that they are going to report my to chex systems. I feel as though this is unethical, and I also feel it as threatening. They are taking money out of my bank account, so I'm not sure what their issue is.Desired Settlement: I want White Hills Cash to stop harassing me at home and work! I'm paying on my loan, so there is no reason they should be having their collections department harassing me.

Business

Response:

Dear Mr. [redacted],

White Hills Cash always strives to provide excellent customer service and we are very sorry for any confusion caused by our system's issue. Where the confusion lies is with na $88 NSF we received on 2/14/14. We did have a debit of $19 clear which paid in full loan #[redacted]-**, but the payment for loan #[redacted]-**was returned as NSF. I know that our inability to reach you has also caused a problem so you weren't able to get the correct explanation for the "Refusal to Pay". As a courtesy and based on you Valued Customer Standing with us,effective 4/14/14, the balance remaining on your current loan will be waived.

We are sorry for any inconvenience this may have caused you. Should you have any questions, please give me a call.

Review: I have two loans with this company which I have never missed a payment or been late. I have used there services on several occasions. Recently I received a email from this company stating there was a problem with them getting the payment by [redacted] which was the way I have always paid. I called and gave the made the payment by my debit card as a one time payment. My information was not to be kept on file or stored. I also received several harassing calls after this payment was made. This was on January 10th. I emailed on the 24th of January to see if the [redacted] was going to be drafted. I did not receive a response so I assumed the payment was good. The payment did not come out so I called and made the payment again with my debit card. I also stressed my information was not to be kept on file. Today February 7th I pull up my accounts to review and White hills cash has stored my information on file and drafted a payment from my savings account without my permission. This is against the law and I will be contacting my lawyer in regards to there practices. I called to try and discuss and they would not allow me to speak with a managerDesired Settlement: I would like the remaining balance of these accounts cleared and I will allow that to be the end of this issue. Reference: Case ID [redacted]

Dear Ms [redacted],

The agreement that you were required to read and sign included the Truth In Lending Act that you are referring to which states what you would owe should you choose to make bi-weekly payments in lieu of paying your loan in full. You also received emails prior to each pay day reiterating the terms of the loan so that you could make an educated decision on your needs and capabilities.

By signing your Loan Agreement, you agreed to the application of Ft. Belknap Indian Community law. You agreed to comply with all of the terms and conditions of the Loan Agreement upon execution. White Hills Cash relied upon your representations in good faith and approved your loan based upon such representations.

White Hills Cash always strives for excellent customer service and we are willing to work with you to achieve resolution of your concerns. As a courtesy to you, after today, we will accept your payments up to date to satisfy your principal loan amount and all finance fees incurred with respect to your loan. This means that, as per your request, we now regarding your loan as completely settled and we will not seek additional payments from you or further collect on monies owed under the terms of your Loan Agreement. However, the terms of your contract will stand and we will not be refunding any payments to you. We hope this compromise is satisfactory. We appreciate your business.

Respectfully,

I never received a copy of the loan. I only gave them my informationj over the phone, went on their website and to confirm my information was correct. I do have bank settlements showing that I made the payments that where over the amount that was agreed and the amount that was transfer initially. I also seen that state loans in louisiana don't permit them charging me over 75% interest on a payday loan.

If I never signed anything or agree to the loan does that mean I owe them 700% interest on an illegal loan?

Review: I currently have two open loans with WHC. I have used them prior to these, and recently received suspicious emails from them wanting debit card information saying they were having issues beyond their control and unable to process my ACH payment, which is normally deducted every payday. I have MORE than paid these loans over anyhow, and I am not going to be placed into any unethical scamming to get money. This is probably because their license to lend for Georgia is no longer legal, and if I gave them my debit card information they could take whatever they wanted and find a loophole.Desired Settlement: I want my loans considered paid and closed. Review: I applied for a payday loan and next thing you know I woke up with money in my bank account. I called on this loan because I was never contacted in anyway before the deposit was made in my account. I tried to log on to their webpage with my email and last 4 of my ssn and it said thank you for signing your document. I called to see how I can pay this off they said I would pay 90 every 2 weeks until the 394 was paid off. I took out a 300 loan the 94 was interest. Now they decide whenever they want to take money out of my back account and I called them again today and was told that I pay 90 every 2 weeks as interest only none of that money goes to the loan itself I need help how do I stop them from taking money out of my account. This place needs to be shut down.Desired Settlement: I would like this company shut down it is a complete scam. I need further instruction on how to pay this money back and how do I stop them from attacking my bank account when this was never authorized.

Business

Response:

Dear Ms. [redacted],

Review: Company calls everyday after I have spoken to and have explained the situation and tells me that I haven't spoken to anyone.

On 5/10/2013 I received a call to my job from an agent at White Hills Cash after I have already requested them not to call my job. I told the agent that she is not suppose to call my job and agent proceeded to speak about my situation with out verifying if I was the correct after she pronounced my name incorrectly. I told her that after I tell her she can not call my job there is no conversation. She stated that she can speak about my account because she already called. That would defeat the purpose of not calling someone's job. In that case any collections agent can say,"oops, sorry, but since I already called your job, you are in collections." She, (the agent), violated a federal law by calling my job after I asked for my job not to be called, by not verifying if I was the correct person and also by continuing to speak after I told her that she's not allowed to call my job. Also by not asking if I'm able to talk due to me being at work. I called the company and spoke with an agent who was not helpful then trans me to a super without my knowledge. The super advised that he will speak with agents but the tone and attitude of his leads me to believe that he is not. Being that I see thousands of complaints online in regards to White Hills Cash, someone needs to deal with them promptly.Desired Settlement: Stop calling my job and me everyday after I have made arragements with an agent already. Teach White Hills Cash agents how to speak to borrowers in a professional mannor.
