We were hired 2/22/07 to replace this customers driveway.
We submitted drawings and a copy of our contract and secured a permit...

with the City of Florissant. We set up an inspection and passed it before pouring concrete. The inspections was to see if our rock base was the correct depth, that compaction and form were set up and all was to plan and code. We set up a final inspection for finish and clean up We passed that inspection as well. Customer was pleased. No problems or concerns were mentioned, customer paid in full, signed our completion certificate saying they were happy and we gave them our final Lien Waiver. That was on 5/25/07. I did not hear from this customer again until on or about August of 2014
He said we had done his driveway 2-3 years ago and there was a problem. I promptly went out there. The concrete in the lower sections was a bit discolored and chipping at the expansion joints. The expansion joints were damp and holding water. His driveway is at a low spot on the street and the right side was catching water from his neighbor's yard.
I also explained his driveway was done at that time seven years ago, and was clearly out of warranty.
He said at that time he had several concrete companies out and was told by a couple the driveway needed to be replaced and a couple talked about re-floating the surface. I explained resurfacing would not work and I don't do it. There was nothing wrong with the integrity of the concrete to warrant removal. The problem was cosmetic.
I told him they make concrete stain and paint for driveways but I never used them. I also said I didn't know if they would work with water coming up through the joints.
I went and brought samples and he picked a paint instead of a stain. I agreed to power wash the entire driveway, caulk the expansion seams with caulk and paint the entire driveway with two coats of concrete paint for $1,698.00 on 10/29/14. I was very clear that I could not guarantee that I would work and solve his problem.
I received a call in the spring of 2015. He said the finish was coming up. I promptly went back out. Some areas at expansion joints were discolored and wet plus flaking. I offered to re-caulk and repaint those areas at not charge. He said he did not want that and wanted his money back for the paint job in full. I explained that we had discussed that what he was asking me to do may not work. I reminded him that I clearly told him it was not guaranteed. That the original job was well beyond any kind of implied warranty and had been done to code and under permit with inspections.
I could with clear conscience walked away at the first phone call. I responded and tried to help.
I explained to him that I thought it unfair to expect me to pay for something he hired me to do when I did nothing wrong. He obviously didn't see things my way.
In trying to keep my companies record clean and not getting a Revdex.com complaint, I did tell him I would look over the job and refund him the money above my cost on the paint job only. I told him I was coming out of a hard and slow winter. That I may need to make payments and he said that was fine. I don't remember saying $800, but again I may have, I don't remember.
Its been a couple months and I had not heard from him and frankly it slipped my mind. That's the truth.
I feel my company speaks for itself. My integrity is without question. I feel filing this complaint without so much as a phone call is not only grossly unfair and but also unwarranted.
I was going to refund money, not because this customer is in any way deserving of it, but to keep from getting a Revdex.com complaint on my unblemished record. Both points are moot at this time.
