Initial Business Response /* (1000, 13, 2015/05/17) */
We know we can not please 100% of the people all the time. We need to use contracts to try and minimize any possible confusion and so far we have found way better results from using contracts than not using them. When you have over 350...

students contracts are a must. We are however going to take this feedback very seriously and review the parts that she feels were confusing and will rework them if possible. We did make some changes to the procedure of the front desk staff. In that now anyone that asks for another copy of their agreement (all are given a complete copy of our 2 page contract and one page disclosure upon sign up) they must give out all pages of the agreement and the disclosure to minimize future confusion.
Our agreements have a 3 day right to cancel for any reason and the 30 day written notice she is commenting on is in regards to the end of the agreement and not continuing on more than the 3 years. Yes we do have a moving clause for anyone but mostly used by the military in that if you move more than 25 miles from our location we will cancel the remainder of the agreement. She moved to just over 17 miles from our location which does not qualify for termination. I did confirm that the billing company did not use the toll road in their calculations.
I did not blame the mistake on the employee that is no longer with us. I was just stating a fact while trying to work on a resolution.
I have never heard or at least do not recall ever hearing about the son wanting to leave for personal reasons. I spoke to the main instructor and found out that her son fully enjoyed our classes. I was aware of some personal scheduling issues at most. We have the most liberal attendance policy of any Martial arts school I know of. From my conversation with her she just didn't want to drive any more.
Initial Consumer Rebuttal /* (3000, 17, 2015/05/29) */
(The consumer indicated he/she DID NOT accept the response from the business.)
This issue is not resolved; I am requesting cancellation of my contract from the date of the 30 day written notice dated September 15, 2014 to include the $856.18 they state I owe and any other charges that have been accumulated since the 30 day notice.
As I stated previously when I signed my son up I was told by [redacted] that I could cancel with a 30 day written notice. She even referenced the 30 written notice sections on the checklist (which is represented by a greater than looking sign). The bottom line is, I expressed clearly to the manager what I was told by his employee when signing my son up, I was never presented with the back page of the contract that details a 25 mile move or Doctors note until after I was denied cancellation and was subsequently told that the company places the back page in the folder because THEIR employees forget to copy the back when making the copies of the contract.
I was NEVER presented with the back side of the contract until I disputed the denial of the cancellation. Nor did the company address that in there reply. Why would I not be required to sign or at minimal initial the back side? I signed the front, I initialed up and down the checklist, which referenced the 30 day written notice. Since I was moving, when they requested one of the 2 (lease or doctors evaluation) I had no problem submitting such paperwork.
I made it very clear to the manager when we spoke in person that for personal reasons my son no longer wished to attend (as he says he doesn't recall). My son is 10 years old I did not then nor do I now feel that I need to speak upon his personal situation, any further than he does not wish to attend. I do not feel when dealing with children from the ages of 3 (as they do) it is any of the company's business. I did however after being denied the cancellation and finally being able to meet with the manager, express that for personal reasons my son no longer wished to attend. But I felt more comfortable sending in my lease than releasing my son's personal medical information. At the meeting with the owner, he stated he had nothing to do with the billing co, I then requested a number to the billing company so I could move forward and discuss this with them. He denied me the number stating that I didn't need to speak to the billing company. I stated that I needed to know who in particular I was disputing this contract with and he stated himself. Well which one is it? Before I left his office he offered me an option 50% or 60% "buy out" of the remainder of the contract. I declined and left.
The company speaks upon a "scheduling issue"? On who's part, not mine. I never expressed ANY issue with scheduling as my son could attend ANY day of the week of our choice based on the package I paid for.
Being that I have been Active duty military for 18 years and move frequently, I ALWAYS ensure I ask about ALL cancelation policies for my family. I do not see resolution for my issue. I am requesting cancellation of my contract from the date of the 30 day written notice dated September 15,2014 to include the $856.18 they state I owe and any other charges that have been accumulated since the 30 day notice.
Final Business Response /* (4000, 22, 2015/07/01) */
Our school teaches focus, respect, integrity, discipline and self control through the use and teachings of self defense and martial arts. Parents often come to us to help in teaching these life skills to their children. We, like most parents, recognize that this is not easy or quick. Our instructors pour their hearts and souls into teaching our students. We decided long ago (5 years ago) to change our agreements with our students and their parents that want us to partner with them to teach these children those life skills. For those students who what to make a long term commitment, we partner with them for a 3 year term. This enables our instructors to go to a much deeper level with these students instructing them multiple times per week. If the student or parent is not ready to make that long term commitment, we do offer a 6 month agreement which enables the family to experience martial arts for a much shorter term. Once a family makes a commitment to a 3 year agreement, we are also making a commitment to them for 3 years. Honesty, integrity and responsibility are essential values we are instilling in the children. And yes we expect the parents to honor the agreement that they have made with our school. When you make a commitment to something, you stick with it and follow through to the end. You don't just give up. We have a saying in our school that gets repeated in every class including our class with 3 year old students - Winner never quit and quitter never win. We know that 10 year old children do not know or even care what is best for them - that is the parent's job. That is why prior to signing any agreement with our school, we ask the parent if they are going to make the commitment to follow through with the agreement. We expect that there will be times when their child would rather stay home and play video games instead of learning respect. We always make sure to get this commitment from the parent that they will do whatever is necessary to help us help them foster these values in their children.

Final Consumer Response /* (4200, 24, 2015/07/17) */
(The consumer indicated he/she DID NOT accept the response from the business.)
This issue is not resolved; again when I signed my son up I was told by Tasha that I could cancel with a 30 day written notice. This is the FIRST time I am EVER hearing of a 6 month option. Again, I was told the school was 3 years because that's how long it took to achieve the black belt as long as my son passed [redacted] testing on scheduled dates but I could cancel at ANYTIME with a 30 day written notice. In reference to "just giving up" my son did not, I said he had a personal reason not to attend any longer. Now that there is a "6 month option" that was not offered I'm wondering what the problem is. My son attended over 6 months. This company's entire response has NOTHING to do with my contract and/or a solution. Instead it implies my son is a quitter, lazy, lacks respect and I as his mother lack integrity. They then go on to speak upon "staying home and playing video games". This company lacks business tact to say the least and treading in slanderous territory. As I stated in my previous response I have been Active duty military for 18 years and move frequently, I ALWAYS ensure to ask about ALL cancelation policies for my family. I do not see resolution for my issue. I am requesting cancellation of my contract from the date of the 30 day written notice.
