After reviewing the patient's record I feel that she in entitled to a refund of $of the money she paidI will explain in detail how this was determined.First I need to discuss the type of contacts she was fitted with and how they are ordered and chargedShe was fitted with the ***
*** toric lensesThese are custom, made-to-order contact lenses, for people with high amounts of astigmatismThey are lenses to be worn daily for months and then discardedA years supply consists of four pairs of contacts which retail at $The cost of the contacts are NOT split evenly between the four pairsSince they are custom lenses, an initial pair is ordered in the patient's prescriptionThe patient tries them on and if the vision and fit are good, the lenses and taken home for a weekThe cost of the initial pair is $If, when the patient returns for the one week follow up, the vision and fit are still good, the final pairs can be orderedThese lenses are non returnable and non refundable(as per the manufacturer)Therefore they are not ordered until the patient returns for their follow up visit to make sure they are the correct lenses for that patientThe cost of the three pairs of contacts is $200.The patient first came to me for an eye exam 11/1/and was fitted with the *** lensesShe was dispensed the initial pair 12/10/2014, paid the $and scheduled her week follow up.(I am enclosing the instruction sheet the patient signed) She failed to show up or respond to out phone callsShe called a year later asking to order more contacts, which we could not do.She returned for a new eye exam on 4/9/telling me that she stopped wearing the contacts a month earlier(she used a pair of contacts only good for months for months) At that time her corneas were very irritatedAfter a few weeks her corneas cleared up enough to be refit for contactsI went over the proper use of the contacts and the importance of following all wearing schedules to avoid eye damageOn 5/11/she paid me $depositOn 5/21/I dispensed a new pair of the *** lenses and scheduled her follow up appointment for 6/1/At that time she paid $for the balance(her vision insurance would have covered the balance of the contacts, however since she failed to complete the fitting process we never billed for the contacts, only the exam)She failed to show up for her visitOn 6/3/a message was left by my receptionist for the patient to return for the contact lens checkAfter no response, I personally left her message on 6/20/telling her that she needed to come back in before the rest of her year's supply could be orderedWe did not hear back from the patient until 2/1/She never contacted us nor made any effort to try to make arrangements for her follow up around her busy work scheduleOn 2/1/she called and asked if her contacts were still hereThey were not because they were never orderedShe was still wearing the initial pair of contacts(1/months later) and made an appointment for 2/4/to come and see meShe did not show up.Contact lenses are medical devices which need to be worn properlyWhen contact lenses are misused or abused they can cause serious damage to the eye.To address the patient's statementJust because she prepaid for the contacts does not mean that they were all orderedAs explained above, and to the patient in detail, the remaining pairs of lenses are non returnable and would not be ordered until she returned for the checkupShe did re-sign the contact lens instruction sheet stating the lenses were only good for months and she would return in a week.I do not feel that she is a responsible contact lens wearer and is at risk of damaging here eyesTherefore ordering the rest of her contacts is not an optionShe is entitled to a partial refundThe fees are broken down below.Contact lens Fitting $less 15% discount =$34Initial pair of contacts $Total $amount paid $refund $75If you have any questions or need clarification please feel free to call meI will be happy to discuss the issue with youI will send the patient a refund check at the address provided once I hear back with the resolution of this dispute.Sincerely,Michael K.O.D
