Customer contracted with Granite Direct to have new granite installed As part of that project, customer had us "tear out" the existing countertop as well as her 12"x12" tile backsplash There is no repair work associated with the removal of the existing countertops or tile backsplash, only tear out and haul away The job was completed on November 26, and customer signed a Project Completion Form indicating that there were "No" unresolved issues The removal of the title backsplash, which was liquid nailed directly to the drywall, was accomplished by cutting the grout line at the top of the tile and removing the same from the wallDue to the use of the liquid nail adhesive, certain portions of the drywall came off with the tile, however, this is the result of how the tile was affixed rather than how it was removed This is clearly shown in customer's photos, where there is no damage to the wall above the grout line.Customer brought her claims to my attention in January, almost months after completion and I indicated that I was happy to take a look at her photos and see if there was anything we could do for her Upon reviewing the photos and the bid submitted by her contractor, I determined that there was no damage caused by my installer and that all alleged damage to the drywall was the result of how the tile was originally attached Customer's bid from her contractor also included items such as drive-time, GC fees, painting, texturing, cleand materials, which all appear to be standard charges for the installation of her new tile backsplash.Upon my determination that Granite Direct was not responsible for the alleged damage, I nonetheless offered to pay for the replacement drywall material, even though I don't believe Granite Direct is responsible in any way My offer was not accepted and instead customer threatened to file a lawsuit, at which point I rescinded my prior offer, leading to her filing of an unfounded complaint with the Revdex.com.In short, Granite Direct was hired fabricate and install new countertops As part of that process, we were hired to "tear out" the existing tile and granite, not perform drywall patching or repair work Our contract clearly states that we are not responsible for damage and, in fact, the customer signed and dated the Project Completion Form on November 26, clearly noting that there were no unresolved issuesThe fact that her tile backsplash work is going to cost her more than she anticipated or budgeted, does not make Granite Direct responsible
