As you are aware, this firm has been retained by Dr. Shlomo W***, in regards to the above-stated matter. Dr. Widder denies any and all allegations of improper business conduct in this matter and denies liability as to the disputed amount.Pursuant to the terms of the contract entered into between... the Complainant, [redacted] ***, and Dr. Widder, [redacted] was responsible for any and all financial obligations resulting under the contract.There is no dispute that Dr. Widder, due to an illness, contacted [redacted] to postpone the surgery on April 4, 2017 and immediately rescheduled it for the following day, April 5, 2017. There is also no dispute that the scheduled time for [redacted] to come in for her appointment was for 7:00am on April 5, 2017. However, [redacted] did not show up to Dr. Widder's office on April 5, 2017 until after 8:15am and did so only to cancel her Surgery. [redacted] not only cancelled her surgery after its scheduled time, but did so to the inconvenience of Dr. Widder's subsequent patients that day. Such actions by [redacted] are tantamount to a last-minute cancellation, thus subjecting her to full financial responsibility for the procedure in accordance with the express terms she assented to in the agreement between the parties.Specifically, [redacted] initialed and/or signed an acknowledgement of her financial responsibilities including that: 1) because surgical time was set aside specifically for [redacted] by the medical staff and anesthesiologist, if she were to cancel her surgery for a non-medical reason, absolutely no monies would be returned to her; and 2) she understood and agreed to the document being signed and cancellation policy of the Widder Cosmetic Surgery Center. [redacted] signed and/or initialed such acknowledgement on the 4 (four) following documents: "Pre-Op Instructions", dated March 17, 2017, "Agreement, dated March 17, 2017, "Acknowledgement", dated March 7, 2017, and “Cancellation Policy', dated March 17, 2017. [redacted] thus acknowledged her financial responsibility for the entire procedure in the amount of $9,100.00.Due to the time restraints of a Doctor's schedule and the potential for interference with other patients' surgeries, Dr. Widder further required his patients to place a $500.00 deposit in order to ensure the patient's appearance at the schedule appointment time, [redacted] signed and/or initialed her acknowledgement of the deposit price in the following 3 (three) documents: “Pertinent Preoperative Information”, dated March 7, 2017; “Acknowledgement”, dated March 17, 2017; and "Cancellation Policy", dated March 17, 2017.Upon [redacted] ***'s failure to arrive on time to her 7:00am appointment scheduled with Dr. Widder, his medical staff, and anesthesia provider on April 5, 2017, and her subsequent cancellation of the surgery, she became liable for the entire amount of the surgery plus the deposit price. Dr. Widder then debited her account in accordance with the terms contractually agreed to in the amount of $9,600.00. So there is no confusion, Dr. Widder acknowledges that had [redacted] not rescheduled here surgery his illness would have entitled her to a refund of the fee. However, she did in fact opt and commit to an alternative date and time which would have otherwise been booked with another patient.Dr. Widder is a highly respected member of his profession and in the community. He comports to the highest of standards of care both professionally and personally. The aforementioned documents are presented to patients in order to ensure that each person is aware of their financial responsibility throughout the treatment process.Please therefore accept this letter as Dr. Widder's formal denial of liability in response to the complaint made against him on April 12, 2017 by [redacted] ***.If there is anything further Dr. Widder must provide, or should you have any questions or concerns, please do not hesitate to contact us.Sincerely, Mark *. The above named patient came to our office as was seen on 3/28/for consultation for surgery There is no charge for consultation At the time of this visit, *** *** signed our policy on payments (enclosed) *** *** called our office on September 16, to book her surgery for
November 1, 2016, at the time she paid the required deposit of a non-refundable $(see attached.) unless patient is unable to get a clearance from her doctor At the time, patient was instructed to see her doctor for a medical clearance and several required blood test at which patient stated she will obtain On September 22, we received all her pre op paper work from DrT*** (see attached, only the cover to protect her privacy.) On October 5, 2016, patient called stating that she needs to cancel her surgery and "she would do it another time." She was informed once again about the non refundable deposit At the time, she denied signing the consultation form (copy attached) and made accusations stating that "Maybe I did it" which is absurd and certainly untrue Even with such accusation, I NEVER used inappropriate language Also, we sent her an email with the copy of the form she signed with her signature We have many patients, and I do not see them all or know them allI try to get as much information on a hone call that I can so I can be of help.This is a professional office, we do not do business in this manner I had never in the years that I have been employed her, had a complaint like this.If you have any questions or concerns, please feel free to contact me.Sincerely,Lyn N***

I am rejecting this response because:She was rude and hostile over the phone, and she straight up lied about "NEVER" using inappropriate langauge. Though I did ask her if she signed the consult paper; it was simply out of curiousity and not at all an accusation. I didn't realize the form I signed back in March had anything to do with the refund. In any case, that had nothing to do with my decision in making this complaint.  Her behavior towards me was anything but respectful or professional, which is actually backed up by many other complaints in various review sites. After submitting this complaint, I called again to get a confirmation of cancellation (a request so basic and typical of any Dr's office,) to resolve this matter quickly. I was put on hold for 10 minutes then hung up on. Everytime I called back, I was prompted to an answering machine stating the office was closed. It was well within their business hours, so it was very clear she was avoiding me. This whole situation and her behavior has been absolutely bizarre. Honestly, I don't want to deal with this anymore.   I would've accepted her response, had it been truthful, but it wasn't. At this point, I just want other consumers to be aware of my experience.

I am rejecting this response because: My scheduled surgery was for 4/4/17. I signed an agreement to do that. I drove 8 hours from Sneads Ferry, NC to Virginia the night before surgery. 3 miles from the office on 4/4 the physician called me to CANCEL surgery. I then had to wait until 1447 that day to check into a hotel because they could not get me in any sooner. This physician could have easily called me the night before my scheduled surgery to cancel rather then wait until the day of surgery. Not only did he inconvenience myself but he also inconvenienced my daughter who was into a 2 hour drive from Delaware to Virginia.This physician stated that I arrived at the office at 0815 to cancel surgery on 4/5/17-this is in fact a lie. I spoke to this physician before 7am on 4/5 to let him know I had been up all  night vomiting (probably from the stress he placed me under) and could not get the after care I needed. This MD informed me that the earliest he could perform the surgery would be the following week. I went into the office to reschedule surgery and to place another deposit if needed. This physician told me that day that "doctors get sick too." Well yes, I understand that. Unfortunately, if he wants his patient's to understand this he too needs to realize that patient's also have illnesses, deaths, and emergencies. I was still willing to go through with surgery despite my daughter in SC attempting suicide 2 days prior to my scheduled surgery. There was no way that either myself or my daughter could have surgery on 4/5 and be in SC on 4/6 to pick up my daughter from the hospital. I did not sign an agreement that I would pay for surgery when the doctor cancels surgery.
