I have received your letter dated October 2, 2015, addressed the Tanglewood Apartments, enclosing the complaint of [redacted]. This is Tanglewood's response.
On July 28, 2015 Mr. [redacted] and a co-applicant submitted a Rental Application to...

Tanglewood and placed a $250.00 application deposit.In the application, Mr. [redacted] agreed that the application deposit would be retained by Tanglewood as liquidated damages if the application was approved but he decided not to rent the apartment for any reason. The application was approved, and Mr. [redacted] and the co-applicant executed an Apartment Lease Contract on August 21,2015,for a lease term beginning on September 1,2015. In paragraphs 3 and 19 of the lease, Mr. [redacted] agreed to pay liquidated damages in the event he failed to perform the lease, including paying rent for the entire lease term.
On September 2, around 4:00 p.m., I called Mr. [redacted]'s daughter, who translated for her parents to find out whether they would be moving into the apartment. She stated that they would come to the office on the following day to pay rent and submit utilities information. I attempted to to contact the applicants again on the afternoon of September 3, but no one answered. When I called on the 4th, Mr. [redacted]'s daughter stated that they did not have the money to move in at that time. I explained that Tanglewood would not hold the apartment for another week, but another unit would become available later in the month, and she stated that this would be fine. About a week later, I contacted Mr. [redacted] to inform him that the apartment was ready. His daughter informed me that they were moving somewhere else and no longer wanted the apartment. Because they never took possession of the apartment, I allowed Mr. [redacted] and his co-applicant to rescind the lease and thereby avoid liquidated damages. However, under the terms of the application, the application deposit was retained as liquidated damages.
Tanglewood denies that it engaged in any unfair business practices. There are cost incurred when an applicant places a deposit, the application and apartment assignment process is completed, Tanglewood coordinates available apartments of different sizes and types, the specific apartment is taken off the rental market, and then an applicant decides not to rent the apartment. Retaining the deposit compensates Tanglewood for the costs of services provided to Mr. [redacted] and for the loss of income associated with taking a unit off the market. I also deny that I was rude or unprofessional to Mr. [redacted] or his daughter. All conversations with her were cordial, and the applicants did not seem unhappy or upset during any of the conversations described herein.
according to your letter, this response may be reported to the public with or without notice to Tanglewood. Tanglewood is providing a response in order to avoid the Revdex.com publishing negative and inaccurate information related to the business practices of Tanglewood and to provide an answer to a customer service issue. Tanglewood, as a private company, does not agree that its response to a complaint regarding a private business matter can be posted in a public forum, no does Tanglewood, in responding to the complaint, grant the Revdex.com permission to display its response publicly.
