I have attached from our agency management system notes from February 15, 2017 and you will also see a second note at the bottom on October 20, 2016 where the customer requested a change in their payment plan. The second note is especially material because the customer said they had dual coverage and 1) never sent proof and 2) Why would they change the payment plan if they had another policy. 3) They also made a claim in January, so if they had another policy, why would they make a claim on this policy?Bottom line, you can do every possible favor and extra added help in the world for some customers and it will never be enough. This is clearly one of those cases. On several occasions I drove all the way out to her work, because she is self-employed and can't get away. I have also driven out and met her at restaurants in the evenings. On all of these occasions the drive was at least 30 to 40 minutes from my office and well over an hour from my home. I always have provided her service above and beyond what would be required.What happened way back at the beginning here is when the policy was written. She was tight on money, her son [redacted] had no money, but they needed insurance on the car he was driving. This part is very important. She wanted to know the cheapest possible way to get him insured so he was legally compliant — nothing more. Her son was just getting started. I told her if she keeps the car in her name and wrote a separate policy, her son could pay the policy out of his account while riding her coat tails for being a homeowner and having better credit. That got them a much lower rate than him applying for the insurance on his own. That was a favor to her and at this point, obviously clearly unappreciated. We also discussed it teaches him the responsibility of making the insurance payments on his own. We had a whole big conversation about teaching him responsibility and parenting challenges. She signed all the applications personally.Fast forward years down the road, the son [redacted], gets in an accident with an Uninsured Motorist it was their fault. There was no Uninsured Motorist coverage on the policy. [redacted] was told there was no UM on the policy. He said "I" never signed anything. That is right. He was not the Named Insured on the policy. His mother [redacted] was and she signed it. (I wish I could use a softer term)When it came time to save money, she was at the front of the line. When it came time to take responsibility for the coverages she refused to purchase and signed off in writing, she was not willing to do that. The most convenient thing to do was to blame me.This is a common happening in the insurance business where people don't want to spend money to purchase the necessary and highly urged coverages, but when it comes time for a claim they get upset that they don't have the coverage. She alleges fraud. Fraud would be saying I provided a coverage arid didn't provide it. Her signed waiver of UM coverage is attached. Multiple policy renewals were sent out with the coverages fully disclosed. She alleges fraud. The policy was properly placed and in force for years.She alleges fraud. We send out blast e mails and other communications every year offering policy reviews. They never replied.She alleges fraud. We have no financial motivation to write less coverage. And we are required by law to have the customer sign a document rejecting UM coverage when it is not purchased. We have the document. (attached)My attachment with the comments I made immediately after the conversation we had on the phone in February clearly shows she was obstinate and we were unable to work with her. She was obstinate to the point where she refused to provide us her address meaning we could not mail her a cancellation letter for her signature.There was no way we would cancel her policy with anything verbal when she is threatening legal action and it is already against our policy to not get something in writing when coverage is reduced, removed, or cancelled. She was insisting we back date a cancellation 6 months because she had another policy. She has never shown us the other policy. (probably because it doesn't exist) We begged her to cancel the policy. She refused to put it in writing.We also have recorded phone conversations that I can't include in a letter where we were trying to get her to sign a cancellation letter and she refused.If there is anything else you need.
