Review: In April of 2009, the shower pan in our master bathroom began to leak. We hired [redacted] (CCB #XXXXXX) to rebuild our shower and do other repairs. The work was completed and paid for by early June 2009. The workmanship ranged from adequate to poor. We thought that the shower tile work was ugly and uneven, instead of faulty and not up to code. We learned this late this summer when the threshold tile began to loosen. We had a contractor evaluate the trouble and learned that water was leaking through the tile/grout. There was visible standing water between the tile and shower pan. Photos were taken. The shower pan was found to not be "code" and I discovered that the required permits and inspection had not been done.I immediately contacted [redacted] He assured me that he would make amends (his message is still on my voicemail). He asked why we hadn't complained back in 2009. I explained that we believed that the workmanship was ugly, not faulty. Because the project had been fraught with delays and "re-do's", we were just happy to have a finished product. While my contractor was at the house doing other repairs, [redacted] stopped by. He phoned me to discuss the issue and denied that the shower pan was "not up to code". He agreed to come do the necessary demolition and pay for the shower pan replacement. I specified that the shower pan, threshold, shower floor and first two rows of tile should be his responsibility to cover. He denies agreeing to this detailed reimbursement.Mr. [redacted] told me that had we not been initially satisfied, he would have ripped out the shower and started over. I asked why the same wouldn't hold true four years later when it was found that, due to faulty workmanship, replacement was necessary. He asked why I wasn't blaming the plumber who did the work for not getting the necessary permits and inspection. I explained that he hired and paid for the plumber. As requested by [redacted] I forwarded the bill to him for reimbursement.

After waiting for several weeks for a reply, I phoned and texted [redacted] to see when I could expect payment. [redacted] did not reply. When I phoned him from my work phone, he answered. He told me he was still considering what reparations he felt that he really owed me and that he would let me know soon. After waiting another few weeks, I left a message asking if he had made any decisions. I never have heard back from him. He should reimburse me the $950+ for the needed repairs.

On or about 4-23-09 I met with [redacted] to look at a leaking shower. I gave a estimate on the work that I would be doing and a description of the proposed work. She had called a plumber to come take a look at the problem and he recommended me to do the repair work. After some inspection we saw that the shower pan was leaking and it needed to be replaced. I told her I could do all the demo ,sheetrock, framing, tile work and painting but that all the plumbing work needed to be done by the plumber she had called originally. We then discussed permits and she stated she didn't want to pull any permits for the job. After agreeing on a price she asked if I would act as the General contractor and schedule the plumber and add his costs on my estimate and pay him when we were done since he had recommended me He also agreed on this process also since we had a working relationship. When all the work was completed [redacted] paid me in full and she also

had me do some other repairs before I left. As far as I knew she was happy with me and the job and there was no complaints. I never had a call back on this job.

In July of 2013 I received a call from [redacted] and she stated she was having problems with her shower I asked what was going on and she said the shower pan was leaking and there is water underneath the pan. I asked her why she thought it was leaking and she said that some tiles had fallen off and I used drywall instead of cement backerboard and I didn't install the liner correctly. I asked her if she would let me fix any of the problems and she said she was very unhappy with me and my workman ship and that she wanted her new contactor to do the work. After some discussion she told me all the tile looks terrible and she wants it all down. I asked why she didn't call me before so I could fix anything she didn't like and she said she was just happy I was gone. I explained to her that it has been over 4 years since I was there and I had never heard any complaints from her before and I would come over immediately and take a look.

When I got to [redacted]'s house her contractor was taking out the flooring in the bathroom and some tiles fell of the front of the shower and he said there was a problem with the pan. I asked what was going on and he said the pan was leaking and that the liner was not installed properly. I just listened to him and let him explain what he thought was the problem. He stated that drywall was use and not proper backer board and that water was leaking under the pan. I then asked him what a new pan would cost since [redacted] said I couldn't do the work and he said $350.00 for the pan 400 for demo and haul and 300 to install new tile. So roughly $1000.00. I told [redacted] That I would demo out the shower and haul all the debris and pay for a new pan only if it was leaking. She agreed to the 350 and hauling and if the pan was actually leaking. I then took out he entire shower. When I got to the removal of the pan I notice a little bit of water in between the

pan and liner. When I removed the entire shower floor and just the liner was left there was no signs of water getting past the liner. I then removed the liner and there was no moisture below the liner. I took pictures off the demolition process to document there was no moisture anywhere below the liner. So the shower pan was not leaking.

I then told [redacted] that the pan was not faulty and that I would not be paying for any of her costs for the new shower she wanted and that I would not charge her for the demo and haul. She then stated she would make a complaint to the Revdex.com Contractors Board and I told her that is her right but I would be disputing any and all negative allegations against me and my company. [redacted] then sent me a Bill for $920 and I told her that I shouldn't have to pay for any of it because there was no problem with the pan. She then went into how I did such a horrible job in the first place and that I should pay for the whole thing. I asked why I never heard from her about what a horrible job I did until now but she didn't have an answer for that. After a few more threatening calls I decided to send her and Invoice for $350 for the demo work and not to take anymore of her abuse.

In the end I have been in Business since 1998 and have zero complaints against my company. I have tried to come to some conclusion with this person but I think after 4 years of not hearing anything and then have some other contractor tell her that my work is faulty is just not right.

I have read [redacted] response thoroughly, and I look forward to addressing him in Small Claims Court on May 28th. His report is full of many inconsistencies:

Paragraph 1 -

*His bill indicates "all work performed by [redacted] which is inaccurate, as most of the work was done by other individuals.

*He indicates "payment made in full at completion of job". Per his invoice, 65% of the fee was due up front and 35% upon job completion and this is how he was paid - 2 separate checks.

*We never had any conversation about "permits". I assumed (unfortunately) that all necessary details required for the job would be handled by the contractor (him).

Paragraph 2 -

*I contacted [redacted] in September 2013, not July. He said that he would do whatever it took to make the situation right.

*I did not indicate that the pan was leaking. I indicated that tile had fallen off the curb because water was leaking through the tile and into the pan. The demo hadn't taken place so we weren't sure exactly where the water was going. We could see a good deal of water between the tile and pan at the interface with the curb.

*The pan was not installed up to code. I have accessed a number of construction resources that are consistent in describing what an adequate pan entails. I have photos showing that my pan did not meet those requirements. Therefore, retiling over the existing pan was not an option. In order to replace the pan and install one that was done properly would require removing the floor of the shower, the curb and bottom two rows of tile (and then replacing them). THIS is what [redacted] agreed to cover in addition to the demolition. I indicated that I'd rather just replace the whole shower than have a "patch job" done. So I indicated that I would pay for the materials and everything but the pan, floor, curb and bottom two rows of tile. My contractor gave [redacted] Valenzuela a verbal estimate for that specific work ($950, not $920 as stated by [redacted]

*I never agreed to pay [redacted] $350 for demolition if the shower pan was not leaking, since it was quite clear before the demo took place that it was obviously not up to code and would need replaced anyway.

Paragraph 3 -

*After the demolition, I contacted [redacted] He indicated that because no moisture was found under the pan, he didn't feel like he should pay for all of the agreed upon re-work. I was disappointed with his response, but he asked me to send him a copy of my contractor's bill and he would look it over and let me know. In the subsequent weeks, [redacted] did not answer any of my texts or voice messages. In November, I finally called him from my work phone and he answered. He indicated that he was still thinking over how he wanted to handle the situation and said he would let me know. When I didn't hear back from him after several weeks, I left a voice message that indicated that if I didn't hear from him by the end of November, I would pursue other avenues (Revdex.com, CCB, etc). I received no response from him, so initiated my complaints.

*I indicated that I never called him in regards to the awful tile job, because that's all I thought it was. Not ugly tile over a shower pan that was not up to code.

*The original job took forever to finish and disrupted use of both upstairs bathrooms. The fellow who did the majority of the work (tile, painting, etc) wound up applying a second paint coat, full of roller fuzz, to the bathroom wall (and then was repainted by [redacted] This was the one time that I saw [redacted] do any hands on work at my home.

*I have never received any invoice for the shower demolition (done 9/25/13) from [redacted] for $350.

I will be happy to send any photographs and construction resources (as they pertain to shower pan requirements) to you for review. It will be clear that the shower pan that [redacted] and his workers constructed was not adequate. In addition, I can send you a copy of [redacted] 6/8/09 invoice to you that indicates 1) who was to do the work, 2) what was to be done, and 3) how payment was to be made. I can also provide you with a copy of the 9/2013 invoice to [redacted] for the work done by my contractor.
