Baystate Paving was hired to remove and dispose of exiting asphalt driveway & parking area from Mrs *** Multi Family Rental Property in Dorchester on August 30, 2016 . The job was to be completed in two phases and estimated cost of the First phase
was $ which was completed in days and paid for on August 31,2016Phase # 1) which consisted of Removal & Disposal of existing asphalt Driveway & and rear parking lot and extending the rear parking lot to accommodate her tenants cars. After the asphalt and dirt was removed we discovered that the ground underneath was mostly clay and had a high water content and was not suitable for pavement under these conditions. As a temporary solution we brought in truckloads of gravel at no additional cost to Mrs.*** At this time we informed Mrs *** of our findings and showed her where the ground was unstable and explained that the clay and the water issue would need to be corrected before any pavement could be installed . We told her that we do not do this type of excavation and that she would need to hire a excavation contractor that would have the equipment to dig down approximately feet and order tp remove the clay.Also there was no way of knowing about the clay or high water content of the ground underneath the asphalt therefore this additional excavation work was not included in our original estimate Trying to assist her with this process We recommended a local contractor *** *** *** and also told her to call around her area to find additional local contractors. We told her that the additional work would cost her approximately $ 1200. PHASE ) install a base layer of inches of asphalt and a finish layer of inches of asphalt at the cost of $ 5000 which cannot be completed until the ground conditions are corrected Phase # Install a two inch base layer of asphalt and a two inch top finish layer

I would like to rebut what Bay State Paving has said in their respond to my complaint.  I am tired checking this out for inaccuracies. Therefore, I am sending it on before it is too late. Tell me if I have to change the format.

I BELIEVE MY INTIAL RESPONSE TO THIS COMPLAINT EXPLAINS THE NECASSARY STEPS NEEDED TO COMPLETE THE DRIVEWAY . AS MRS. [redacted]  STATED IN HER COMPLAINT SHE HAD WATCHED US DO HER  NEIGHBORS JOB FOR 2 DAYS AND SHE FELT THAT WE INSTALLED A QUALITY JOB AND WANTED THE SAME JOB AS WE DID FOR HER NEIGHBOR. WE PROVIDED HER WITH A PROPOSAL WHICH SHE ACCEPTED AND SHE WAS EXPLAINED  THE INSTALLATION PROCESS OF REMOVING THE OLD DRIVEWAY AND INSTALLING A NEW ONE . THE COST AND THE INSTALLATION WAS EXPLAINED TO HER BEFORE ANY WORK WAS STARTED AT HER HOME AND ANY QUESTIONS SHE HAD WAS EXPLAINED IN DETAIL BY MY SUPERVISOR TOM.MRS. [redacted] HAD THE CONFIDENCE IN HIRING US AND PAYING $5000 . FOR THE FIRST PHASE OF THE JOB WHICH WAS REMOVAL OF THE EXISTING ASPHALT  FROM THE DRIVEWAY AND REMOVING THE GRASS & LOAM FROM THE AREA SHE WANTED TO EXTEND. THE ONLY ISSUE THAT IS HOLDING UP THE COMPLETION OF THE DRIVEWAY IS THE FAILURE TO CORRECT THE HIGH WATER CONTENT AND UNSTABLE SOIL OF THE GROUND WHERE THE ADDED SECTION OF PAVEMENT IS TO BE INSTALLED WHICH WAS NOT PART OF OUR PROPOSAL. SHE WAS MADE AWARE OF THE CONDITION OF THE SOIL IMMEDIATELY AFTER THE ASPHALT WAS REMOVED AND ADVISED THE THIS WOULD BE NEEDED TO BE DONE BEFORE ANY ASPHALT WAS TO BE INSTALLED.WE ADVISE HER THAT THESE AREAS WOULD NEED TO BE REMOVED BY A EXCAVATING CONTRATOR FOR A ADDTIONAL COST WE ESITMATED AT $ 1200.  AND   BEFORE THE SECOND PHASE OF INSTALLING THE ASPHALT COULD BE COMPLETED .OVER THE NEXT SEVERAL WEEKS MRS. [redacted] CONTACTED SEVERAL EXCAVATOR CONTRATORS BUT DID NOT HIRE ANY OF THEM TO REMOVE THE SOIL AND CORRECT THE WATER ISSUES . SO AT THIS POINT WE ARE STILL WILLING TO COMPLETE THE DRIVEWAY AT THE SAME PRICE OF $ 5000 BUT ARE WAITING ON HER TO HIRE A CONTRACTOR TO CORRECT THE SOIL CONDTIONS . MRS [redacted] HAD THE CONFIDNCE TO HIRE US AFTER WATCHING US INSTALL A DRIVEWAY FOR HER NEIGHBOR AND PAYING FOR THE REMOVAL OF THE ASPHALT SO I CANNOT UNDERSTAND WHY SHE WOULD NOT TAKE OUR ADVICE ABOUT HIRING A CONTRACTOR FOR REMOVING THE SOIL SO WE CAN COMPLETE THE JOB ON A STABLE GROUND.
