Mike Sumerel Builder's Response to Complaint TD [redacted] The job began in May as a time and material job to fix termite damage in the houseThe complete flooring was taken out down to the ground in all but one room of the house and then using new materials the floors, floor joist and seals were replacedWhen job was almost completed, it turned into a complete remodeling of the entire houseThe homeowner decided that it was costing too much even though the job had not exceeded the estimated cost, so at the owners' request, we did a contract for the remainder of the job with allowances for various materials to keep the cost within the original estimateAny cost over the allowances had to be paid for by the homeownerThere was no allowance for outside doors, other than the front door only which had a $allowanceThe cost of the new doors the owner chose and that I paid for were almost $with the homeowner agreeing to reimburse me by the end of the monthThe floor covering allowance was also exceeded and never reimbursedThis money that was spent for these materials that were over the allowances was money that was needed to pay for previous month bills and labor costOn December the 9, I still had not received any payment for these chargesThe homeowner told me explicitly that he was not going to pay me until it finished the jobWhen arriving to work on December the 12, found the doors locked and homeowner refusing to let me in to get my toolsThe sheriff's department was called and had to force the homeowner to unlock the door so I could get my toolsI returned the doors that had not been delivered and retrieved that money to pay some of the previous month billsThe remaining bills that were over the allowances and labor charges have been paid for out of my pocketI have invoices and time sheets for all money paid for this job

he needs to reimburse me half of the 81000.00 dollars I paid in good faith thinking he was purchasing materials for the house not his chicken houses.  he did not get a permit which I assumed he had  the new contractor has found many thiongs he did wrong like not nailing yjr siding to the...

house  and covering up rotten wood  which he was suppose to replace.  do you legally make him pay me back or do I go to court?  also is he criminally wrong doing this and not having a contractor's license?  I just was told this.

Any cost over the allowances had to be paid for by the homeowner. There was no allowance for outside doors, other than the front door only which had a $500 allowance. The cost of the new doors the owner chose and that I paid for were almost $5000.00 with the homeowner agreeing to reimburse me by the end of the month.
