In response to issues reported to your department from [redacted] in order of complaint: Damage Costs Addendum:Our $Security Deposit special did apply to those with credit scores and rental history that met qualifications but it did not nor was ever applied that you do not have to clean/maintain your apartment.Attached you will see that Mr [redacted] actually signed multiple Damage Charge Addendums that clearly show the opposite.Please see attached pages where Mr [redacted] signed Bath tub resurfacing:Mr [redacted] signed multiple Lease Renewals that state that the tenant agrees to maintain the premises during their tenancy and return it to the landlord in the same condition it was received less wear and tearTub was so ingrained with grim and staining, that it need to be resurfaced to bring back to an acceptable condition.Please see attached picture Carpet cleaning:Attached you will find the carpet vendors bill which detailed excessive soiling that was not listed on the tenants moChecklist.Mr [redacted] had a full days to mark down anything that was damaged or he found “horrible” as he stated in his letterNothing was recorded although he did record other small details such as the light switch plate was missing screw.Please see attached MoChecklist In conclusion:Offering a Special for modoes not negate the tenant’s responsibility to maintain the unitThe tenant is given many documents, that he signed, stating what he could be charged as well as what his responsibilities areAdditionally, Mr [redacted] acknowledges that the special was based off certain criteria not that the special gave you carte blanche to damage the unitDesired Settlement:That this matter be dismissedSincerely, [redacted] **Regional Property ManagerMobile: (414) 305-5395Fax: (414) 764-SOak Park DriveOak Creek, WI [email protected]

What they are claiming is that had I not been told on moday that with the $security deposit I didn't need to worry about anything as long as nothing was broken, and had therefore taken the time to clean the bathroom tub, I would have ended up cleaning it with scrubbing bubbles which would have damaged it furtherFirst of all, if that had been the case, the next tenant would have been out of luck from the startSecond, if not scrubbing bubbles, how would they have preferred me to clean it? Everything they are saying points back to them wanting to replace the tub again immediately. The other issue I have is that even with all these messages, they STILL have not divulged how long it has been since the carpet was replacedAgain, there was absolutely nothing spilled on the carpet my entire tenancy that was not vacuumed up before I leftThe entire carpet was in extremely rough shape before I moved inFor me to point out everything wrong with the carpet would have required a ton of copies of the move in checklist sheet, and with the understanding that my $security deposit meaning I didn't really need to worry about it much, I had no interest in taking the time to point all these issues out. As for the online reviews being so negative, there are many other apartment complexes out there that do not have the same issueIt seems to be a problem dealing with this complexOne of the top reviews is someone that was not evicted from their apartment, and they ran into many of the same issues as I did upon leavingI don't know the details that reviewer ran into, but I believe them now after going through this process with Wildwood PreserveWhen I talked to the lady in the office after receiving the bill, her response was: "That is why I don't like to rent somewhere without a security deposit, so that way the money I owe just comes out and I get a smaller amount back from the original deposit." That statement is ridiculous, because if I'm paying a security deposit I want the whole thing backI also would not have been told up front then that I really didn't have much to loseI have great credit, I've rented from six other rental properties in my life, and have NEVER had any issuesI'm a very good tenantI pay my rent every month with no problemsI've demonstrated that I am not someone trying to take advantage of a rental communitySo no matter what happens out of this, whether I am satisfied with the outcome or not, the complex is unbelievably shady when it comes to their operations surrounding security deposits and how they are handled.

The documentation provided by Wildwood Preserve does not stop the fact that the business is very shady with the $security depositWhen they tell me one thing, then have me sign copies of paperwork stating otherwise does not make it OKAlso, to say that the unit was not maintained during my 2+ years living there is simply not trueThere was nothing broken when I moved outAs for not documenting the carpet stains, you see how small the form is to fill anything out onI would have needed several copies if I were to document everything wrongI still have not gotten an answer on how old the carpet is, and the fact that it sounds like they still did not replace it for any new tenants makes it even worseThe picture they provided of the tub was taken with a sepia lens, so of course it is going to look bad (not to mention, they didn't even get the last name of their tenant correct)Like I said, I cleaned it approximately midway through my time living there with a cheap bottle of scrubby bubbles when it looked exactly like that and it came right offClearly they did not try and clean it, even though in their documentation it shows a price for cleaning of $They saw an opportunity to take advantage of someone with good credit and get a brand new tub. This apartment complex is running shady business, not only evident through my experience, but on many reviews onlineThere is another review very similar to my situation from months agoThey try and find ways to take money from people.

In rebuttal to issues reported to your department from [redacted] in order of complaint: $0 Security Deposit Special:Our $0 Security Deposit special did apply to those with credit scores and rental history that met qualifications but it did not nor was ever applied that you do not have to clean/maintain your apartment. Page 2 of the lease states:Attached you will see that Mr. [redacted] actually signed multiple Damage Charge Addendums that clearly show he know there could be charges.Please see attached pages where Mr. [redacted] signedOver the course of Mr. [redacted] tenancy, he signed and received copies of multiple leases and areas that advise him how to maintain his unit and if it is not maintained, what the charges would be. It was then up to Mr. [redacted] to choose how he maintained his unit. Bath tub resurfacing:Mr. [redacted] claims that he cleaned his tub once over several years of living in his apartment with a “cheap scrubby bubbles” type of cleaner. I would have to guess and say that this solution that he used is what scratched the tub and allowed the dirt/grim seep into the porcelain.As you can see on the Move-In Checklist, the bathroom was remodeled prior to Mr. [redacted] moving in (June 2014) so the claim that we “wanted a new tub” is complete fiction. That unit had just been remodeled prior to his residing there.The picture was not taken with any filters. That was the lighting in the bathroom as the space is very small. Carpet cleaning:·         Age of the carpet is not a factor as we never stated that we replaced the carpet. As listed on the Steamdry Invoice, they were able to repair the damages inflicted by Mr. Hauser.Attached you will find the carpet vendors bill which detailed excessive soiling.Please see attached Move-In Checklist. This Move-In Check List is supplied to our Company through Wisconsin Legal Blank and issued according to State Regulations and Laws. Mr. [redacted] had 7 Days to mark all over the sheet and even attach a second page or pictures if he felt the unit had a plethora of issues but he chose not to list anything in the entire carpet space which is 7 spaces in length and left the entire Move-In Comment area blank. Online Reviews:·         This complex has 304 apartments and yearly the average number of turns due to evictions, notices, etc. are 1/3rd of the population. Unfortunately, as in this case, not everyone will agree with charges or rules for that matter. In conclusion:Again, offering a Special for move-in does not negate the tenant’s responsibility to maintain the unit. The Special is to help prospective tenants not to have to shell out additional funds during the moving process.
