I have been given the complaint sent to you by Ms*** ** *** regarding the return of her and her daughter, Ms*** ***’s $holding fee deposit. Ms*** *** required a co-signer and her mother Ms*** *** agreed to be that co-signer. Ms*** rental
application was then accepted at that time. Per Premier Real Estate’s rental policy, which is stated on the application, (and was informed to Ms*** *** by the site manager) that once accepted her $holding fee deposit would be applied towards the security deposit when she moved in. If she canceled her application after being accepted, (which she did) the $holding fee deposit would be forfeited. “If accepted, the undersigned hereby agrees to enter into a lease as agreed between the parties or at least to rent the apartment with sixty days notice to terminate tenancy. If applicant refuses to accept the apartment after application is checked and accepted, applicant waives right to deposit.” Please feel free to contact me if you have any further questions. She has terminated her lease and decided to vacate. We have been in her apartment numerous times. I have been, my manager has and our maintenance supervisor and none of us have ever smelled anything. She stated it is a smoke smell and she is allergic to smoke. It is possible that maybe someone in...

another apartment is smoking, but are apartments are not non-smoking so there is nothing we can do about it. She is moving out as of Dec 30 and have paid her termination fee.
