*** ***’s complaint contains so many errors and falsehoods it’s difficult to know where to start so we will simplify the facts. *** ***’s vehicle was impounded by the Fairfax County Police Department on July 14, at 12:20am. According to police documents the driver of the vehicle was arrested. As we are contracted by Fairfax County our company was requested by the on scene officer to impound the vehicle. It was taken to our storage facility. *** *** left his vehicle in storage for days. The storage is by calendar day. We are required to begin the process of Virginia Storage Lien procedure on the 4th day of storage which entails a $administration fee Thus when *** *** picked up the vehicle on 7-17-he was charged days @ $per day, $for the impoundment tow, and the $administration fee for a total of $560.00. *** *** paid by credit card. ALL charges are set forth in our contract with Fairfax County. *** ***’s main error in his complaint is citing Virginia Code that has absolutely nothing to do with his tow. The code he cites relates to Private Property Towing, NOT Emergency Police Towing. Nothing in the code he cites pertains to this situation. In fact we are are very strict guidelines on what the fees are. The contract and it’s fees are strictly monitored by Fairfax County
*** *** could have picked up the vehicle the next day and the total charge would have been a total of $but he chose to leave the vehicle in storage accruing more charges. *** *** paid by credit card then disputed the charges with the credit card company making the same erroneous statements made in this complaintOn October 8, the credit card company ruled in our favor that the charges were just and correct
*** *** makes several very defamatory remarks about our company. We will only address those by stating that we are a family owned company that was established in and we are still operated under the same family. We investigate every legitimate complaint thoroughly. In years of business our reputation and business relationships with national and local government agencies, including police departments and fire and rescue services remains at the highest professional level
In conclusion *** *** was charged the correct fees under a contract that has tremendous oversight and is highly monitored. Again, *** ***’s towing issue stems from Law Enforcement Emergency Towing, not private property towing as in the codes *** *** cited
Virginia Codes and Fairfax County Codes are what apply in this case and they were followed correctly, fairly, and exactly as authorized
