Review: HelloI am writing this email because I filled out an application for a rental in Yakima WA through a management company called Wilson Real Estate. They required an application fee of $30.00 per person which is normal but they also required that I have my deposit in full at the time the application is submitted. I did think this was weird but provided a check anyways. We were accepted after they visited my current home which I had never heard of this process either but went with it. We were told to fill out our rental lease and return it the next day. When I went to the office I asked if they would be replacing the carpet and painting the inside walls and did state that I did not want to move in unless this was approved. There was never another opportunity to discuss any changes we would expect. I was told that if we backed out of the rental we would forfeit our deposit even though we did not turn in our rental agreement. This does not seem right to me I went through the rental agreement and did not find anything that stated this and no one told me that at the time I gave my check. Hope you can shed some light on this very confusing situation. [redacted]Desired Settlement: I would like my deposit back!

Response:

Regarding case ID [redacted] filed by Ms. [redacted], our response is as follows:

1) We do require a non-refundable application fee be paid by each applicant

2) We do require the applicant to pay a “holding deposit” in the amount of the security deposit of the

applicable unit. The holding deposit is refunded if the applicant is denied and forfeited if the applicant withdrawals their application or fails to execute a rental agreement.

3) We do request that the applicant allow us to inspect their current residence. This is a tool that we use to give us insight as to the applicant’s ability to to maintain our rental units in a clean, well kept, and

respectful manner.

4) After we approve a tenant, we do require the rental agreement be executed and returned within 48 hours. This is agreed to by the applicant when they submit the application and agree to the terms of the holding deposit.

5) Ms. [redacted] did request that the carpets be replaced, the interior painted, and that she would not move in unless these requests had been satisfied.

6) Ms. [redacted] was informed that she would forfeit her holding deposit if she withdrew her application or failed to return the rental agreement, as that was the terms of the holding deposit of which she had agreed to.

7) Ms. [redacted] would not find the contractual language that she was looking for because it is not included in the rental agreement, the terms are on the deposit acceptance form of which she signed and was provided a copy of.

We would like to share that Ms. [redacted]’s holding deposit was in fact returned to her due to other circumstances unrelated to her application or qualifications. A refund check was issued on November 1, 2013 in the amount of $600.00. The check cleared the bank on November 6, 2013.

As a company, we abide by all requirements of the Federal Fair Housing Law and Washington State Tenant Laws. All of our terms and conditions are available for applicants to review prior to their submitting an application. We hold firm that we did not violate any of these requirements or laws, adhered to our responsibilities as agreed to in the holding deposit agreement, and acted appropriately in our business actions with Ms. [redacted].

We respectfully request that this complaint be considered unfounded and removed from our record.
