Review: may 7 2013 I gave [redacted] at 1123 wall st la jolla a $13000 ring,I have reciepts,to clean and sell on consignment.$8000 minimum bid to be oked by me.In june he sold it without my consent an has refused to pay me or return the ring.the buyer I believe paid 16000 because [redacted] sent the diamond out to be lazered to increase the value all without my consent.[redacted] has told me twice ,some day he will pay me $9000.The consignment reciept states 10% comission.Every month he says next month.[redacted] next door business neighbor states this week another unhappy client was protesting in front of [redacted].there is a negative pattern here. This is the worst experence I have ever encountered with a merchant. This guy is dishonest!!! I will never trust anyone again. [redacted]Desired Settlement: I would like a minimum of $10000 dollars and to never see him again.I cant except the ring back becaused its been changed and I believe he is trying to make a cheap reproduction.

Response:

To whom it may concern:

I have a buyer for the ring in question and have sold the ring as it was consigned to me by Mr. [redacted]

for the purposes of resale. The ring is on layaway at this time and the buyer is hoping to have it paid

in full by Christmas. I cannot pay Mr. [redacted] until I have received full payment on this ring due to store

policy. (If a customer should decide to not purchase a consigned item then I have no way of getting

a refund from the original owner.)

I have tried to explain to Mr. [redacted] to no avail. He would not listen to me and began making

accusations and threats to me instead. Included in these are the following statements made by him:

''To drive his truck through the front ofmy store," To throw a bomb in my store" etc. His behaviour

has been irrational and becoming worse daily. I have had to call the police department at least twice

due his harassment towards me as well as my customers. The police have recommended that I not

speak to him to avoid any further conflicts or confrontations.

I will obviously pay him when my customer completes the payments to me in full. The ring was/is

sold for $9,000.00 with a 10% commission to me of $900.00 which will net Mr. [redacted] a total of

$8,100.00.

Sincerely,

Consumer

Response:

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.

Regards,

I have tried to get back my ring since may,I myself have had a buyer in may. I had a $10000 buyer in sept.I have been lied to for 5 months.I have never seen my property after [redacted]s got his hands on it.I have never recieved a call for my permission to sell, alter, send to lab, send to have inhanced at lazer lab, sent on a jewelry road show ect, ect, lie after lie.All I was told was it will cost you more to sue me.[redacted]s have never called me for any reason.Hes threaten to sue me for my peaceful protest.the police have done nothing to me because I have done nothing ,but request $ 10000 plus expences thats what I have lost so far.I am working with the consumer fraud division of the san diego district attorney an the many angry customers some who have been waiting years, they have heard the same lies .all complaints are being sent to the fraud divison.I well be protesting in front of [redacted] scram store all of nov@dec into jan collecting names of as many victims as cross my path.[redacted] has threatened myself and is again lieing about bombs an store distruction.Hopefully with GODS help this man can be stopped.

Review: This business is a consignment jewelry shop. I gave Mr. Winchell $8,400 worth of jewelry to sell for me on January 26, 2010. The agreement (verbal and written) that anything sold I would pay him 10% of the sale price and we agreed on minimum prices for the pieces of jewelry. By December of 2011 I went to collect my jewelry, he persuaded me to keep the jewelry there. In October of 2012 I went to the store to collect my jewelry, he didn't have it saying they were at a trade show, etc., but I was able to collect my engagement ring. The baguette diamonds were cracked and later fell out. The ring was perfect when I gave it to him. I moved away in October of 2012 and fell seriously ill so I could not deal with the problem until April 2014. I wrote a certified letter requesting the return of the jewelry. The return receipt was signed but I never heard from him as requested and I could never reach him by telephone (just a recording). I understand that he has closed the store from his website information. The phone recording says voicemail full. So I believe I have been defrauded.Desired Settlement: I would like my jewelry returned, or paid fair market value for the pieces.

Review: I put my engagement ring on consignment for [redacted] to sell. It has been 10 months and the ring has not sold. I call once a month and every time I get different story. Originally he told me the ring would not sell without my consent. I will try to regain my ring for the last time tomorrow.Desired Settlement: I want my ring back or I want the value of the ring

Response:

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution would be satisfactory to me. I will wait for the business to perform this action and, if it does, will consider this complaint resolved.

My name is [redacted] and we just spoke over the phone about my issue being resolved. I originally filed a complaint against Winchell Jewler Design in La Jolla. Since then my issue with the company has been resolved. Thank you
