A central air system was designed and installed in my home. It leaked throughout, created mold and company hasn't remediated it or refunded money.
*** designed a AC system to run colder than average (65 degrees). I am disabled and have a medical condition with a life threatening inability to regulate heat. This system (even ran at 70 - 72 degrees) was faulty. It never stopped leaking water everywhere.

April 25th 2018 the ductwork and 5 ton Goodman AC install was completed. Aug 1 exploded leaking ducts were found in basement- phone call made to the company about them. Buckets were placed under leaks and we waited to hear back.
Aug 2 email sent to *** about exploded leaking ducts In basement sent. Pictures included.
Aug 3 phoned *** - he sent out *** and *** to fix it with the caveat "my husband be home to learn how to empty the excess water out of the ducts. It's not too much to ask"
Aug 3 *** states he was thrilled to not find water in the ducts because if he did that would be "really bad" Loud rattling of return starts that night and we see a spike in humidity inside the house. Unknown to us, the fan mode was changed so that water vapor was blowing through the ducts creating 85% humidity readings in every room for weeks to come. This would significantly damage the plaster walls.
Aug 6 system starts to smell, emits a noxious odor, we feel ill. The drain hose looks cloudy and filled with sediment. We photograph it.
Aug 8 left message about smell, rattle and humidity levels.
Aug 9 additional message left, let the secretary know the smell was making me very ill.
Aug 10 *** said he was aware that I called earlier and states "we can't live at your house!". After more yelling "you want me to tell someone else that I can't be there because of you? Is that what you want me to do?". I reiterate that the smell is noxious and my medical condition doesn't afford me to go outside or turn the system off. He agrees to send *** to look at the system. We evacuate our birds to a vet (and pay for their board) for their safety, in case cleaners will be used. *** cleans what he says are "clean coils"; states the humidity problem is "because it's humid everywhere in the state and we need to wait for the weather to change". States the smell might "go away on its own", or we should call a "smell remediation company". The cloudy water in the drain hose was clear after he left. He fixed the loud rattle. He was shown the water filled but not leaking yet duct run, said something about running extra air through it to dry it out. (Still undiscovered to us, the fan was left on "ON" so that water vapor was blowing into our home causing the 85% humidity levels in the air conditioned spaces, while the unconditioned basement was 60%rh. *** knew this was happening but did not tell us. Our concerns about the water vapor and wet walls were ignored, blamed on "weather".
Aug 13 video of water vapor dumping out of vents sent to ***. Found more ducts filling with water but not yet exploded.
Aug 14 *** writes "warm air raising up from the basement through cracks in floor" blamed for excessive indoor humidity, not the switched fan setting blowing water vapor. I returned email with follow up questions. "If I match the temps so they are the same, will the humidity stop?"
Aug 15 *** writes that a control was ordered to be installed the next week. Can change fan to "auto" so it only runs when the compressor is on (we weren't aware it was ever switched off "auto"). Side door stops opening all the way, we aren't sure why.
Aug 16 mold and an inch of standing water on subfloor found in closet duct was ran in. Exploded ducts found in basement, water puddles under volume damper levers. Notified ***. Contacted mold and HVAC companies. HVAC experts stated 5 tons was vastly oversized outside standard practices. Mold experts recommended remediation in 48 hours.
Aug 17 *** sent an email saying *** would be out Monday.
Aug 20 *** offers to spray mold-ex on sheetrock and replace the ducts. Called ***, he said he'd remove the system and refund us our money. Aug 27 cut floor joist discovered.

Desired Outcome

I am seeking the system be removed from my home, and my home restored to the condition it was in before the system was installed. The damages the system caused shall be repaired by certified contractors in their respective fields. The water damages remediated by a licensed insured contractor who specializes in water/fungi remediation. A fungi test will be run and tested cleared when the water damaged materials are removed and replaced by new materials. The plaster damaged by water vapor needs to be repaired, as well as the plaster cut for the air return. The floor joist that was cut and never replaced needs to be braced so there is no longer a fall risk in my dinning room. The closet floor the air return was cut into shall be replaced and braced so that it is safe to use and structurally sound. I'm seeking loss of use housing while these repairs take place, alternative housing for myself, husband and our house pets shall be paid for. The damages to the floor caused by the duct in the closet leaking onto the subfloor need to be fixed. The full cost of the system shall be refunded.

*** and *** requested that I put in an insurance claim. I'm working with my insurance agent to resolve this. They were not interested in me trying to resolve this problem. They requested an insurance claim number which we did and we are waiting on insurance negotiations. I just put in a call into my insurance representative and waiting to hear back from him.
