Per Charles Contrino: Tell the consumer that I will mail him the refund check in the amount of $1500, in protest, through my attorney via certified mail.

Charlie stated I am not going to pay her the judgement, I am going to counter sue her in court. She told me she would accept the window in lieu of the cash and then she changed her mind. I have also contacted the insurance adjuster, as this was an insurance job, and made him aware of the situation, and she still has not had a window installed. I will be talking to my attorney today.

Regarding my claim for a refund, I filed a complaint with the Attorney General's office. In response to the complaint, enclosed is a copy of Charles Contrinos response. You will note that he states that a refund check was being sent to e. Please note the copy of letter from my bank informing me that a "stop payment" was issued on that check. The bank would not give me details on that order, as it is privileged information between the bank and their customer. But I was told that in order to obtain a stop payment order, the signator of the account has to personally come to the bank, provide photo identification, and sign the request. Please note in his letter of September 22, 2015, "in compliance with a recommendation made to us by the Revdex.com, you are receiving the refund." Mr. Contrino never ordered the doors and that is why he sent the check. Again, he is stalling for time. Because of his actions I feel the Revdex.com should cancel business approval of Mr. Contrino and his firm, for violating your standards. Sincerely, [redacted] L. [redacted] LP/tbm  Enc.

I spoke with Ms. [redacted] and she stated she never accepted anything in Lieu of the money judgement. He did no work and took her money.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.  Consumer came into Revdex.com and said that she had won a court judgement against the company, but it has not  been paid. The consumer would like payment of this judgement. Regards, [redacted]

The Business Response received regarding the complaint is totally rejected. If the message was attached in response to my complaint is copy of letter sent to me by Mr. Contrino, it was never received. On or about July 15, 2015, in response to a call, [redacted], **., President of [redacted]. called on me. Mr. [redacted] was highly recommend to me by a business friend as one who did outstanding work. We discussed a new deck. He made out an estimate and gave it to me. In further discussion, Mr. [redacted] informed me that his firm did only decks, no installation of doors, etc. He then gave me a copy of a directory of the South Towns Builders Association, Inc., of which he is Vice-President. He checked off the name of Window Experts & More, Inc., owned by Charles Contrino. Mr. [redacted] left, and I called Mr. Contrino, who returned my call and came to see me on July 17, 2015. After discussing the work to be done, he gave me a contract, which I signed, and he asked me for a deposit. I gave him my check for $1500.00 as a deposit. He then informed me that he would have to order the doors, and would call me when they came in. He gave me a brochure on the doors from a firm in Akron, Ohio called [redacted]. Mr. Contrino cites at length the "terms'' of the contract as they appear on the back of same.  I had no reason to examine these terms as he was recommended to me by the Vice-President of the same association that he was a member of.  Mr. Contrino called me on Tuesday, July 28th stating the doors were not on that days delivery, but expected on Thursday, the next delivery date. He called me on Thursday, July 30th, telling  me the doors were not on that delivery. I asked him for the return of my deposit, and he  agreed to return it to me. An hour later he called, telling me he would be at my home at 9:00 A.M. Saturday to install the doors. At approximately 8:45 A.M. that Saturday, Mr. Contrino  called stating he did not have the doors and he would return my deposit. I faxed him a letter on August 10th informing him that no check had been received. He called me stating he had mailed it to me the previous week, would issue a stop payment on that check, and go to the Post Office and mail me another check, via Certified Mail to insure I received it. Nothing received.I faxed him another letter on August 14th, informing him of non-receipt of my deposit, and if I did not receive it by August 17th, I would commence action to recover my money. I filed a complaint with Revdex.com on August 25, 2015. I never called Mr. Contrino asking to have the doors installed. Any telephone conversations were instituted by him, as noted above. I was never told about "other customers" being ahead of me nor anything else. It is my belief that Mr. Contrino never placed an order for the doors. I ask that he produce copies of his purchase orders for the doors; confirmation of these purchase orders from his supplier, and the terms of that order. If in fact he did place an order, he either was on "PrePayment prior to delivery, or on a COD basis. I feel he has suffered no financial loss and is using the "terms" of the contract to justify keeping and not returning my deposit. On August 25, 2015, I signed a contract with Mr. [redacted] of [redacted] to install a deck at the rear of my home. No deposit was requested and none was given. Informing Mr. [redacted] of my situation with Mr. Contrino, he informed me that I would be given back my deposit through his efforts in the South Towns Builders Association. He then referred me to [redacted], a firm that also installs the doors required for this deck. I contacted them and signed a contract for the doors. No deposit was requested and none given. [redacted] completed the work to my complete satisfaction on Friday, September 4th. Superior is slated to install the deck this week. Be further advised that Mr. Contrino and his firm are under investigation by the New York State Attorney General's Bureau of Consumer Fraud and Protection. [redacted] L. [redacted]

To Whom It May Concern:  In response to the reopened claim by Mr, [redacted], our company has stopped payment due to advise given to us by our attorney. Claim and counterclaim suits have been filed in the City of Buffalo Court. We are awaiting the outcome of that decision which will be handled by the City Court on November 5th, 2015 at 9:15 am.  Upon that decision we will inform the Revdex.com of the outcome and will resolve this matter. At the time of the signing of the contract, you were informed that the door could take up to three (3) weeks to be delivered. The following week you called and wanted the door installed. At the time, you were informed that the door still had not been delivered. You had also been informed that there were other customers that were already on the calendar prior to you and If we were able to get there sooner, you would be informed of the same. At this time, since the material has already been ordered, you will still be liable for those fees. Pursuant to Paragraph 14 of the contract, you have not provided prior written notice of cancellation of the work to be performed or refund until now. All cancellations must be sent in writing to the business address by certified return receipt mail. We at Window Experts & More, INC had scheduled Mrs. [redacted] for an install on July 13, 2015.Weather was calling for rain, so we contacted her and scheduled a new install...

date for July 21, 2015. We arrived at the residence at 9:35AM, I Charles Contrino, proceeded to enter the home at that time, Mrs. [redacted] informed me that she did not want the window any longer and wanted a refund. I had told her, 'What do I do with the window?' She told me, 'Whatever you want to do with it.' She then proceeded to ask me for her check. I told her she had forfeited her deposit due to the contract. I have attached copies of the back of the contract, which she neglected to do. I have also attached the order form from my supplier. Mrs. [redacted] proceeded to contact me via voicemail and text message threatening me with Attorney General, Revdex.com and small claims court proceedings. I have documentation to all of these messages. I will make them available upon request and consultation with me attorney. My attorney has advised me that Mrs. [redacted] is in violation of the contract and if these proceedings  continue it will be Window Experts & More, INC that will be seeking legal action against Mrs. [redacted].
