She can not get out of her lease She is bound to the terms of the lease We have done everything we can as a landlord We can not help that she can not get along with her neighbors

We are disappointed to hear that Ms*** decided to go to the Revdex.com to make a complaint without attempting to contact us first Here are the facts:1) *** *** Apartments is managed by Windsor Realty & Management, Inc.2) *** *** is the Property Manager of ***
*** Apartments.3) *** *** is a guest of *** *** and lives with her partner, *** ***, of apartment ***.4) Mr*** is a tenant and a signed lessee of *** ***, Ms*** is not.5) Ms*** completed an application to be added to the lease at ***.6) Mr*** subsequently requested that Ms*** not be added to the lease at ***.7) This complaint is the first notice Windsor and *** *** have received regarding Ms***' allegations about a bug infestation.8) Neither Ms***, nor Mr*** have reported bugs in their apartment, nor have they filled out a work order, requesting treatment of any bugs.9) Windsor has a full-time, certified Pest Exterminator on staff We effectively treat bedbugs and roaches to prevent infestations Again, Ms*** claims to have seen bugs in ***, yet she has never reported this finding to *** or Windsor.10) Upon receiving this complaint, Ms*** was able to inspect *** for bugs Ms*** did not see any bugs Rather she saw a neat, clean and well-kept apartment The only items that brought attention were two rabbits and two cats, more animals than are allowed under the lease.10) Ms***' "Desired Settlement" is to be allowed to break the lease Since Ms*** is not a lessee to ***, this desired result is impossible 11) Ms*** also requests in the "Desired Settlement" to have *** spray for roaches and bedbugs We are prepared to accommodate this request The property manager has been notified of the situation and will make arrangements to treat *** 12) In the future, we request that Ms*** or Mr*** follow the proper procedure and fill out a work order for any repairs and/or problems with *** They can contact the property manager, *** *** at ***13) Should either Ms*** or Mr*** have any questions regarding this matter, they can contact Windsor Realty & Management, Incat ***

I submitted this complaint letter January 19, It is curious to me that I would receive a response March 4, when the complaint calls for action by the end of February 2016.Since I moved in to The *** apartments, I have had four different property managersScott originally moved me inI asked him about noise complaintsHe failed to mention that the walls were thin and that sounds would carry through the walls and floor as freely as they do at The ***The cleaner at the time stated that the previous tenant of #had placed noise complaints with the office but Scott immediately shrugged that off and stated that the last tenant was "crazy" as in unreasonableI later found out that the previous tenant of my apartment was the previous property manager and was let go from his positionWith this information I decided to rent the apartment*** (tenant in #w/ name changed to protect her identity) had not moved in yetThe tenants at the time were a couple who would argue and slam doorsThat's when I learned how fragile the floor was between my apartment and the one above meI addressed this issue with Scott who assured me that those tenants were being evictedScott was true to his word.When *** moved into the apartment above me (#404), I introduced myself and learned that she is a Cleveland State University Graduate Student working on her Master's DegreeWe exchanged phone numbers in hopes to communicate any future concerns through each other versus through the officeI had stated in my original complaint letter that this plan went array once I received a text from her stating that I cannot keep communicating with her every "little sound" I hear coming from her apartmentThe sounds I was hearing were not littleI am not reporting the sexual sounds coming from her and the male companions that she keptI am complaining about the noise her and her company kept when walking into her apartment at odd hours of the nightThose sounds include the loud noise of her and her guests stomping around in heeled shoes, the consistent going to and from the bathroom due to a night's work of partying at the bar, shouts of woohoos at 3:AM, the laughing and giggling that was louder than conversations, and the bed that is so easy to fall apart that it sounds like pieces rolling around the floor when it falls apart from all the thrusting that goes on up thereThese are not reasonable soundsFootsteps are reasonableWater pipes clanging are reasonableA CSU party Grad is not reasonable.My noise complaint did not begin with Michelle, the current property managerThis has been in affect since Kyle, the property manager after Scott*** sexcapade at that time was so loud that the residents in the adjacent apartment building could hear it and inquired about itMystery was solved when I informed him that it was my neighborHe couldn't believe I tolerated that through the night. After a while I stopped "tolerating" the noise and the inconsiderate tendencies of my neighborI put in an office complaint with Heidy who informed me that the tenant in #would be moving out November Then she was no longer the property managerMichelle was the recipient of my latest complaint against my neighborShe informed me that she had passed on the email to the owner of the property who then stated to Michelle that he had to deal with previous noise complaints regarding the same tenant. I asked what will be doneMichelle assured me that *** would receive a letterThat letter was not delivered until January 8, which was a week and a half from the original date of my noise complaint with MichelleThe following week, *** had a male companion with her after 2:AMIt wasn't the sounds of her having sex that woke me upThat came laterIt was the high volume in voices, traffic to and from the toilet, and her poorly crafted bed that kept me upThis is the same week that she threw a get together for her and her friends that did not end till closer to 4:AM.I have been ignored during this last phase of my request to my landlord for assistance with the quiet enjoyment of my apartmentI asked for helpI asked for something to be done considering I am a good tenant and have been throughout my rental historyI don't need condescending advice about thin walls and apartment livingThere is nothing about being interrupted from REM sleep after 2:AMI have a job that pays my rent payment that is a daytime jobI require a full night's sleepI expect my landlord to provide quiet enjoyment as the law of Ohio statesWindsor did not provide that for me or did they care to provide a solution.Due to constructive eviction and the lack of response to my January 19th complaint, I moved out of the apartment February 29, I handed Michelle, the property manager as of this date, the keys to #It is, also, the date that I meet Michelle, the new operations managerI appreciate Michelle's response to this emailUnfortunately, she is too new to understand the depth and gravity of my experience with WindsorI left a message for the owner to get in touch with me on January They waited until hiring Michelle to respond to this Revdex.com complaintLatent defects such as poorly insulated (for sound) buildings should be disclosed to unsuspecting applicants before they become tenants and once they are tenants, their concerns should not be ignored

We have reviewed the file and refunded the $200 disputed amount to [redacted].

The Property Manager has talked with both tenants, 404 and 304 numerous times and has sent letters....

304 goes as far as telling the manager she can hear the girl upstairs roll over in her bed and complains that she can hear her and her male guest going at it at 2 am. The manager let them both know that some of these things come with apartment living especially with wood floors and thin walls. 304 told the manager she is moving out at the end of her lease which is in March. They are both good tenants.  From what the manager has heard from both girls its not like she is blasting music or having large parties 404 just has a different schedule and they are conflicting with the girl below.  This is all part of apartment living and just because you can't get along with your neighbor does not mean that you can break your lease, therefore she is bound to her lease.

living at Rosewood Park Apartments. Although we would prefer that you had talked to us directly, we welcome the opportunity to clear up your misconceptions. First, we would like you to know that we take tenant reports of bugs and pests seriously. We have a full-time, licensed exterminator, Jose [redacted], who is more than capable of tending to legitimate requests from residents. Mr. [redacted] is experienced and knows the proper procedures and treatments for the kinds of pests you stated in your complaint. Second, you state that the complex is infested with bedbugs and that every week someone is throwing out furniture due to bedbugs. I can confidently say that there is no infestation of bedbugs at Rosewood Park. Indeed, many apartment dwellers toss out old furniture for reasons other than bugs. People move into houses and buy new furnishings. Couples break up and throw away furniture belonging to another. To surmise that all of the tossed furniture is due to bugs would be an unfair conclusion. Third, your desired settlement is to have your unit professionally exterminated. As already stated, Mr. [redacted] is a professionally licensed exterminator. We will continue to treat your unit as we have done in the past. We only ask that you cooperate with Mr. [redacted] and Management with regard to proper preparation of your unit in anticipation of treatment. Since treatment involves using chemicals, there are strict procedures that Mr. [redacted] must follow in order to successfully treat your unit, which requires compliance on your part. Again, we would like to thank you for bringing your concerns to our attention and we hope that you will turn to Management for resolutions in the future.
