Below is a copy of the email I sent to [redacted] on March 15th.I just re-emailed the letter below to Mr [redacted] He was away on vacation in the Bahamas and missed it He has accepted my offer Hope this resolves this complaint!btw - the link to the shipping policy and disclaimer at our website is [redacted] Hello [redacted] I just got off the phone again with *** claims, and they have agreed to reimburse the shipping cost, minus some incidental charges including insurance The amount quoted is $57.06, and we should receive via USPS by the end of the month Upon receipt, we will in turn mail you a check for this amountI do agree with you, everyone has been a loser in this unfortunate incident, and we should NOT benefit from any profit As a goodwill gesture only, and because I do not feel we were in anyway liable for your wine shipment freezing in transit, I will include another check for the profit margins of your two invoices Normally, I would add a credit to your account, but this seems unfair to me under these circumstancesLet me assure you, whether you are dealing with a larger retail/online merchant like the Bounty Hunter, or a small mom/pop store like ours......every wine store using [redacted] *** or whomever to ship has a disclaimer and shipping terms posted at their websites This is a standard practice just like automatically insuring for replacement valueThe text is very similar and pretty much makes the same statement regarding the seller's responsibility and liability In the years of doing business I have never once had a customer's delivery arrive frozen It may interest you to know on the very same day your wine arrived frozen, we had another customer's wine arrive frozen too, but this time in Minnesota.....where it might have been some what more expected under the horrible conditions that veiled upon the northeastern USA than your locationRenee and I sincerely hope this helps remove some of the sting from your loss Best Cheers!***

On December 21, a case of wine was shipped to me and arrived on December 29, When the wine arrived it was frozen with several bottles exploding in the packing box; the remaining bottles had the corkage partially disgorgedIn effect, the wine was not drinkable and unfit for storage due to freezingI contacted The Wine Consultant to make them aware that I had received damage goodsI was advised to file a complaint with the shipper, ***Subsequent to my filing a complaint, *** contacted The Wine Consultant and denied the complaintWhen advised of this by The Wine Consultant, I appealed the decision to ***In the ensuing weeks, *** refuses to acknowledge my emails and correspondenceBased on advice from legal counsel, *** does not recognize me as their customer, hence they only deal with The Wine Consultant who *** believes either shipped the wine during a period of hazardous weather or shipped the wine in an unsuitable containerIt is my position that The wine Consulta
