This particular building that this resident lived in was in desperate need of updating and renovations on both interior and exterior of the building. On 5/8/15, we began the process of walking the property with contractors in order to obtain the necessary proposals. On 5/7/15, we sent a letter...
(attached) notifying the resident that we would be entering the apartment in order to start this bidding process. We then gave the resident notice of our return entry on 5/11/15 (attached). We then sent notice to all occupants of the building on 5/22/15 (attached) stating that we would be doing numerous updates and improvements to the building and that these improvements were expected the continue through the end of June. We than began work on the exterior of the building such as; paint, brick work, concrete, etc, but had not yet needed to gain access to the interior of the apartment units at this time. On 5/27/15, a notice was sent to the resident (attached) stating that we would be entering the apartments to begin installation of new windows. Window installation began on several different areas of the building, but not yet this particular apartment. On 6/12/15 another notice was sent (attached) to this particular resident stating we would be entering this specific apartment to replace the old aluminum windows with new vinyl double hung windows. On 6/18/15, the resident emailed (email attached)stating she had returned home to find that her apartment was dirty, and that there were holes in the wall. The complainant also stated that the apartment door was unlocked, however, contractors were in the hallway still working. I spoke with the resident on this same day (the same day of the initial complaint) and advised that the contractors were still working and that they would clean any debris upon their departure for the day and that they were still there working, thus the reason the door was unlocked and the contractor was inside. I verified with the contractor that they did in fact vacuum and wipe down the apartment prior to their departure on 6/18/15. The complainant stated she was refusing to pay any future rent because her apartment was dirty. University Apartments feels it gave plenty of proper written notice to the resident and resident failed to follow or read the letter. 6/18/15 is the ONLY date that [redacted] and resident communicated with each other, at no point did were there any unanswered phone calls or emails. On 6/18/15,the same day of initial complaint, University Apartments offered to release this particular resident on 6/29/15 from the agreed upon lease agreement at the resident's request, which originally expired on 7/15/15. University Apartments feels it went above and beyond with notifying ALL residents of said building of dates of entry and notification of building improvements, as a matter of fact, other residents have personally thanked us for doing much needed improvements! On 6/22/15 a final notice was sent (attached) stating that we would be entering the apartment the week of 6/22/15 - 6/26/15 to complete repairs, this process was expected to take 4-5 business days, which is clearly stated in the letter. This particular resident vacated the apartment on 6/29/15, 16 days prior to lease expiration date and University Apartment waived all rental and utility charges for the month of July 2015. University Apartments has suffered an income loss for this particular apartment, but we felt that we were doing what was necessary to keep the customer happy.
