Initial Business Response /* (1000, 5, 2014/06/20) */
Contact Name and Title: [redacted] SVP
Contact Phone: (XXX) XXX-XXXX
Contact Email: [redacted]@sbtbanknow.com
On February 11, 2014, the SBT customer identified above conducted an ACH transaction for $74.26. The customer's balance at that...

time was $69.26 therefore putting the customer in an overdraft situation. SBT began assessing a daily overdraft fee of $8 as a result. Immediately after the overdraft situation occurred, SBT [redacted] branch staff made attempts to contact the SBT customer identified above via telephone. Additional attempts by branch staff via telephone were also made over a 30 period but to no avail. Not once did the customer answer the phone or return our call. In addition, SBT sends out notices to customers in the mail who are overdrawn informing them of the overdrawn status. These letters are sent weekly until 30 days have gone by with the customer in an overdawn status. The SBT customer stated above did not respond to any of these notices as well. Per bank policy, after 30 days of overdrawn status and no successful contact with the customer, SBT considers the account to be abandoned and closes the account. A case is then generated and sent to a collection agency for collection. SBT does not report abandoned checking accounts to the credit bureaus. SBT does however, report abandoned checking accounts to [redacted]. This is a system used by other banks to determine past account abuse by customers attempting to open an account at a bank at a future date. It should also be noted that the SBT customer identified above contacted the collection agency on June 17, 2014 and paid the outstanding amount in full. As a result, a status of paid will be reflected by [redacted]. Thank you for the opportunity to respond to case #XXXXXXXX. Please contact me if you have any other questions.
Initial Consumer Rebuttal /* (3000, 7, 2014/06/24) */
(The consumer indicated he/she DID NOT accept the response from the business.)
That is so absurd. First of all, I still have no statement of my account. I am sure the amount in my account was $74.26, and the $5 difference claimed by SBT was probably from the account fee, which was totally not right. I remember I called the bank about this issue several times, and they promised to waive any fee in my account. Second, I did NOT receive any notice about this overdraft AT ALL. The first time I knew this was from the phone call from debt collector company. They are just so rude that they charged such ridiculous amount of money for just $5 overdraft, which is also so questionable. I would NOT accept this response. The only reason I paid the balance is that I don't want to hurt my credit score. I have been always a great costumer and always try to resolve issues before they happen. I pay my bills almost immediately. This is the first time that I found myself involved such kind of issue. I tried very hard to call those people in SBT but they just refuse to response. I don't think this is the right way to do business and I feel so offended and insulted. Besides the money they asked is so absurd. The solution I am seeking here is that 1) statements should be provided to me, 2) the balance should be refunded to me.
Final Business Response /* (4000, 11, 2014/07/03) */
A review of the SBT customer database revealed 23 "Account Overdrawn Advices" that were mailed to the customer identified above in addition to monthly checking account statements. It should be noted that the address the customer used to open and maintain the SBT Checking account does NOT match the address the customer is using in this complaint form. If the customer has changed addresses, it is their responsibility to inform the bank at the time of the move so that the address can be updated and that documents such as statements and overdraft notices can be sent to the correct address. In addition, as stated in our initial response, repeated attempts to contact the customer via telephone were unsuccessful and messages left on the phone were not returned. Only until the customer was notified by the collection agency did they call the bank. The customer is encouraged to visit any of our ten locations throughout the [redacted] area to receive hardcopies of checking account statements and overdraft advices. Finally, we would like to reiterate that SBT does not report bank initiated account closures to any credit reporting agency.
Final Consumer Response /* (3000, 9, 2014/06/24) */
Additional request is the withdraw the report of my so called "abandoned" account to chemsystem. That is so not true. Again I did NOT receive any notice at all which claimed by SBT staff. I don't know the reason but any how this is not my fault to make this into a "abandoned" account. Again, I am still not sure that where the $5 comes from and why. No body even care to explain about this now and that is why I file this complain and want my money back. I want to get my credit score and report back to where they were before this happened.
