This complaint is an invalid complaint due to the fact that the tank is yrs plus in age, in the ground and the vent pipe that is supposed to be exposed so that it can vent was obviously buried by the home owner at some point in time because we are sure this is not the first time getting oil in the last monthsThis is the first time he has purchased from our company and he did not advise the delivery driver that the vent pipe was not exposedWe are further looking into this matter, and this issue will be resolved totally within the next couple of days

I have reviewed the response made by the business in reference to complaint ID# ***, and have determined that my complaint has NOT been resolved because:
OFFICIAL COMPILATION OF CODES, RULES AND REGULATIONS OF THE STATE OF NEW YORK "613-General operating requirements." states "(7) Delivery of petroleum to a UST system(i) Immediately prior to a delivery, the carrier must determine that the UST has available working capacity to receive the volume of petroleum to be deliveredEvery aspect of the delivery must be monitored."Nowhere in any code or law does it state, that it is the home owners’ responsibility to ensure the functionality or ability for a UST to "RECIVE" oil. I’m troubled by the argument of this business owner because the age of the tank in this particular matter is completely irrelevantthe business would have us believe that an overpressure issue is in any way related to the age of the USTPerhaps the business would dare make the accusation that this issue would have occurred had his technician used a 1" diameter pipe as oppose to the air tight connection that was madehad the tech used a smaller pipe from his hose inserted into the 2" fill pipe to pump the fuel; displaced air would have been allowed to escape (Oil jargon called using a bazooka)it is also common practice for the carrier to start pumping slowly until a whistle from a vent pipe is heard to prevent over filling

The clean up was done at the customers house to the customers satisfaction

the last 5 months. This is the first time he has purchased from our company and he did not advise the delivery driver that the vent pipe was not exposed. We are further looking into this matter, and this issue will be resolved totally within the next couple of days.
