In the agreement, Paragraph 5, [Subsection C] Reserves. states, "A reserve may be established by Consignor for selected items, provided that Witherell's approves of the reserve in writing prior to delivery of the Product to Witherell's...If no reserve is established, the Product will be sold to the highest bidder, and Consignor hereby acknowledges and agrees that the price received for such Product may not be as high as Consignor would have desired, and Witherell's shall have no liability of any kind with respect to the price received and Consignor hereby releases Witherell's from any and all liabilities with respect thereto, and Consignor shall be fully bound by the auction price and will have no right to seek rescission or otherwise to interfere with the sale."
