Review: In October of 2011 we signed a contract with Witsil Construction to build a house in Chelan, WA for us. As of today these are the unresolved issues.

• The contractor ([redacted] Witsil) has not got the final inspection or occupancy permit. We have been living in the house since June of 2012.

• We have double wood framed glass doors with side lights in our den/office that need to be replaced due to poor workmanship.

• We have some deck boards that need to be replaced. They have marks on them where the painter or someone tried to clean up paint drips and took the color out of the Trex decking.

We have working with [redacted] Witsil for over two years now to try to get these issues resolved with no luck.

For some time, about a year, I have been asking [redacted] Witsil to get the things done that need to be completed to get the final inspection and occupancy permit. I have been getting the runaround about the things that need to be done to get the final inspection. I started calling him on a regular basis and every time I call he tells me he will check to see why nothing is happening and then never calls me back. I get the same answer every time I call him with no results.

The issue with the doors all started when [redacted] Witsil suggested to my wife that it would be a good look with a nice flow to stain the doors the same color as the floor and she agreed. Prior to this they were to be painted. His painter then used some stain that he had left over from some other job. I know this because the painter working for the sub told me that he was told to use the stain left over from another job. (without making any attempt to match the color to the floors). I have never found a painter that could or would not be able to do some matching of a stain. They had a sample of the color right there on the floor. [redacted] is now using the excuse that we did not give him a sample of the stain color ([redacted] did not ask for a sample). In any case, there was about 1500sf of floor next to the doors as a sample.

I came by the day the painter was just getting started and only stained a very small spot on the doors. I believe this was in May of 2012. I stated at that time that the color was all wrong and was not going to work. [redacted] told me that we should wait and see as it will darken when it dries.... it did not. He then told me that Douglas fir has a reddish tint in its natural state. But it still could have been stained to match the floor.

After his painter used the wrong stain on the doors, they looked so bad and out of place that we all (including [redacted] Witsil) agreed to see if painting them would work to correct the problem.

My concern at that time was that the stain had worked down into the window caulk in some spots and showed up as dark wave-like spots that would not be resolved by painting them. Painting them did not solve this problem. [redacted] Witsil then removed the glass from the doors and side lights and the molding that holds them in. He then tried to paint the grove that holds the windows. [redacted] then reinstalled them with a molding that did not match the rest of the window molding and it is uneven and splintered. In the possess of doing this the glass got scratched. [redacted] then had the painter paint them leaving the glass scratched and paint on them. In no way is this acceptable workmanship under any circumstance. Had the painted doors turned out satisfactory, we would been okay with them but they did not. We were left with doors that are an embarrassment to us and should be to [redacted] Witsil.

In a letter dated February 19, 2014. [redacted] Witsil accused me of being dishonest with him. If anybody is being dishonest, it is [redacted]. He lied to me week in and week out about having placed an order for the replacement doors. He first told me that they were ordered through Marson and Marson. Whenever I checked in with him, every week or so, he told me he wasn't sure what was going on with the order and he would follow up and see what was taking so long and again with no return phone call. After several months of this, I checked with them myself and was told that they had never been ordered. He then told me he was working with Chelan Building Supply and that they had been ordered through them. After several months of him telling me again that he would follow up to see where the doors were, I checked with them and I was told that he had talked to them but he had not ordered any doors. Now he is back to saying he ordered them through Marson & Marson, my guess is that they would tell me the same story. He mislead me week after week that the doors were ordered and would be replaced as soon as they came in.

On February 26, 2014, we responded to [redacted] Witsil's letter. Offering to sit down with him to resolve these issues , but it would have to include replacing the doors and side lights. On March 3, 2014, we received a another letter from [redacted] Witsil.

[redacted] Witsil and I met shortly after the last letter. He stated that he would replace the doors if I paid for half of the cost. In no way is this acceptable as we already paid for the doors once and this is his responsibility. We hired him as a general contractor to build this house and at one point we all, including [redacted], decided the den doors were not satisfactory and needed to be replaced. Now he is not willing to replace them.

As for the other things on the list the deck boards have not been addressed by [redacted]. In an effort to meet him part way, we are willing to take care of the deck boards ourselves.

We held up our part of the contract with [redacted] Witsil and paid him in full and we expect him to complete his side of the agreement.

The resolution we want and deserve is to have the doors and side lights replaced. The final inspection and occupancy permit completed as he has a legal obligation to take care of these things.
