The situation is unfortunate but for numerous reasons we are not responsible for the alleged damage to the windshield
1/ As stated by the shipper they arranged and paid for the packaging for the shipmentSince no survey was done on the
shipment at destination the cause of the damage cannot be ascertainedImproper packaging could definitely have been the cause
2/ The shipment was signed for in good conditionWe agree that it was not the shipper's father's signatureIn fact, we requested from the carrier and provided him the information that it was his father's import customs' brokerWe also advised that the cell phone number of this broker was on the proof of deliveryWe provided them a copy of thisWe suggested that they may wish to take this matter up with this party who accepted the shipment in good orderTo our knowledge they have refused to do this
3/ The damage was only reported after delivery, damage could have occurred to the shipment after it left the carrier's care and in the care of the party the receiver nominated to deliver the packageTo our knowledge nothing in writing was ever presented to the carrier's destination agent
4/ We are not the carrier but the freight forwarderWe explained to the shipper that the contract of carriage was between them and the carrier as we had arrangedThey were provided a bill of lading from the carrierWe suggested they continue their claim with them but again they did not want to pursue thisWe did contact the carrier on their behalf but due to the clean proof of delivery the carrier refuted the claim
We feel that the shipper's claims, that we did not provide sufficient information regarding customs clearance documentation/clearance procedures and costs at destination, are incorrectOur instructions regarding the bill of lading and its subsequent surrender at destination were for the carrier release onlyIt is the responsibility of the shipper/receiver to ensure they are aware of foreign countries regulations
Both our rate quote and our *** information guide were emailed to the shipper prior to making the bookingI have cut and paste excerpts below from those documents which pertain to damage and import regulations at destination

Your price will include transportation and Canadian documentation charges onlyWe DO NOT provide customs clearance at destinationWe will advise you of pre-shipment inspections or special certificates or legalization that may be required and the associated costs for theseHowever, ensuring you meet entry requirements is your responsibilityYou will have to arrange clearance with the foreign customs authorities at destination or hire a destination broker to do this
We do not provide packagingYour goods should be packaged with the voyage in mindYour goods will be handled at a minimum of warehouses prior to leaving Canada so limiting the number of pieces is a good idea to reduce the risk of lossDuring their voyage your goods may be placed below, beside or on top of other shipments so the packages must be able to withstand this or damage may occur
We only insure goods against total loss, not damageSince you package the goods, any damage will be your riskIf you feel the goods were mishandled by the line causing damage, you would have to claim against the shipping line at destination
We have been in business for 20+ years and have not had any unresolved claimsWe do not feel responsible to compensate the shipper for this alleged damage as it was not caused by usOur reputation in our industry, we believe, is second to noneI trust we sufficiently have outlined our case above to see this issue closed

I disagree with all of this You cannot just blame the customer for everythingWe did make a claim over seas on the glass*** You were to find out that there was a signature from someone who picked up the package but you did not know that my dad made a claim on broken glassThis makes no sense , this is so unfortunate*** ***
