I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint. Specifically, Mr. B[redacted]’s response is unsatisfactory for the following three reasons:1.      Mr. B[redacted] chose the wrong glue for the project, which means the problems with the glue have existed from March 18, 2016 when the project was completed.  At the time of the most recent repairs to the stones, Leeroy represented to my father, Larry, that Mr. B[redacted] had relied on the advice of a salesperson at Menards about which glue to use for the project.  Unfortunately for Mr. B[redacted], the salesperson at Menards was wrong about which product to use.  Mr. B[redacted] should have known the proper glue to use for the project as a result of his experience and expertise, or at least should have done his research on the correct product rather than relying on the advice of the salesperson at Menards.  Mr. B[redacted]’s lack of diligence in selecting the proper glue for the project is what created the problems we are having with the stones.  For these reasons, this is a workmanship issue.2.      As Mr. B[redacted] admits, he had notice that the glue was improper for the project at least as early as May 2016 (approximately 2 months after construction had been completed).  Mr. B[redacted] further admits in his response and in text messages to my husband that the glue was not working because it melts in heat.  As soon as Mr. B[redacted] knew that he used the wrong glue for the project, he should have repaired each and every stone on which the wrong glue had been used.  He did not.  Instead, he chose to repair them on an ongoing basis as the repairs became necessary.3.      Mr. B[redacted] has demonstrated his original intent to repair the stones on an ongoing basis—rather than all at one time—by continuing to repair the stones as they fell off both before and after any alleged warranty expired.  The statement that Leeroy made to my father at the time of the most recent repairs is consistent with that intent and course of conduct.  Specifically, Leeroy represented to my father that he had consulted with Mr. B[redacted] about future repairs and that Mr. B[redacted] had indicated that they would continue to make repairs as needed in the future.  Despite this representation, his prior representations, and his course of conduct, Mr. B[redacted] now has refused to repair the most recent set of stones that have fallen off our seating walls and columns as a result of Mr. B[redacted]’s use of the wrong type of glue for this outdoor project.For these reasons, Mr. B[redacted]’s representation that we are no longer entitled to “free repairs” is inaccurate and unacceptable.   As such, we continue to request that Mr. B[redacted] repair the new stones that have fallen off—at no cost to us—with the proper type of glue and that the repairs continue to be ongoing as the glue inevitably fails in other locations on the seating walls and columns. In the alternative, we request complete repair of all remaining areas of the walls where the wrong glue was used, at no cost to us.  As we mentioned in our complaint, an estimate we have received of the cost for the repairs of all identified defects in the seating walls and columns exceeds $6,750. Regards,
