Thank you for the opportunity to respond to the complaint lodged by *** ***-ID #***.*** *** manages the apartment complex at *** ** *** ***There is no visitor parkingAll tenants display hang tagsAny vehicle that does not display a hang tag is to be towed per our
contract with *** ***Mr*** was parked in this lot in the space marked for apartment 5.Mr*** has stated numerous complaints.Complaint He was illegally towed.ResponseIt is unfortunate that he did not see the two signs (12" by 18") that were posted on the building but it is obvious that this lot is parking for an apartment buildingThe spaces are numberedThe pavement is a different color and height from the adjacent alley and surrounding apartment parking lots.Complaint The tow driver and CS said the sign was not visibleResponseThis is an untruthI was the person who spoke to Mr*** on the night he was towed and have responded two times to his emailsI told him that the signs were in the only spot that they could be putHe speaks of a pole close to the lot where he was towed from but that is a utility pole and it isn't even on the parking lot he was towed from.Complaint #There were scuffs on the door handle.ResponseWe never enter a car and would not ever touch the car doorTo tow a vehicle, we put the drive wheels on go-jaks (small dollies) in order to manually push the vehicle into position to towIn addition, Mr*** stated in an email to me that his emergency brake was on but we would not be able to manually push the vehicle if the emergency brake was set.Complaint #Undercarriage damage.ResponseI have communicated numerous times with Mr*** but this is a new complaintWhen we tow a car, we use a wheel lift that onlytouches the tiresWe do not touch the undercarriage of a car.Mr*** keeps adding complaintsIn our phone conversation he complained about being towedIn the first email, he again questions why he was towed and speaks of scratches on his doorIn the second email, he questions about the emergency brakeIn his correspondence with you, he questions undercarriage damageHe has threatened to contact the Revdex.com, his relative in law enforcement and going to courtMy opinion is that he keeps adding complaints and threats in the hope that we will refund his money. As Mr*** stated in his email, this was his first time in Muncie and "I don't know any other place beyond where I saw other cars parked"Unfortunately that space was reserved for a tenant of the apartment complexTenants pay for their reserved spaceWe removed his car per our contract with the *** ***We will not refund his moneyI don't exactly understand what he means by "as well as my undercarriage vehicle to be fixed: whether it be the number, side, etc" in his desired settlement but we did not damage his vehicle as we only touch the drive wheels on a vehicle when we tow it.If there is any other information that I can provide, please feel free to contact me at 765-292-5092.
