I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:
On Monday I told the company in an e-mail that I did not want the fill pump. It had not left their possession and this should rescind the contract. Spoke to a lawyer concerning the matter and confirmed it. Clay still insisted that he spoke with corporate concerning this and told me that all sales are final and they would be happy to resale it for me if I wish. I did not sign a contract, there is nothing stating that the sale is final and it was a final decision by this company to purchase the pump if it could not arrive by Monday. We ordered a brand new pump 8 weeks prior and it was to be delivered to our facility the following week. It arrived Friday that week. I can't believe they didn't allow the contract to be rescinded as it never left their facility and they could not meet our delivery date. I also iterated that I would be willing to pay for a restocking fee but that the fill pump they were trying to sell was way over priced and that I was not willing to pay that much for it since they weren't able to get it here by Monday. Since they already had my money and would not allow the sale to be rescinded, the only option they left me is to take the pump and go to court. I was told this was being sold under consignment. I find that hard to believe as well. Never had any consignments have an issue with a return that was never in the buyers possession. This is bad business practices as well as deceptive business practices. What they are doing is sticking me with a pump that was built in 1992 that is worth about $1000 to $3000 and then making me get a lawyer to determine the outcome. No matter how you look at this... it is not good business. We have the means and the ability to make sure this doesn't happen to anyone ever again with Whol As. If I have to seek legal council, we are going to take it a lot further than they would anticipate.

The buyer, [redacted]) kept on insisting that Wohl Associates, Inc. (Wohl) did not ship the product out to them quickly, but that is totally false.
Wohl received [redacted] funds on Friday, October [redacted] in the afternoon and Wohl has in their possession (which I can send if you need it) a "copy" of [redacted]'s Advice Of Credit showing the funds arrived into Wohl's account on Friday, October [redacted] in the afternoon. By the time the funds came in the trucking company would not pick up the product so it was arranged to ship on Monday morning, October [redacted].
Based on the sales person's conversation with "Tron" of [redacted], he was informed if the wire transfer of funds was sent on Friday, October [redacted], Wohl would use the rest of the day to test and prep the machine for shipment and the machine wolud be shipped out promptly on Monday morning, October [redacted].
[redacted] statement in the complaint that the Pump was built in 1992 is irrelevant as the question of age never came up and [redacted] could have investigated if that was a factor during the three to four month period of going back and forth on this machine.
This machine was fully tested and a video was taken of it running.
This is a total inaccurate claim which Wohl will defend vigorously.

Regarding the above referenced ID Number [redacted], Wohl Associates, Inc. (Wohl) is in the used equipment business in [redacted] NY since 1968.The company that has filed this complaint, [redacted], [redacted], is totally incorrect and this complaint is without any merit...
whatsoever.The facts are as follows:[redacted] ([redacted]) has been speaking with our company about this FILLING MACHINE for over one year.**Our company sent a video of the machine running. [redacted] finally placed an order in mid October and the funds were received via a wire transfer on Friday, October [redacted]. We immediately got the FILLER ready for shipment to them.**It was too late to ship the machine on that day since the funds did not arrive until the end of the day and no trucking company was going to pick it up so late in the day.**Wohl got in touch with [redacted] early Monday morning October [redacted] and advised the FILLER was ready for shipment and [redacted] told us to hold back the shipment.**Wohl had no reason to hold back the shipment, but [redacted] wanted that and a couple of days later [redacted] asked us to ship the unit to them.We would be happy to answer any other questions on this matter you may have, but [redacted] complaint is without merit.
