In response to complaint # [redacted] I did sign a contract on 09/17/to build a pole barn style garage and not once in my estimate contract or our discussions did I ask for a down payment or draw This however, was suggested by the customer She insisted that I take the amount given to me and that her bank write the check to me personally I believe within a day or so, the customer called to ask what I did with the check, I told her that I deposited it She told me to wait to do anything with the money because the bank called and said if she did not pay off her house, they would take the money back After talking to my bank they said don’t touch it, because it seems the loan was acquired under pretensesI received another call a day later or so and customer informed me that she had acquired another loan to cover the first loan and things could move forward The customer was told and it was stated in the estimate and contract that company was in two contractsShe was given an estimated time of start, but there was not a guarantee of when that would be I received a phone call from customer and she stated that she was advised by someone that the area needed to be stripped of the sod and topsoil, but this was not a help to me When I arrived to dig holes for the footers I spent over an hour and a half removing dirt from the yard and off the fence that needed removed to start building Footer holes were dug and the inspection was passed I arrived with employee to pour concrete footers and customer came outside several times as the concrete was mixing and then poured in the holes At one point she confronted my employee and then stormed off I asked what was said and my employee stated that she asked what size posts we would be setting? He told her to ask me I went to front door and knocked and when she answered I asked her if she had any questions and she said “no.” She was short with me She stated “there was work to be done and all you are doing is talking to the neighbor.” I explained to her that the only work to be done at this time was to mix concrete and pour it into the holesWhen completed the inspector came out and the footers passed inspection The garage was built, the framing was then inspected and passed inspection This was done by the head of the department There was some bracing that he requested to be placed before metal was attached I had an inquiry about the bracing so I had requested and inspector from the [redacted] Code department to come to the jobsite The engineer from the department arrived and explained what was needed and the building passed the inspection again and was approved to continue to placing the metal As stated on 04/24/17, I received a phone call from the inspector saying that I am taking too long and that he was going to turn me into the county prosecutorHe also said that wood used was rotted As I did previously, I tried to contact the customer and she did not reply She has not communicated with me in person since 01/20/17, she has only responded to few of the text messages that I have sent her Now, after the rude phone call from the inspector, I called his boss and asked him (the head of the department) to meet me at the job site When he arrived he went over what corrections were needed He also apologized for his subordinate acting in the unprofessional manner that he did I don’t discuss my finances with anyone, yes, I did discuss my custody battle with the customerSo I’ve got to wonder where the customer got any idea about the money With her stating that my child’s mother showed up at her residence to tell her not to pay me any more money, once I complete: Will I receive the balance owed considering the scope of the job completed and what is left Desired Settlement: I had and still have every intention on finishing the jobI would like for the customer to contact me and to settle this matter and complete our contractThaddeus JW***

May 19th, 2017In response to complaint #12129401Contract was signed on 9/17/to build a pool barn style garageI did give him a certified check in theamount of $10,of my own free will and the check was personally made out to himI did have aproblem with the loan and Mr*** said he would put the check in his second bank account to preventit being taken from himI took out a second loan which took care of the problem having no effect on his$10,000.The exact wording in the contract states *** Brothers Construction is currently under contract for two(2) projectsThe project for South Williams street will not begin until approxNovember 1st, 2016.This is just an estimated time of start date, in all actuality, it could be sooner or later.I don't know what Mr*** was talking about when he stated I was advised by someone that the areaneeded to be stripped of the sod and top soilI personally dug the foundation to help with the processwhile he was working on his other projectsWhen he arrived and saw that I had dug the foundation,he informed me in front of his co-worker that he was impressed with my workHe told me there was tomuch dirt so I removed much of the dirt and spread it both around my house and throughout mypropertyLater after removing the dirt he told me that there wasn't enough dirt for him to do the job heneeded to do.He arrived at a later date with an employee to mix the concrete for the footersI walked outside tocheck on the progress several times that dayEvery time I went out to observe I had seen him inconversations with the neighbor along my fence lineHe would look over at me then continue to talk tothe neighborI said to his employee, 'He is getting a lot of work done talking to the neighbor isn't he?"His employee just laughed so I walked back into my house and came back outside minutes later andMr*** and the neighbor were still talking but had moved further along the fence line towards theally so that I couldn't see themI did ask his employee what size post they would be setting.Twenty (20) minutes later Mr*** approached my front door asking me if I had any questionsI wasupset with him and stated to him there was work to be done and all he had done was talk to myneighborHe replied "only one hole can be done at a time"Mr*** informed me that the inspectorhad checked it out and it had passed but I was shown no proof of this occurringAll I know is that theinspector was getting on Mr***'s case about errors being done on project.I made daily observations on the project but noticed very little work being completedI periodicallymade calls to Mr*** concerning where the project stood at that given points in time, I don't feel Iever received any real concrete answersThis really frustrated me.April 3rd, I texted him asking if he had any approximate date on when he would be completing thegarageHe replied telling me all sorts of things but never answering my direct questionOn April 17th,he texted me more things that needed to be done but still didn't answer my question on whenproject would be completed telling me he was tied up with custody issuesHe asked me to call him laterthat afternoonI texted him the day of April 18th, telling him I couldn't contact him the previousday due to attending a funeralI also stated I was concerned about the dry rotted wood that he hadused on the garageMr*** never replied so I contacted and met with an inspector from the codedepartmentWhen the inspector saw the dry rotted wood he immediately called Mr*** and toldhim the dry rotted wood must be changed then proceeded to mark the wood.I have been informed by multiple members in the community that Mr*** has been working otherprojects after starting mine so I went to investigate myself and sure enough he is working on otherprojects since starting mine that were not part of the projects mention in the contract that needed to becompleted before mine would be in motionOthers in the community have told me they havepersonally offered to help Mr*** in completing my garage but he replies with "he has no money" toeveryoneAlso we agreed upon a price to begin with and that price is on the contractAfter signing thecontract Mr*** came to me asking me to sign another contract for an additional $2,I told him \was not comfortable doing so.May 9th, Mr*** finally contacted me saying he would like some communicationThere hasbeen a lot of communication but this communication has accomplished nothingI signed a contract tohave a garage built in my back yard because I've had to replace four (4) vehicles due to parking streetside.This has increased my car insurance and created a lot of stressThis was all explained to Mr***when the contract was signedEight (8) months later and I still do not have a garageI am paying over$per month for my loan and I have absolutely nothing to show for itThis is not rightI feel Mr.*** is in breach of his contractThere are several flaws with my garageHe used dry rotted wood.what other cheap shortcuts might he try to pursueIf he can get away with doing this to me how manyothers has he done this to and if not stopped how many more might he continue to do it toI havenumerous neighbors that will vouch as eye-witnesses to the production of the garage from the verybeginning.*** ***
