WE feel the complaint should not be held against us or even posted on our siteThe home owner (*** ***) gave, Haymaker Tree & Lawn Incpermission to remove the tree and stumpAs a contractor I can only use OOPS (811) to locate public utilities not privately installed utilities, that is the homeowners (*** ***) responsibility to inform us of buried lines on or by any trees or stumps that need removedIn this case Mr*** gave us permission to remove the tree and stump knowing that stump removal is subgrade actionWe protect ourselves as a company by using the service OOPS providesWe have no responsibility for privately installed utilities and there is no safe guards for privately installed utilities except for the land owners (*** ***) to use precautionary measures to mark, remove or relocate lines before the work is doneI invite you to call OOPS (811) for yourself and hear exactly what they provideThank you for your time,

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
As I stated previously, the invoice/estimate that I had DID NOT have
the statement that Haymaker has circled at the bottom of the blank copy
they provided here.  I can provide the original if challenged, but have
attached a photo of the original.Secondly, at the time of the
work, I told them not to go deep on the stump, just grind the top but
do not go below ground level.   They did anyway and that is how they cut
the line.   They also went well outside the boundary of the main stump
itself which is how they encountered the line.  The line is still
sticking out of the ground and is clearly not near the center of the
stump.Thirdly, they told me at the time that someone would be
repairing it, but nobody ever arrived and Haymaker never responded to
messages that I left when I tried to call about it.  At the time, I accepted their apparent intent to make the repair and when asked to pay in full, I did believing that they would make the repair.I chose
Haymaker because their ad in the yellow pages indicates Revdex.com Accredited
Business and it indicated they were FULLY INSURED. The fact
that they have since changed their invoice/estimate to include the
statement about owner responsibilty regarding utility lines, the fact
that they never sent anyone to make the repair they said would be made,
how they did not listen to the instructions I provided, and how they
continue to deny any responsbility in this matter clearly indicates that
they do not care about their customers and that they are trying to
protect themselves from their mistake.I do not accept their response, but it's clear they have no intention of making this right and that they are a business that cannot be trusted.   I've learned that I will not pay in full until matters such as this are resolved, and it's unfortunate that we cannot have faith in our fellow man.Regards,
