requests transfer of our office's medical records electronically to another health care provider at no charge.  The original records, however, must be retained by the undersigned medical group practice, the departing provider's former employer.  Further, the new employer of the provider reportedly cannot accept a copy via electronic means.  The complainant was informed of the mutually agreed upon arrangements in place with the provider with respect to providing copies of our office's medical records.  The provider has failed to comply with the terms of the agreement or otherwise cooperate to facilitate receipt of medical record copies.  the complainant has no obligation to pay a fee for a copy of the records to be sent to the provider's new employer.  This is the obligation of the provider who has failed to abide by the agreement.Prior to the filing of this complaint, the complainant was informed that a copy of the requested records were made, available and ready to be provided to the provider's new practice employer.  In an effort to resolve this complaint, we will make arrangements to deliver a copy of the records promptly and attempt to resolve the underlying non-payment dispute with the provider.  We sincerely regret the circumstances of this complaint.  We believe mis-information was given to the complainant by someone external to our office in an attempt to create conflict for our office.

A copy of the requested records has already been provided to the physician as originally requested by complainant on the records release form.  However, we will make another attempt to satisfy the complainant by sending a duplicated electronic copy of the records directly to the complainant via a secure method in compliance with HIPAA.
