Dear Revdex.comDiamond Restoration preformed a property inspection to determine if hail or wind damage exists. When damage is present the homeowner is asked to a sign contingency contract. We treat all homeowners with the upmost respect and courtesy and explain the contingency agreement in
detail. If the homeowner chooses not to sign the contingency, we walk away. The homeowner signed the contingency and the salesman contacted the insurer to file a claim on behalf of the homeowner. The salesman met with the insurance adjustor and walked the roof and property with them. We have found that our being at these meetings tends to slow the adjustor down, they are then able to locate all existing damage on the entire property. Often times we are asked for our help or opinion about the property damage. We by no means tell the adjuster how to do his job but act as an assistant to help find all the damage which increases the value of the claimThe contingency contract is valid with this homeowner as the salesman attended the insurance adjustor meeting and the home owner received a statement of loss from the insurance company. The roof was passed or bought by the insurance company. A contingency contract is the homeowners promise to hire us as their roofing contractor if we are able to get an insurance claim passed. If we cannot get the insurance claim passed, a free written estimate is provided upon request. It’s our experience that when the insurance does not buy the roof/siding/gutters etcthe home owner has no interest in a free estimate. The use of contingencies is a common practice in the construction industry. A contingency is a contract provision that requires a specific event or action to take place in order for the contract to be considered valid. If the party that is to fulfill the requirement of the contingency is unable to do so, the other party is released from its obligations. We fulfilled our requirement by getting the roof passed. I have discussed this complaint with the salesman, knowing the character of this individual, I believe no high pressure or miss leading sale tactic took place. He asked to see the scope and price identified on the loss statement/scope of work received from the insurer because as the homeowner was fully aware we work from the insurance proceeds. The estimate in the scope of work from the insurance carrier is required to fill in the figures on the contingency contract. It is my opinion that the homeowner simply decided after receiving the insurance proceeds they would shop around or keep the money and not repair the roof, I cannot speak to their motives. However, a salesman from another company did call our Sales Manager to discuss the home owners contract, the Sales Manager would not discuss the job with him as soon as he realized it was not the husband. (There is a long texting chain). He is the homeowner’s brother and said he would run our name into the mud. He said he was filing a complaint with the Revdex.com and Angie’s List. I am not a member of Angie’s List but will be contacting them to respond to any complaint filed. As for our being threatening, I feel asking someone to fulfil a commitment is neither harsh or threating. The tone in the voice of our Sales Manager may have changed when he was unable to make the homeowner understand their obligation but no one was threatened. Please assure the home owner we have no further interest in doing business with them. I believe this complaint is unjustified and hope I have explained my position The service we provided has value even though the home owner did not allow us to move forward with the project.
