Lot drainage issues NOT addressed by builder after multiple requests. Also, consulted with Drainage Professionals which concluded problem.As part of 1 year home warranty starting May 2014 I provided in writing lot drainage issues on March 7, 2015 to business owner Mr Woodard of Woodard Builders. After many months of constant communications Mr Woodard continues to deny any drainage issue even after providing pictures, obtaining estimates from professional drainage experts confirming issue, and neighbors on both sides of my home having drainage systems installed - NO ACTION has been taken and it is now August 2015. To compound the drainage problem all of the rear gutters are draining into backyard adding to the flooding. If remains grass will die as all nutrients is being washed away, backyard unusable for many days of flooding, water running down driveway creates slip hazard with moss build up and/or freezing water. In addition, mulch and soil debris from lot runs into front sewers contaminating water supplies.Desired SettlementEstimates for drainage solution average $3000 for labor and materials which include installing a drain basin at the top corner of backyard and run pipe to side of house. Along top part of backyard a drainage ditch will be dug with fabric and river rock in it - basically solution is to install riverbed along back of lot to divert water into drain basin. In addition, the gutter downspouts that go to the middle of the yard will be diverted to side of house. Business Response Builder has responded to complaint's many inquiries. Builder has had different landscaper from original installer review site for independent opinion of any corrections need. He found none. Builder had[redacted] look at site and they found no action needed. Complaint agreed to industry standards of reviewing site 24 hours after rainfall to determine if water standing in yard. Complaint to notify Builder after rain event to look at yard. Emailed complaint last week and that is still the plan. Complaint must be waiting for a large rain event. Filling this complaint is unjust since Builder is waiting to review once emailed to look at site. Complaint lives on a sloping lot and does not believe water is to run from upper rear yard to lower side and front yard. Water runoff is being handled as designed by landscape professional. Warm season grass is doing well on sloped lot. Consumer Response Builder's response has many false statements and below provides further details:1. I have in email from [redacted] the below statement to Builder and you can see for yourself the reason why I need to contact Revdex.com on this Builder - email dated May 14, 2015:"The [redacted], to include Mr.[redacted], does not regulate individual lot drainage and thus, does not have a say in the adequacy of grading and drainage. I spoke with Mr.[redacted] about his conversation with you and he indicated that he made the comment that the pop up was installed satisfactory as related to manufacturer specifications not the location. He also indicated that ideally drainage should be routed to the front yard. The Town provides technical advice but does not have a say in the actual lot grading drainage and landscape design"The Builder stated [redacted] found no action needed which is NOT how I would interpret the email.2. I do live on sloped lot and I DO believe water is to run from upper rear yard to lower side and front yard - that's the problem water pools in backyard and does NOT make it to front yard. Dumping output of gutters for entire rear roof of house into backyard only exacerbates the flooding.3. Builder had different landscaper also look but this "other" landscaper is used by Builder so not much of an "independent" view considering Builder provides him business.4. Builder has known about this issue formally in writing since March 2015 with many opportunities to correct and after 6 months I feel this is not "unjust" to report to Revdex.com as well as contacting other industries such as [redacted] ([redacted]).5. I did inform Builder of so called "rain event" and then rain started again so visit to yard was cancelled. The "rain event" that contributes to flooding is dependent on many factors - how saturated was ground, temperature/humidity, what season for example lower flooding in Summer, ..etc..6. Builder's response on my grass of "Warm season grass is doing well on sloped lot" is not true. I have already replaced 2 entire rows along entire top of backyard where river starts to flow, flooding has washed away grass in lower areas and only clay remains, many areas very thin and no topsoil remaining. I know "doing well" is a subjective term but in my opinion backyard grass is definitely not doing well. In addition to providing drainage solution the Builder will also be held responsible for cost of past and future grass replacement if not resolved.All of my above statements can be substantiated to Revdex.com with emails, pictures, ..etc.. The Revdex.com is designed to inform others of information to help with pre-purchase decisions and I want consumers to know if building a home with this Builder beware if any drainage issues occur.Final Consumer Response The Builder and original Landscaper met at my home on August 26, 2015 and we agreed on a drainage plan which will be done in 2 parts. Part 1 will be done now and Part 2 will be done in Spring 2016 because if done now bermuda grass only has 2 weeks left of growing season and yard will remain dirt until next season. I agree to close this Revdex.com complaint.
