I am rejecting this response because:This is unacceptable The bed was due to be completed by a day or two after Christmas This was a birthday/ Christmas present for my son His birthday was Dec9, and it was supposed to be delivered Decor Dec When the weather was mentioned as an issue when Ruben called Jim (as I have not ever even talked to Jim on phone- only through texts) Ruben let me know about delay and I texted Jim for expected delivery date(attachment 1) Then it was one excuse after another When Jim had surgery and we were unaware, we stated this was concerning us and we feel we are being blown off(attachment 2) Only at this time did his wife text us to tell us how rude we were being due to circumstances that we were unaware ofAt that time, we stressed importance of them communicating with us and making us aware of things so we do not worry Naturally, getting no response for something paid for in full is concerningWe then attempted contact a week later for an updateNo calls or texts were returned At this time, we let them know if we did not hear back from them by 8am the next day we were calling the police And the next day there was still no response or call from them They completely stopped all communication and made no attempt to call, discuss or set up a time to deliver The police officer asked Jim if he could send a photo to even show something was done and Jim could not even do this Jim, taking a picture to show a customer who paid in full for a bed, that was now weeks late, does not take a photographer It takes any regular joe who has a phone with a camera, like yourself When you came to meet us, as discussed by Jody, you were bringing all your pictures to show us your work You showed us so many pictures of your work, in your binder and on your phone It is very odd that this request, from a customer who paid in full, was too much for you, as you “are not a photographer.” (attachment 3) As far as your commute for meeting with us to go over pictures, do a contract and receive payment, these are called business expenses Not once did anyone state there was a fee for that, and no meeting would have taken place if that was the caseIt is not our responsibility, nor are we accountable for you not completing or delivering the bed on time Nor are we responsible for any personal issues that arose, which led to the job not being completed on time We have a paper trail of our conversations showing we were being very reasonable What was not reasonable, was when you completely stopped all communication with us, ignoring phone calls, texts and blocking us so we could not message, as we did initially on Facebook This is why we said we would call the police if we did not hear from you by the next day at 8am, and that is why we did so That is not threatening in anyway, to state what actions we are taking if you do not communicate with us is not a threat We paid you $We received absolutely nothing from you You have not produced what we paid for, it is way past an acceptable time to do so, and you chose to stop all communicationWe will accept a $cashier’s check You accepted a job, you were paid (in full), and you produced nothing Even after we were attempting to work with you / be flexible with you on the time frame Personal issues and not meeting deadlines and then stopping all communication is not something you can factor in and deduct from a payment that was made for something you did not produce We paid for a bedIn fullAs stated on our receipt You did not deliver this ***I just looked back through Facebook messages and see that Jody has now deleted her profile This causes her messages with me to disappear I have already saved, copied and screenshotted them, attachment is one of the screenshots.***Attachment I am also including to show that I told them before or by Christmas bed was needed Will be emailed as I cannot attach another attachment

We did have a agreement to make a bed. We also had a agreement that if the bed was delivered and set up there would be a fee for doing so. The bed was completed on time however when it came time there was a snow storm hat affected us. So after getting a phone call from Kelly threatening us we came...

to terms to meet the next weekend. Then just a few short days later Kelly's husband called me and threatened me. We did not ever have any frozen pipes however we did have a furnace go out on New Year's day and had to be replaced. Carbon monoxide levels were very high due to this. Then shortly after that I had to have surgery which was not routine. I had a golf ball size lump blocking my gallbladder. Required 10 staples. I don't have to send pictures of the bed completed. If I sent to pictures to every single person that asked for them I'd become a photographer and get paid for doing pictures. The reason the bed was in a pile of lumber was because it had to be dismantled so we had the room. Also I did drive the 2 hours to meet with them to discuss the building plans in person instead of over the phone. We have never delivered and set up anything we've built. We have however delivered for a price. So with all of this they can either pay a delivery and set up fee and we'll do that or they can have a partial refund for materials only. Like I said we drove 2 hours no compensation for that, we also drove 30 miles to Pekin to get materials, we also have time in building the bed not to mention the several phone calls (some threatening). Materials for the bed was around 230.00 take that minus 700.00 470.00 for time and labor. They can get 230.00 back.

I am rejecting this response because:This is unacceptable.  The bed was due to be completed by a day or two after Christmas.  This was a birthday/ Christmas present for my son.  His birthday was Dec. 9, and it was supposed to be delivered Dec. 26 or Dec. 27.  When the weather was mentioned as an issue when Ruben called Jim (as I have not ever even talked to Jim on phone- only through texts) Ruben let me know about delay and I texted Jim for expected delivery date. (attachment 1) Then it was one excuse after another.  When Jim had surgery and we were unaware, we stated this was concerning us and we feel we are being blown off. (attachment 2) Only at this time did his wife text us to tell us how rude we were being due to circumstances that we were unaware of. At that time, we stressed importance of them communicating with us and making us aware of things so we do not worry.  Naturally, getting no response for something paid for in full is concerning. We then attempted contact a week later for an update. No calls or texts were returned.  At this time, we let them know if we did not hear back from them by 8am the next day we were calling the police.  And the next day there was still no response or call from them.  They completely stopped all communication and made no attempt to call, discuss or set up a time to deliver.  The police officer asked Jim if he could send a photo to even show something was done and Jim could not even do this.  Jim, taking a picture to show a customer who paid in full for a bed, that was now weeks late, does not take a photographer.  It takes any regular joe who has a phone with a camera, like yourself.  When you came to meet us, as discussed by Jody, you were bringing all your pictures to show us your work.  You showed us so many pictures of your work, in your binder and on your phone.  It is very odd that this request, from a customer who paid in full, was too much for you, as you “are not a photographer.” (attachment 3) As far as your commute for meeting with us to go over pictures, do a contract and receive payment, these are called business expenses.  Not once did anyone state there was a fee for that, and no meeting would have taken place if that was the case. It is not our responsibility, nor are we accountable for you not completing or delivering the bed on time.  Nor are we responsible for any personal issues that arose, which led to the job not being completed on time.  We have a paper trail of our conversations showing we were being very reasonable.  What was not reasonable, was when you completely stopped all communication with us, ignoring phone calls, texts and blocking us so we could not message, as we did initially on Facebook.  This is why we said we would call the police if we did not hear from you by the next day at 8am, and that is why we did so.  That is not threatening in anyway, to state what actions we are taking if you do not communicate with us is not a threat.  We paid you $700.00. We received absolutely nothing from you.  You have not produced what we paid for, it is way past an acceptable time to do so, and you chose to stop all communication. We will accept a $700.00 cashier’s check.  You accepted a job, you were paid (in full), and you produced nothing.  Even after we were attempting to work with you / be flexible with you on the time frame.  Personal issues and not meeting deadlines and then stopping all communication is not something you can factor in and deduct from a payment that was made for something you did not produce.  We paid for a bed. In full. As stated on our receipt.  You did not deliver this.   [redacted]I just looked back through Facebook messages and see that Jody has now deleted her profile.  This causes her messages with me to disappear.  I have already saved, copied and screenshotted them, attachment 3 is one of the screenshots.[redacted]Attachment 4 I am also including to show that I told them before or by Christmas bed was needed.  Will be emailed as I cannot attach another attachment.
