Im seeking completion of the maintenance with due diligence and within a reasonable time, with all living conditions being considered and not the customary diligence in which the issue is being resolved, with neglect for the living conditions in late June , on the
2nd floor, with no climate controlI also expect that in the future when I request corporates contact information it should be given to me immediately, and not have it requested of me to bring paperwork proving my son's disability and only then, I can have the contact informationI also expect future common courtesy and respect that a tenant is due as a customer and not have my inquiries answered with deflection and patronizing responses covered in a condescending toneWith that said only after contacting Woodhaven Apartment Management LLC, the Revdex.com, the Colorado Apartment Association and the Denver Metro Fair Housing Centerand providing paperwork about my child's disability, they are now in the process of repairing the ACThis was a small task that required a lot of time and energy and lost wages on my wife and I's part to resolve

We spoke to the resident and cleared things upShe had not been to the pool in a long time and had never gone to the office to ask if the pool had ever been fixedThe manager spoke to her and everything is good now!

There seemed to have been a miscommunication that occurred as far as repair timingWe did respond and the AC has been fixed within days of his complaintWe do have a priority list for AC's since it is the hot seasonWe do our best to get to everyone in a timely fashion

This complaint was resolved

We have decided to let the resident out of his lease

There must have been some misunderstanding that occurredWe have since changed our paperwork to insure this will not occur againA refund check has been issued to the applicant

Complaint: [redacted]
I am rejecting this response because:In March 2016, I contacted Woodhaven Property Management regarding rental of a one-bedroom apartment. I originally had spoken with a gentleman named [redacted] who stated that the apartment wasn't ready and that I had to wait 12 days for them to get it prepared. I made accommodations with my employer to take off work to move and had to get a hotel temporarily until the place was available. I followed up with [redacted] and he stated that the apartment was available I paid my deposit and receive my keys and move my belongings into the place. I was there 12 days and found that the place was infested previously with bedbugs and they were living in the walls and in the carpet. I was pretty upset about this and I immediately contacted the management and they immediately denied all responsibility for it and refused to be rational and reasonable. I contacted the regional manager [redacted] and she was hesitant to help me at first, but she knew what she was facing and actually paid for my Movers to move into a sister apartment complex relatively close. I had to miss work again to move and my boss was not too happy about this. I moved into the complex down the street called Westwood Apartments and was there two days and also found bed bugs and had to call an exterminator to this place. This is when the problems began.... I had to pretty much beg Woodhaven Apartments to release my deposit back to me in order to pay the rent in to the new place because I didn't get paid for several weeks. They made me sign a confidentiality waiver stating that I would not speak about the truth. I was cohearsed by them to do this because they threatened to file harassment charges on me for bring the bedbug issue up in their office in front of other tenants. [redacted] was extremly rude on camera. I moved into Westwood Apartments and the place was disgusting and nothing as to what [redacted] had indicated was available. The first night I was there, the toilet flooded and I couldn't even get a hold of Maintenance to fix it. The laundry machines were constantly broken and we're not fixed until the final month of my lease. They falsely advertised this apartment. As a direct result of missing work and having bed bugs, I lost my job. They never fixed any of the problems within a timely manner and or violating the lease on their end. I didn't pay my rent and so they started the eviction process and never gave me a specific date to vacate my home. I went to work at another place and came home and all of my belongings were thrown out onto the grass in front of the apartment and I lost over $2,000 and valued belongings by the maintenance staff. I tried reporting this to the management, [redacted], and he was totally rude about the situation and didn't care and tried blaming it all on me for the situation when his company is the one that caused all of the problem all alongSince this company violated their lease agreement and the Covenant to liability of comfort, they should not have any premise to charge me the fees that they are charging. Additionally, I would like the monetary value of the belongings that were stolen from me replaced. The apartment manager [redacted] claim that they cleared out my apartment and I went by there the next day to get my mail and they were still belongings on my balcony which proves that they did not clear out the entire apartment and I lost it computer, a TV, a tool set, a nice skateboard, among other things.... this company hired an attorney to send me a cease-and-desist letter and they are threatening legal action against me but they are defending a company that is knowingly negligent to their tenants. I would love the opportunity to talk to them in front of the judge.
Sincerely,
[redacted]

Initial Business Response /* (1000, 15, 2015/08/24) */
8.19.2015
This is in response to complaint case # XXXXXXXX Building/Unit XXXX-XXX. On 6/23/15, we received a call from [redacted], she had a backup in her kitchen sink. We notified maintenance right away but they were unable to unclog the...

sink. We contacted [redacted] A plumbing company. When they arrived they tried to jet the line but was unsuccessful due to a blockage. Impressions carpet cleaning was also notified to extract water from the hallway carpet. [redacted] A ran their camera thru the line and found a broken pipe located under kitchen vinyl. [redacted] Maintenance Coordinator contacted Mr. [redacted] by phone at this time to let him know that [redacted] A was needing to jack Hammer the kitchen floor to replace a broken cast Iron pipe. After speaking with Mr. [redacted] we agreed to begin the work on 6 /24/15. [redacted] A was not able to begin the work until late afternoon. We were in constant contact with the residents in regards to the extent of the repair. After replacing the broken pipe, [redacted] A backfilled the hole and replaced the concrete. On 6/25/15, two members of our housekeeping staff entered the apartment and cleaned kitchen walls and appliances. [redacted] and I physically went to the unit on 6/25/15 and 6/26/15 to supervise the progress and keep the communication open with Mrs. [redacted]. Mrs. [redacted] verified that she was receiving our door hangers from the vendors and maintenance staff. On 6/26/15 we had new kitchen vinyl installed and restored the kitchen back to its original state. At this point, we had housekeepers do a final clean along with [redacted] Carpet Cleaning, installed new pad, and completed carpet repair in hallway and carpet cleaned both areas. In the end [redacted] and I spoke with Mrs. [redacted] personally, she thanked us graciously and stated that after staying with family it was good to be back home.
Initial Consumer Rebuttal /* (3000, 18, 2015/08/25) */
(The consumer indicated he/she DID NOT accept the response from the business.)
I was out of my home for 3 days based on their mishandling of maintenance and the first night I didn't get a notice until 11pm that I could not go back into my unit and find lodging in my middle of the night with small children.
I was instructed to remove everything from my counter, I did as instructed only to come home with everything in my counter removed by Woodhaven staff and set in the wet dirty pipe water soaked carpet and concrete dust their plumber left all over my property. My kids coats were thrown onto the floor, there was moulding left in the floor only after I complained did the Manager come over. I still have not and per the Manager I will not be reimbursed. The carpet was never cleaned as the Manager replied, only a portion was replaced.

Initial Business Response /* (1000, 7, 2015/10/02) */
Ms. [redacted] signed a lease that clearly outlined what her charged would be if she broke her lease, which is signed, initialed and dated by her in several locations. Please see attached lease and concession addendum.
When she gave notice she...

told us she would provide us a forwarded address at move out but she did not give us one so, we sent all correspondence to her address at the property which is common practice.
She was charged as follows:
Residents are responsible for their lease until it either finishes or a new resident moves in. Her leases ended 7/31/15 and she moved out 6/30/15. A new resident moved in 7.16.15 so she was only charged half the month $476.61.
Concession charge back of $300.00 for a MI special due to her lease break.
Reletting Fee of $985.00.
I do apologize if things were not explained to her better in the office and I have addressed that with the staff but, she was charged according to her lease.
Initial Consumer Rebuttal /* (3000, 9, 2015/10/06) */
(The consumer indicated he/she DID NOT accept the response from the business.)
If my correspondence would have been forwarded to my address on file, which is the Woodhaven address, my mail would have been forwarded to my current address, as all my other mail was forwarded to me via USPS.
I understand I signed the lease. But when I spoke with the foreign lady when I signed my move out notice, She explained I would only be charged for the month of July, which I should have got in writing.
I've done research on this reletting fee and I will be taking Woodhaven Apartments to court. After, of course, I pay off the debt collector which Woodhaven so kindly sent me to.

Mr. [redacted] did apply for a studio apartment at our community. He was not denied, he was accepted with conditions which means he would need to put down an extra deposit. He was originally scheduled to move in April 8th but moved it to April 15th because he needed more time to come up with the...

additional deposit. On the 14th of the month he called and said he wanted a 2 bdrm instead which we did not have. We explained to Mr. [redacted] that if he canceled now, he would lose his deposit since we have been holding the unit since the day of his application which was the 27th of March. It is typical that a deposited is forfeited once an application is approved and an apartment is held. We held this unit for 14 days before Mr. [redacted] said he no longer wanted the studio apartment.

We have done all that we can do for Mr. [redacted] as noted in my previous response. Unfortunately, he was evicted for non-payment of rent and his personal belongings were dealt with as with every eviction. The sheriff dept was involved so I am confident we did the evictions by the book.
