I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below
I have documentation (which I provided the HOA in May) which refute the claim that the leak was caused by anything internalIn fact, two companies stated the water entered from the exteriorIn the letter from HFI, it is stated that unique weather conditions forced water into the unit causing the floodIt is plausible that wind direction played a large role in the water entering the unit, and explains why the leak has not (yet) occurred againThose documents and pictures the chimney next to mine which demonstrate the company hired to fix the roof last year clearly missed several chimneysHow many floods have to occur before the HOA admits there is a problem?
I also have included pictures of missing flashing along my roof-line and damaged flashing along the exterior of the chimneyWhile I was unable to secure a ladder to climb on to my own roof, I was able to stand inside the chimney area and could see day lightThe claim that the leak was caused by a toilet overflowing is preposterous, as my (former) tenant was on vacation at the time of the floodThe water to the condo was not on when I entered the unit on April 26thFurther, the bathroom wall is shared with the bedroom - the only portion of the condo untouched by water damageYou will also find a picture of water damage to the interior of my unit immediately adjacent to the chimney. Just because the HOA does not think this is an issue does not mean they are right

Woodridge Association of Owners, Inc. The Board has asked that I respond on its
behalf to [redacted]'s complaint that she recently filed with the RevDex.com regarding a lack of roof repairs to her unit. In May 2014, the
Homeowners Association asked [redacted] Construction to inspect Unit [redacted] (Ms. [redacted]'s
unit) and Unit [redacted] to determine the source of the water damage that occurred in
April. [redacted] inspected the outside structure of the building containing Units [redacted]
and [redacted], around patio doors, the roof, gutter and fire•chase to see if they
could determine the source of a water leak that would cause damage to Unit [redacted].
[redacted] could find no area that was leaking that would cause excessive water on the
ceiling of Unit [redacted].
[redacted] was of the opinion that
a toilet or other source of water overflowed from within Ms. [redacted]'s unit into
the ceiling of Unit [redacted]. I enclose copies. of [redacted]'s original letter to the
Homeowners Association and its addendum letter regarding its inspection.
To date, Ms. [redacted] has not
provided any information or documentation to the Homeowners Association which
would prove that water entered her unit because flashing around the chimney was
lacking. New roofing and gutter systems were installed on all Woodridge units
approximately one year ago by [redacted] Roofing Company from Avon, Indiana. There
have been numerous and frequent downpours of rain since the water leak occurred
in Ms. [redacted]'s unit in April. No complaints have been received by any other unit owners about water leaks. Furthermore, Ms. [redacted] has not
complained about any additional leaks since April.
In addition, Ms. [redacted] has
not provided any documentation to the Homeowners' Association to support her
claim that adverse weather conditions caused damage to her condo.
As Ms. [redacted] points out in
her complaint, "Four companies were unable to recreate the leak inside my
unit." This fact, and the fact that no other-complaints have been received
by any other homeowners after the spring rains, suggest that lack of flashing
around the chimney of Units [redacted] and [redacted] was not the cause of the problem.
The insurance purchased by
the Homeowners Association is "walls out" coverage and was intended
to cover the liability of the Homeowners Association for negligence and for
damage to the exterior ofthe buildings and the common areas. Ms. [redacted] has her own homeowners'
insurance coverage with [redacted]. The Homeowners Association forwarded the
[redacted] letter to Ms. [redacted]'s carrier so that it could evaluate her claim. No
further requests have been made by [redacted] for additional information.
Finally, in her complaint,
Ms. [redacted] specifically states that she wants the roof of her unit fixed. As
stated previously in this letter, the roof is fixed. A new roof was installed
approximately one year ago. The Homeowners Association has received no
complaints from any other homeowners about leaks. [redacted] Construction inspected
the units after Ms. [redacted] had a water leak in April and [redacted] did not fmd_that
lack of flashing around the chimney was the issue.
