While we believe that we have maintained our company values in dealing with Mr.***, we understand that it can be hard to find middle ground in situations wherebuyer’s remorse is involved.In a show of goodwill, we are willing to offer Mr [redacted] a full refund for the cost of thetop that he purchased from Woods Cycle CountryIn addition, we will cover the cost oflabor to have our techs remove the topMr [redacted] will still be responsible for the initialprice he paid for the installation of the Pro Box top.As the top was new when we sold it to Mr***, we understand that we will be takingback a piece of equipment that must be resold as usedAs such, our offer torepurchase the top is only valid if the top assembly has not suffered any damage whilein the possession of Mr***Other than wear and tear, we will be unwilling tostand behind this offer if the top has suffered any damage or if it has been abused inany way.As the mounting clamps and hardware often burnish the finish of the vehicle, Mr***will need to acknowledge that his vehicle may show some residual signs of the tophaving been installed on his Polaris RZRIn addition, as some holes are often drilled inthe roll cage and body for cable routing, these holes will remain unfilled after the top hasbeen removed.As Mr [redacted] claimed a tax exemption on the purchase of the Polaris RZR, theaccessories installed on the vehicle were also exempted from State sales taxTheamount of the refund would be in the form of a company check for a total of $1999.00.If this offer is agreeable, then Mr [redacted] will need to contact [redacted] via email toschedule a date and time for him to return the Polaris RZR to Woods Cycle Country sothat the top can be removed by our techniciansWhen he arrives with the vehicle thetop will be inspected for any damageIf the top is undamaged and in a resalablecondition our staff will proceed with the removal of the topWe would want to concludethe return by April 7th, Upon completion of the work, Mr [redacted] will be presented with a check from WoodsCycle Country for $1999.As terms of this settlement, Mr [redacted] also agrees that he will report this issue to theRevdex.com as having been settled in a satisfactory manner.If acceptable, to schedule the removal of the top at Woods Cycle Country’s location inNew Braunfels, [redacted] can be reached via email at [redacted] .If you have any additional questions about this issue, then don’t hesitate to contact mevia email

Apologies up front for our delayed response, but Mr***’s allegations required someresearch on our part, it took a while to complete that work.Mr***’s assertion is that we marked an item up (a Polaris RZRPro Box /Audio Engineering roof assembly incorporating a stereo system and LED lights,hereinafter referred to as “the top”) so that we could then offer him a discount on thatsame item is incorrectNot only do we not operate in that manner, but as the courtshave found this practice to be construed as advertising, it is a practice that wewould never actively practice or condone.While we would have liked to have worked this issue out directly with Mr***, thecustomer notified us that he would only communicate with our dealership via email, andthen while we were waiting for a response from the Pro Box, he filed a claim with theRevdex.comAt this point we decided to halt all further communications with him, and I ( [redacted] ) decided to personally handle this situation.The key item that invalidates Mr***’s concern is that he has chosen to compare thetop that he purchased from our dealership with ones that are currently available on thePro Box websitePro Box is a company that has continued to innovate and develop newproducts, and as such their lineup is constantly changingThe top that he purchasedfrom our dealership is from the previous model year, and that model is no longer inproduction.Woods Cycle Country is one of the largest Polaris dealerships in the State of Texas,and we stock a large number of accessories to outfit the vehicles that we sellWe arealso one of the largest Pro Box dealers in the StateDue to the quantity of tops that weorder (and their cost) there are times where we may have some non-current tops instock, and this is the exact case with the one that we sold to Mr***The top thatMr [redacted] purchased was on display on another vehicle on our showroom, and as ProBox often takes 4-weeks to fill our orders, we offered to move it from the vehicle it wasoriginally on to the one that he purchasedAs the top was a non-current model, and it was one we had in stock (thus eliminating shipping delays), we chose to offer Mr[redacted] a significant discount on it.The original design of Pro Box tops involved the CNC machining of sheets ofproprietary foam core materialsThe machining process created all the channels for thewiring that was contained internally in the topsOnce complete, the top was coated witha truck bed type liner, and then outfitted with the speakers and lightsEarly in 2016, ProBox completely revamped the way in which they produce topsThe new tops areconsidered to be formed tops, and instead of the machined foam core, they utilize areinforced fiberglass structureThis is important because the new method of producingthe tops has significantly reduced the cost to produce themDepending on the size ofthe vehicle and the size of the top, all other components being equal, the new tops costfrom $500-$less than the old-style tops.As Mr [redacted] purchased one of the older style tops, the cost on that top wassignificantly more than the cost of one of the new formed topsMr***’s comparisonof the price of the top that he received to the ones that are shown on the Pro Boxwebsite is not an apples to apples comparison, it is an apples to oranges comparison.As the top Mr [redacted] purchased is from a prior model year, that model is no longereven listed on the Pro-Box website.Other than the pricing concern, Mr***’s complaints to the Revdex.com and/or our staff alsomentioned a few other items, and so I will address each one of them individually.• The purchased top does not have all the features as shown on the Pro Boxwebsite ?" The top shown on the Pro Box website, is a current model that differsfrom the one he purchased, they can’t be compared.• The purchased top has a 400-watt amp on itAt the time, we purchased this topfor our inventory, that was the standard amp available on themThe newversions of the top now incorporate an 800-watt amp.• Mr [redacted] stated that the top does not have an FM capabilityFor a period oftime Pro Box did make some tops that did not have FM capabilityThis was adesign choice by Pro BoxThe LED light bars on the tops create a large amountof magnetic interference that interfered with radio reception, and so they stoppedoutfitting them with the FM radio optionWe believe that the top we sold Mr[redacted] does have the FM option included in the stereo head unit, and RobEdwards (Mr***’s salesperson) pointed out this feature when he wasshowing the customer how to operate the top (although due to the interferenceissue we always recommend that customers use the Bluetooth functionality tostream music, as that eliminates the interference problem)If for some reason, I am incorrect on this point and the top doesn’t have integrated FM, then we will behappy to obtain a head unit that does provide FM service).• Mr [redacted] claims that the head unit does not offer satellite radio serviceWebelieve that the head unit is equipped to pick up satellite radio signals, but as thatis an optional service, the customer would have to pay for a subscription to eitherSirius or XM radio to activate this serviceThat subscription is not included in theprice that we charged [redacted] stated that he also pointed this feature outto Mr***, who then acknowledged that it did.• Mr [redacted] stated that he did not get a remote with his topThat is correct,although we have a replacement on order for him and will provide that to him atno charge.In addition to the top that Mr [redacted] received, that particular model also included theoptional lighted RGB lightsThese didn’t come on the standard tops (when we orderedthe one that Mr [redacted] purchased), and even today they are an optional upgrade (theycost more than the base price of the new tops) on the new formed topsAdditionally,these tops are large and heavy, and we didn’t charge the customer for any of theshipping charges that we incurred when we originally ordered the top.Finally, many of our sales staff prefer the old-style tops to the new onesThey are morerugged, and our staff believe the sound quality to be better than the new formed style.We continue to believe that we provided Mr [redacted] with a quality top at a significantdiscount.A few days ago, I reached out to Pro Box to see if they had any documentation relatingto the older style tops, and their pricing, but unfortunately, they don’t retain backupcopies of their old websiteI did obtain the following quote directly from Pro Box, andyou may contact them to confirm this information.Quote:• “The formed tops currently available on our website are a relatively newdevelopmentAs our products continue to evolve and our company continues togrow, the items that we offer change, often from one month to the nextOver thelast years, we have utilized multiple different suppliers for our amps, LED lights,speakers, and stereo head unitsThe new formed tops that we are new sellingare also significantly cheaper than the older style foam core tops that we used toproduceIn most cases, the new style formed tops are anywhere from $500-$cheaper than the old-style topsThe pricing of the new tops and the oldtops cannot be compared” [redacted] , customer service manager at Pro BoxWhile it is unfortunate that we were not able to resolve this misunderstanding withoutinvolving the staff at the Revdex.com, we do appreciate your involvement in this matter.One of our company values is integrityHad we failed to live up to that value, then wewould do whatever it took to correct the problem, but in this case, we feel that we havebeen fully open and honest with Mr***.If you have any additional questions about this issue, then don’t hesitate to contact mevia email

I am rejecting this response because: To address Mr ***'s response in order: I wanted the correspondence with the sales people, *** *** and *** ***, to be written so there would not be any misunderstanding of who said whatI was not contacted by anyone else from the dealershipI had told the sales team I would try to work this out but if unable would file a Revdex.com complaint on Monday FebAs you know, I held off until Tuesday Febbefore filing the complaintReason was *** *** promised a detailed build sheet on the topThis was not provided.I was NOT informed that this was an older top from a previous year or of any differences there may be in construction, price, or componentsLooking at the website, the top is identical in appearance to what is offered today. Was not given the information, if accurate, that I could have that top with more and better options for the same price if I ordered it and waited on arrivalWould have done that as a person that likes to get his money's worthThat is evidenced by the protracted negotiations for purchase of Razr and top. I am not convinced I was given a significant discountI even wonder now if it was a used topI asked *** *** via email several times to give me some documents showing this top and suggested MSRPHe never didI was not given anything at time of purchaseI thought there would be documentation in the packet provided but there was nothing regarding the topThere was no remote as listed on the radio documentation which I had to search online to find.The radio does have FM capabilityHowever, it will not receive a clear signal unless in close proximity to the station and sitting stillThis renders it useless in the offroad areas where this type of vehicle has to operateThis I have learned from my own user experience.Bluetooth capability does workHowever, it will not play loud enough to be heard while actually driving the RazrCan be heard while sitting still with engine off or at idleThe same is true if music source is connected via USBThe Harley Davidson motorcycle I traded in had all of the capabilities they say this unit has, including satellite radio, with a smaller amp and louder pipesI could hear music at any speed.This unit, by itself, does not have satellite radio capability as I was told by *** ***I have had satellite radio since shortly after it was offered in cars, trucks, home, and motorcycle so I am very familiar with how to activate that serviceAdditional components would have to be purchased to acquire and activate satellite radio.This unit does NOT have the RGB lightsHave even downloaded an app, shown on Pro Box Tops website, for phoneNo RGB lights come on nor can be made to come on.Our negotiations were for an all inclusive, out the door, packageSo there would not be any additional charges for shipping.Have been out with unit among other people with similar machines and topsAsking their opinion has reinforced my beliefsThe consensus was I got what I paid forA $top for $Not a $top for $A couple were even Woods Cycle Country past customers. My complaint stands as amended above

I am rejecting this response because: To address Mr [redacted]'s response in order: I wanted the correspondence with the sales people, [redacted] and [redacted], to be written so there would not be any misunderstanding of who said what. I was not contacted by anyone else from the dealership. I had told the sales team I would try to work this out but if unable would file a Revdex.com complaint on Monday Feb. 27. As you know, I held off until Tuesday Feb. 28 before filing the complaint. Reason was [redacted] promised a detailed build sheet on the top. This was not provided.I was NOT informed that this was an older top from a previous year or of any differences there may be in construction, price, or components. Looking at the website, the top is identical in appearance to what is offered today. Was not given the information, if accurate, that I could have that top with more and better options for the same price if I ordered it and waited on arrival. Would have done that as a person that likes to get his money's worth. That is evidenced by the protracted negotiations for purchase of Razr and top. I am not convinced I was given a significant discount. I even wonder now if it was a used top. I asked [redacted] via email several times to give me some documents showing this top and suggested MSRP. He never did. I was not given anything at time of purchase. I thought there would be documentation in the packet provided but there was nothing regarding the top. There was no remote as listed on the radio documentation which I had to search online to find.The radio does have FM capability. However, it will not receive a clear signal unless in close proximity to the station and sitting still. This renders it useless in the offroad areas where this type of vehicle has to operate. This I have learned from my own user experience.Bluetooth capability does work. However, it will not play loud enough to be heard while actually driving the Razr. Can be heard while sitting still with engine off or at idle. The same is true if music source is connected via USB. The Harley Davidson motorcycle I traded in had all of the capabilities they say this unit has, including satellite radio, with a smaller amp and louder pipes. I could hear music at any speed.This unit, by itself, does not have satellite radio capability as I was told by [redacted]. I have had satellite radio since shortly after it was offered in cars, trucks, home, and motorcycle so I am very familiar with how to activate that service. Additional components would have to be purchased to acquire and activate satellite radio.This unit does NOT have the RGB lights. Have even downloaded an app, shown on Pro Box Tops website, for phone. No RGB lights come on nor can be made to come on.Our negotiations were for an all inclusive, out the door, package. So there would not be any additional charges for shipping.Have been out with unit among other people with similar machines and tops. Asking their opinion has reinforced my beliefs. The consensus was I got what I paid for. A $2000 top for $2000. Not a $2800 top for $2000. A couple were even Woods Cycle Country past customers. My complaint stands as amended above.

While we believe that we have maintained our company values in dealing with Mr.[redacted], we understand that it can be hard to find middle ground in situations wherebuyer’s remorse is involved.In a show of goodwill, we are willing to offer Mr. [redacted] a full refund for the cost of thetop that he purchased from Woods Cycle Country. In addition, we will cover the cost oflabor to have our techs remove the top. Mr. [redacted] will still be responsible for the initialprice he paid for the installation of the Pro Box top.As the top was new when we sold it to Mr. [redacted], we understand that we will be takingback a piece of equipment that must be resold as used. As such, our offer torepurchase the top is only valid if the top assembly has not suffered any damage whilein the possession of Mr. [redacted]. Other than normal wear and tear, we will be unwilling tostand behind this offer if the top has suffered any damage or if it has been abused inany way.As the mounting clamps and hardware often burnish the finish of the vehicle, Mr. [redacted]will need to acknowledge that his vehicle may show some residual signs of the tophaving been installed on his Polaris RZR. In addition, as some holes are often drilled inthe roll cage and body for cable routing, these holes will remain unfilled after the top hasbeen removed.As Mr. [redacted] claimed a tax exemption on the purchase of the Polaris RZR, theaccessories installed on the vehicle were also exempted from State sales tax. Theamount of the refund would be in the form of a company check for a total of $1999.00.If this offer is agreeable, then Mr. [redacted] will need to contact [redacted] via email toschedule a date and time for him to return the Polaris RZR to Woods Cycle Country sothat the top can be removed by our technicians. When he arrives with the vehicle thetop will be inspected for any damage. If the top is undamaged and in a resalablecondition our staff will proceed with the removal of the top. We would want to concludethe return by April 7th, 2017. Not only do we not operate in that manner, but as the courtshave found this practice to be construed as false advertising, it is a practice that wewould never actively practice or condone.While we would have liked to have worked this issue out directly with Mr. [redacted], thecustomer notified us that he would only communicate with our dealership via email, andthen while we were waiting for a response from the Pro Box, he filed a claim with theRevdex.com. At this point we decided to halt all further communications with him, and I ([redacted]) decided to personally handle this situation.The key item that invalidates Mr. [redacted]’s concern is that he has chosen to compare thetop that he purchased from our dealership with ones that are currently available on thePro Box website. Pro Box is a company that has continued to innovate and develop newproducts, and as such their lineup is constantly changing. The top that he purchasedfrom our dealership is from the previous model year, and that model is no longer inproduction.Woods Cycle Country is one of the largest Polaris dealerships in the State of Texas,and we stock a large number of accessories to outfit the vehicles that we sell. We arealso one of the largest Pro Box dealers in the State. Due to the quantity of tops that weorder (and their cost) there are times where we may have some non-current tops instock, and this is the exact case with the one that we sold to Mr. [redacted]. The top thatMr. [redacted] purchased was on display on another vehicle on our showroom, and as ProBox often takes 4-6 weeks to fill our orders, we offered to move it from the vehicle it wasoriginally on to the one that he purchased. As the top was a non-current model, and it was one we had in stock (thus eliminating shipping delays), we chose to offer Mr.[redacted] a significant discount on it.The original design of Pro Box tops involved the CNC machining of 2 sheets ofproprietary foam core materials. The machining process created all the channels for thewiring that was contained internally in the tops. Once complete, the top was coated witha truck bed type liner, and then outfitted with the speakers and lights. Early in 2016, ProBox completely revamped the way in which they produce tops. The new tops areconsidered to be formed tops, and instead of the machined foam core, they utilize areinforced fiberglass structure. This is important because the new method of producingthe tops has significantly reduced the cost to produce them. Depending on the size ofthe vehicle and the size of the top, all other components being equal, the new tops costfrom $500-$900 less than the old-style tops.As Mr. [redacted] purchased one of the older style tops, the cost on that top wassignificantly more than the cost of one of the new formed tops.
