Subject: customer complaint Annie's Attic On July 8, Annie's Attic attempted to hang the chandelier that is in questionIt had a bowl bottom and fell thru the bottom of the fixture itself making us think there was some missing piecesWe called and left a message on this same day, to the phone number the customer had left with us, to let her know the bowl bottom had broken and did she want to pick it up or for us to dispose of itThe customer never called us back for instruction or information, so we disposed of it on August 24,Our policy is not to continue to call back or send a letter in the mail after our initial phone call, however we did wait for a response for aproxweeksThe customer stated that she came in to inquire about the chandelier but never saw it hanging upIn our system the chandelier didn't state "sold" because it wasn't and looked still "available"In the notes of her account were the dates when we had tried to contact herThe contract that the customer signed does state we are "not responsible for loss or damage to the said items" I am so sorry for the unfortunate situation and it doesn't happen very often but occasionally things do break on the sales floorThanks so much for the inquiryAnnie's Attic

I don't know how the owner came to the conclusion that I abandoned my property when I made separate visits, the last being on October 31, to retrieve my property, into the shop to check on the status of my property. I made purchases on one of those visits and can substantiate my trip into the store with my bank statement On each visit I asked an associate if my item had sold only to be told that it had not and was not told of its destruction and subsequent disposal. Why was the fixture hung, and placed at risk of destruction, if upon inspection it was determined to be missing a part, which is was not when I placed it in the store's careI contend that was negligence of the store to attempt to display a glass fixture if a part was missing. The contract does not state if property is damaged that it will disposed of nor does it state that it will be considered abandoned prior to end of contract regardless of condition. While no profit was made, a monetary loss was sufferedI sought $from the sell of my chandelier and am now unable to potentially earn those dollars from its sell due to Annie's Attic negligenceAt this point I am requesting arbitration through the Revdex.com

As stated in my original complaint I never received notification of the destruction and subsequent disposal of my property via telephone, recorded message, written, or whilst in the store to check on my chandelier from any member of Annie's Attic The respondent stated that in their notes for the account there exist an entry as to the day they attempted to reach meWhy then was this piece of information, found within their notes, not shared with me on my visits into the store. I certainly would not have made subsequent visits if there was no merchandise to check on. No where in the contract that I signed does it state the following particulars - 1) time/duration to retrieve property damaged while in the store's possession, 2) methods of contact or number of attempts to reach customer should the need arise to alert a customer. I am of the opinion that the store was negligent in its attempt to display my chandelier, as all parts were there when left in their care. I am of the opinion that the store's efforts to contact me were lacking/insufficient. I am of the opinion that the store was not within their rights to dispose of my property as it is not spelled out the contract that I signed. I am seeking monetary compensation for the destruction and illegal disposal of my property
