I also wanted to address your concern with the process for cancellationAgain, on the first page of the agreement, highlighted in bold print Month to Month (Open-Ended Terms) Cancellation is subject to proper compliance with the cancellation policies as indicated in this agreementMonth to month agreements may be cancelled at any time provided a 30-day written notice is deliveredWe request the written cancellation to ensure the correct membership is cancelled, and that we have a record reflecting the date the cancellation was requestedWe keep all written cancellations in our corporate office for reference if neededI apologize if this process is cumbersome however; we do it to protect the member. Regarding the request for a refundBecause we require the 30-day notice and you requested cancellation on July 30th you are responsible for the August paymentAs ABC explained, you had full access to the club during the month of AugustI understand your frustration but assure you no one lied to you about the fees charged or the policies, which are all clearly written in the agreement you signedWe are not in the business to trick or lie to our members about the feesWe pride ourselves on the low cost of membership and go out of our way to explain the charges during the sign upAll our members are important and valued and we never want to see a member cancel

I am rejecting this response because:In response to the previous message,The end cost of an enrollment fee, a card fee, and one month free is irrelevant because these charges are uncontestedThere is no further value of these "specials" than the price already paid for them, which came to about $10. The monthly membership fee of the second month for the month of July is uncontestedI only want to focus on the dispute at hand, August's membership fee and the yearly fee.When I signed up for a membership, everything was completed electronicallyThe only paperwork I signed with pen is the health/wellness documentAll other documents were signed via little rectangular sign pad and I was verbally told about the documents I was signing for, not anything about the details of those documentsI was never given any of those signed documentsThis is the first time I've actually seen an agreement between myself and your companyThe signature lines are signed "AP" and not a full name like most signatures are and how all my signatures are doneI wouldn't even be able to argue the authenticity of the agreement aside from lack of signature because everything was done electronically and no paperwork was given out.The "Rate Guarantee Fee" was NOT explained in the Heath 24/Workout Anytime storeIt was said by the manager running this store, I quote "You will pay a monthly fee for your membership and after months you'll pay a yearly fee". I asked "Does this cover my membership for the rest of the year?" Your manager said "Yes"Rate guarantee fee was not discussed any further or at any time until I inquired about it over the phone with a female agent at ABC Workout from the phone number provided in my bank statementWhat I gathered from our conversation is I'd be charged in months, NOT days AND that I wouldn't pay a monthly membership fee after the 3rd monthcharges on your bank statement looks like a double charge when it's not properly explainedJust because it's explained now, after I've requested a cancellation and a refund doesn't take away from the fact that this has been nothing but abusiveI still want my money back.I'd like to know how YOU know YOUR staff are "going out of their way to explain the Rate Guarantee Fee"You didn't even leave a name or any credentialsFor all I know, you're sitting in an office miles away and you have no idea who actually audits these stores and whether or not they sit in on the registration.My concern with the process for cancellation is the lack of honesty I've receivedTo reiterate the agreement I'll quote the same text "Cancellation is subject to proper compliance with the cancellation policies as indicated in this agreementMonth to month agreements may be cancelled at any time provided a 30-day written notice is delivered to Workout Anytime Heath, Hebron Road, Heath, Ohio 43056"When I attempted to cancel my membership I was physically standing in front of the store manager and verbally spoken to, quote "You need to write out your cancellation on a piece of paper and mail it to this address in Cincinnati"Your manager gave me an address to some random suite in Cincinnati. No where on the attached agreement does it say I need to mail out my cancellation but it does say that store's addresshmmbreach of contract?What actually happened is I cancelled my membership over the phone with the ABC agentWhere are these "cancellation policies"? It was never mentioned I could just call an ABC agent to cancel my membership.I also noticed at the bottom of that attached agreement "NOTICE OF CANCELLATION: You may cancel this contract at any time..." which indicates the agreement is actually a contractI wasn't even informed that this is a contract I'm signing.I intend to continue fighting this for as long as it takes

I am rejecting this response because:I have not received an e-mail with any information, I just checked my inbox, my junk folder, my trash, and recovered deleted trash - there's nothing anywhere. I was never told by any associate that I was going to recieve an e-mail with all my signed documents. I was never given anything in the store. I don't think the question even came up since it was all done on an electronic sign pad and the girl who did the computer work was working on a screen turned away from me.I believe the store manager is Russel, who I talked with. He cut my "orientation" short because "time was up". He talked more about how he was participating in a competition, how he needed to eat at very specific times, and how much he needed to eat. He talked about how he let himself go and needed to focus on his body more. I didn't think anything of it at the time but I realize now it was quite rude when I'm the one buying into a membership. I'm pretty sure there were many things left out of the orientation because of this. So don't give me this "listen to the person who signed you up" bull. You can't act like you know when you don't.This is turning into a pretty abusive experience. Your every message is pretending like your associates are so professionally well-trained that they could never make an error, considering you're taking responsibility on their training. Because you did their training, are you training and instructing them to give a piece of paper with an address on it in order to cancel? That's NOT written on the agreement you linked to in the previous message. Are you aware that members can contact ABC Workout Anytime to cancel? That's NOT on that agreement.When I signed up, your store manager did not take enough time to explain anything. When I cancelled over the phone, before August, my membership should have been cancelled that day, as per the conversation. This all started because a double charge was placed on my account within 2 months of my registration though I was told, by the store manager, 3 months before I paid the yearly fee. I questioned your store manager, I asked him if I'd make 3 payments then just pay a yearly fee, which he answered yes. So his answer is misleading and if you trained him, you're both doing something wrong.I can't believe I have to come on to the Revdex.com to argue over 60 dollars. These aren't just misunderstandings, rather it seems like your business policy of abusive tactics to steal any dollar you can get. Is the value of this $60 really worth the negative reviews and word of mouth discouraging new applicants from attending your stores? I'll fight much harder if I need to.Do you even have the authority to issue a refund or to speak on behalf of your business?
