Ms***, Per our phone conversation please close out complaint # *** as all issues have been resolved. Thank you,*** ***

To whom it may concern: *** *** purchased a machine from us that we serviced for the first time in January 2017. At that
time we followed service manual instruction from Polaris to inspect the air filter and either clean or replace as needed. In an effort to save the customer money we only cleaned the filter as that was all that is needed. Sometime over the next month the customer got mud and a lot of dirt into the intake of the machine. He claimed he did nothing unusual. However, even with no air filter this type of mud could not occur without the machine being used in a manner for which it was not designed. We have pictures of the internals of the machine proving this. Also, we have a documented case with Polaris stating that they would not pay for repairs under warranty because the problem was caused by the customer, based on pictures. At no point did they say it was our fault. In order to keep a happy customer, we agreed to split the repair bill with him. We would not warranty the world because if he did the same type of behavior the result would be the same. We never pushed the machine aside for other work. The first part we needed was back ordered through Polaris, something out of our control. Once the part was in and the machine was driven we determined that due to it being packed full of mud the valves needed adjusting. In order to do this we had to order shims and wait for their delivery. We could not have know this until the first part was installed. This is also why the price increased. Once the shims came in the machine was fixed within days and he was called to pick it up. This entire ordeal is due to the customer getting to deep into the mud and not doing regular inspections of the filters, as is instructed in his owners manual. Thank you, Heather P*** World Class Powersports

We did have Mrs.[redacted]'s machine in our dealership to get an estimate completed for her insurance company for damage done to...

her side by side vehicle. We completed the estimate and sent notice to her insurance agency that the estimate was complete. The agency then sent a claims adjustor to speak with our technician and go over the damage estimate at our facility. Upon completion she was informed that the adjustor had been here and done their inspection and met with our technician. Most insurance companies pay the dealership directly for the repairs. Since her insurance agency did not do this she was asked how much the insurance allowed for the repair. The reason she was asked is because we try to work with a customer to give them a better rate if insurance does not allow the full amount of the estimate. This is a common practice for us to keep customers happy with our service department and help them if at all possible. She was informed that this was the reason for asking what was allowed on the machine. Since the insurance company did not send us the check directly we asked for the deposit for parts to repair the machine. After she drove here, one hour, and complained about this, we decided to not make her give us a deposit and even offered to deliver the machine to her upon completion so she would not have to drive the hour again to pick it up. She adamantly refused saying she should not have to pay up front for parts when we have her machine in our possession. Because she was upset about that she did not want us to repair the machine. She was charged the $150 estimate fee to assess damage and meeet with the insurance claims adjustor. She would not have had to pay that if we had done the work on the machine. We waive that fee if repairs are done here. We had to be compensated for the time spent if she chose not to do repairs here. Upon leaving she informed her cousin, one of our employees, that another cousin of theirs had just finished technician school and was opening a shop that weekend. We feel that they were hoping to get the work done by a family member so that they could pocket some of the money allotted to them by the insurance company for the repairs. She was given a very discounted price up front when the machine was purchased because of her relation to a current employee.
Initial Consumer Rebuttal /* (3000, 9, 2016/04/20) */
(The consumer indicated he/she DID NOT accept the response from the business.)
The insurance company did not send you the check because I pay up front in full for the side by side at the time of purchase. Instead of asking me how much the check was, I should have been told how much it was to fix my side by side. I think the excuse for knowing the check amount does not show professionalism and I believe the excuse is nonsense. Let's say the check was not enough, than you know that the customer or I would inform you. I would hope that I was getting the best rate to begin with not after I tell you the check amount. It seems like World Class Powersports would want to pocket the money not I the customer that paid up front in full for the side by side at the time of purchase. So even though World Class Powersports had the side by side there at the dealership as a collateral, World Class Powersports still needed the money up front? I don't know of any company that needs money in advance to pay for parts when they have your vehicle or ATV or side by side in their hands already. With this being told to me by phone, I drove to the dealership where my side by side was at, and wanted to be explained about the money up front for parts. I was told again in person by 3 different people that worked at World Class Powersports that I needed to bring them the check to pay for parts. One of the employee's at World Class Powersports, even stated, "I even have to pay for parts when I order them for myself". The conversation escalated and the manager/owner of World Class Powersports told me in person that, "You told you that you needed to pay up front for parts?" I stated I was told by phone and I was told in person today at World Class Powersports by 3 different people". By the way, the employees of World Class Powersports that told me that were standing right in front of, the employees of World Class Powersports just looked at me and did not say a thing. There I was lied to by 3 employees of World Class Powersports to my face and the sad thing is that they did not admit it. So the manager/owner of World Class Powersports said, "You don't need to pay for parts up front when we have your side by side here at the shop". At this point I was too upset about all the lies that I was told, that I just wanted my personal property (side by side) in my hands. I did not want anything that they had offered, due to they had lied to me and I had lost trust in them. So I did not want them to touch my side by side. So I asked to have my side by side back, I was told by World Class Powersports, I could not have my side by side, until I paid $150.00 for estimate. I was not told this up front, nor was this stated anywhere. So now I'm without a side by side, been lied to several times and now I have to pay $150.00 to get my side by side that I own. World Class Powersports denied giving me my side by side. I stated to my dad which was there, "Should I call the police". One of the employees at World Class Powersports stated, "The police cannot do anything, It's a law that we don't have to give you back your machine until paid for". First of all I was not even talking to World Class Powersports, but they shared their opinion anyways. On the other hand, why I don't trust them again is because they share personal information to other people like as she stated below, my cousin open a shop and I supposedly going to take my side by side there to get it fixed, so I can pocket the money by insurance. WOW! What an immature remark to say! However, thank you for the public advertising for him. The shop he opened is for motorcycles. He is a small shop that can only do small fixes and oil change, etc. He is not prepared or have the machines to do what is needed for side by sides or ATVs. He is a one small one man shop. Again, if I wanted to pocket the money, I would not have brought the machine and hour up to World Class Powersports and another hour back home just to get an estimate from World Class Powersports. And if I really needed the insurance money I would not have bought a $20,000 plus side by side from World Class Powersports and paid up front at the time of purchase and also added and bought a windshield for my side by side while there at World Class Powersports and had put on as well. I'm in no need for money.
I am really for sure why you are bragging that you gave me a, "very discounted price up front when the machine was purchase". By the way I had a coupon for $300 off the side by side when I purchase it. This was not given by you. I just did a little checking around and I could have gotten the same exact side by side by a local [redacted] dealership for cheaper than what I paid for it. I'm talking $500.00 cheaper. So everyone reading this please check around first. By the way, the windshield that I paid for at the time of purchase cost me with labor $375 and I notice that on the estimate that you gave it, you were charging me $499.00 plus labor for a new one. Also, when referring to "you" I am referring to World Class Powersports. When looking at the side by side, my windshield is in no damage whatsoever, not even a scratch. The windshield can be taken on and off just like brand new. I also seen a few other parts that is listed on my estimate sheet that does not seem realistic or in no need of a brand new. So, it seems like World Class Powersports are the ones who is trying to pocket money from the insurance company, I would call this an insurance scam if any.
Final Business Response /* (4000, 11, 2016/04/26) */
Unfortunately there is no making this customer happy. The estimate for insurance was done with all new factory parts, as is the norm anytime an estimate is done on a wrecked machine. This is a new machine for [redacted] and even if they wanted used parts there aren't any available. This machine just came out as a 2016. We have never had an issue with any insurance quote in 11 years of business.
Insurance companies have access to parts pricing and can look themselves, and they do to make sure dealer estimates are in line with the normal price of [redacted] parts before issuing the check. The reason the windshield was so much less at time of puchase is because of the discount we offer up front on all accessories bought at time of service. The price of the machine she purchased is $19,999 for the deluxe general. Her price was $18,131.15. A substantial savings, barely above cost. I do not feel there is anything else we can do that would make this customer happy. Clearly, the $1,868.00 up front discount on the machine and the $125 discount on her windshield was not enough.
