I am rejecting this response because: MsP*** is flat out lying because I nor *** *** ever spoke to her. I did not curse out MsSherri as well I had inquired and complained more than once prior to requesting cancellation of the three memberships. I did not speak my mind to Ms Sherri until after my comaplint in late November and again in December when I ask for her or the gym to assist in selling my shares because we were not happy with the new gym procedures nor equipment change and she did assist on selling one of our membershipsThe new equipment and newly development work out area IS NOT, and I repeat IS NOT or was not at the time of us attending available to all. And THIS NIS WHY we chose to not return to World Gym in Prince Frederick. It was specifically put and redone for a new membership fee to be part of a new program
Yes, we have joined a new gym due to the unhappyness and unprofessionalism of the World Gym

Please take note that you sent the previous letter to WORLD GYM FITNESS CENTER, *** *** *** ***, PRINCE FREDERICK, MDHowever, the correct address is listed aboveI am not sure if you need me to respond back to you in order to
close this case, but I will just brieflySince I have proven my case with my previous documentation, I feel no further need to respond on this issue after this reply.With my previous correspondence I sent you copies of the two membership agreements in question, which proves that they are in contract until April and that they signed and agreed to all of the terms of the agreementIn my initial response, I clearly stated that the members had talked to my manager, Sherri H***never said they had spoken to me, because they had not spoken to meThe member was clearly out of line saying I was “flat out lying."I will reiterate my original statement that nowhere in the membership agreement is there a cancelation for management rearranging the equipmentThe member is welcome to pay the $buy-out fee which is clearly explained on the back of the contract and which he initialed when the cancelation policy was explained to him at the time he purchased a membership(A copy was sent to you with my previous correspondence.) Additionally, if the member finds someone who will take over his contract, we would be happy to transfer it to the person of his choiceAt this time, I will consider this matter closed with the Revdex.com.Beth POperations Manager

I am attaching a copy of the member's agreement as well as his wife's. I have underlined on the agreement the charges that were assessed were SERVICE FEES. As per the agreement, it clearly states that a "SERVICE FEE will be assessed for any check, draft,
credit card, or order returned for insufficient funds or any other reason." LATE CHARGES are assessed once the payment is days late. *** *** was charged a SERVICE FEE per his agreement. He was not charged a LATE CHARGE. *** *** is our billing company. We do not collect the money from the members; our billing company collects the money and keeps it as per our agreement with themI am also attaching notes from staff members regarding phone calls from *** ***. As you can see by the notes, *** *** has been aggressive and threatening to the staff of the gym as well as to the Owner. The first staff member who received a phone call was Tracy J***; Tracy is a retired police officer and retired security guardShe is also retired from her job as a teacher with special needs children. Obviously, with her past experiences, she is slow to react to irrational people, and would never say the things this gentleman has accused her of saying.John P***, who is the owner of the gym, contacted *** *** on 12/11/after receiving a phone call from Tracy J*** regarding *** ***. MrP*** had the exact same experience with *** *** and his threatening behavior. He also threatened to call the Sheriff's office, congressmen, senators, etc. MrP*** asked him in a perfect world, what it would take to make him happy. *** *** said the only thing that would make him happy is to refund him his monthly membership dues as well as the late fee and service fee. MrP*** was not willing to refund him his membership dues, so now he has reported us to you, and made allegations regarding our professional behavior that is completely delusional. It is not in MrP***'s nor Tracy J*** nature to be aggressive or insulting to members - EVER. In fact, both are exactly the opposite.We had not previously cancelled *** ***'s membership nor his wife's as he stated we were going to do; however, due to these present circumstances and his hostile behavior towards our staff and owner, I have cancelled his membership.If there is any further information needed, please contact me and I would be happy to assist you in closing this matter.Beth P***Operations Manager

March 10, 2015To Whom it May Concern:
I am in receipt of the letter from [redacted] and I would like to respond to the complaint. I have attached copies of two of the three membership contracts which [redacted] mentioned for your review.
[redacted] does not pay for [redacted]'s account, and therefore, has no rights to request refund or cancelation on his behalf. I will not comment on his account.
As you can see, [redacted] and his daughter have a signed legal agreement to continue paying their membership dues through April 2016.
I will let you know what has occurred:A small gym has opened within a few miles of our location and one of our personal trainers left our location to work there. [redacted], his wife and his daughter all immediately demanded to have their memberships canceled due to wanting to join the other gym. [redacted] has called multiple times, cursing, yelling, and degrading my manager Sherri H[redacted] in order to try to get her membership canceled. As a courtesy, Sherri H[redacted] transferred [redacted]'s membership to a new member. This was a courtesy to her that is absolutely not part of what is offered in our contracts.
The entire family has made it very clear why they wish to cancel their membership – because they want to join another gym. M[redacted]'s letter to your organization is the first we at World Gym have heard of them requesting to cancel due us moving equipment around in our gym. In addition, there is nothing in their contract that states their membership can be canceled if we rearrange equipment! Contrary to what [redacted] states in his letter, the new equipment that we have purchased is for the use of EVERY MEMBER and is available at any time a session is not in progress.I am sorry that [redacted] is unhappy with the situation, however, we have a LEGAL BINDING contract that has been signed by the members that they are obligated to pay their membership dues through April 30, 2016. As you can see on page 2 of the contract, there is a buyout fee of $175.00 per member to cancel the contract, and we would be happy to oblige [redacted] and his daughter if they are willing to pay the buyout.

I am rejecting this response because:This is not listed nor was it what was stated by Ms. J[redacted] the manager who signed our contracts. We paid for December, which we were not allowed to use, plus wrongfully charged the additional $19.50 on each account without consent for the charges. False statements were submitted to Revdex.com by this company as well as unsupported defaming information. We were charged for services that were wrongfully taken from us and treated hostile by their representatives when trying to resolve.
