Customer’s Statement of the Problem: My gym membership was set to expire December 31, Gym memberships don't expire on the anniversary, they continue month - month until written cancelation is receivedAs is written in the complainants’ membership agreement "I understand that my monthly billing membership will not automatically end at end of term checked above.” When I signed up I spoke with a man named Jim and he said they automatically renew memberships without authorization unless we cancel the membershipHe informed me I could call and inform a gym rep that I do not wish to renew the membership or can come in and let someone know a month before the contract expiresCalling in to cancel is never an option as is clearly stated on the complainants’ contract, also the employee in question has worked for us for years and would never tell someone that they could "call in" "All EZ Pay Plan Members must stop into the gym and fill out a days written notice form in order to cancel their monthly billing membershipI agree to pay two additional months from the date of my cancellationI understand I cannot cancel by phone, email or by informing a staff person verbally." I had a reminder set up to call Dec 1, The debit card linked to the account had an expiration date of 12/as wellI had knee surgery last year and called in the summer asking if I could freeze or cancel my membership because I was unable to use the membershipStaff informed me that it was not permissible and I'd have to "ride out" my contract and continue to pay my monthly membership feeI went through several injections in my knee and eventually had the surgery in NovemberNo cancelation was ever received.I only recently found out this week that works gym has been trying to "charge" my expired debit card and in January, February and MarchWorld Gym Greece has made monthly attempts complainants e-mail address of record, regarding the declined credit card They want me to pay $in full for those monthsAs is clearly stated in the contract "All EZ Pay Plan Members must stop into the gym and fill out a days written notice form in order to cancel their monthly billing membershipI agree to pay two additional months from the date of my cancellationI understand I cannot cancel by phone, email or by informing a staff person verbally." Since this was never done, the membership was still activeThey informed me that there were 3--$insufficient funds fees plus the monthly membership duesI tried to discuss with them that their gym does not get charged/nor due they pay for insufficient funds on an expired card because it does not get draftedAlso as agreed to in the membership agreement entered into by the complainant "World Gym will access a $fee for all rejected credit card and/or bank account debitsCredit card and bank account changes are the sole responsibility of the memberI understand that I must notify the gym for any account information changes including: Bank issued credit cards, lost or stolen credit cards, any expiration date change." On 06/12/Mr [redacted] entered into a contractual agreement with us for a gym membershipThe agreement carried a minimum 12-month commitment and then continued as a month-month membershipThat agreement is attachedIn February Mr [redacted] credit card expired, so his dues started to declineAs is clearly stated in the membership agreement “Credit card and bank account changes are the sole responsibility of the memberI understand that I must notify the gym for any account information changes including: Bank issued credit cards, lost or stolen credit cards, any expiration date change”This was not doneWe attempted to contact Mr [redacted] via phone on 2/20/17, 3/7/17, 3/13/and 5/15/Messages were left or the voice mail was fullFurther, emails were sent on a monthly basis after the first Credit Card declineA final collection letter was mailed and emailed on 09/19/ There is no log notes stating any phone calls were received with the exception of 12/08/from his motherFurther, as it clearly states on the membership agreement, “All EZ Pay Plan Members must stop into the gym and fill out a day written notice form in order to cancel their monthly billing membershipI agree to pay two additional months from the date of my cancellationI understand I cannot cancel by phone, email or by informing a staff person verbally”We do not mail out cancelation forms to members, but we do accept written cancelation via certified mail, return receiptAll of our employees are aware of this and inform people when they call attempting to cancelAll efforts were made to contact the member that were reasonable and customary

This complaint is against World Gym not the BAC or RAC for WomenWe have no interest in this matter

The Complainant has been a member of our facility since we opened, and since that time we have billed all of our members on the 1st of each monthThe complainant is well aware that he is contractually obligated to have his monthly dues of $available to be drawn at any time that dayHe is also aware (due to his credit card declining for non sufficient funds multiple times and is clearly stated in the membership agreement) that a $fee will be accessed for all rejected credit card and/or bank account debitsFurther more it clearly states in the complainants membership agreement with us that we reserve the right to charge debit/credit cards or bank accounts for all overdue balances and late feesThere is no "soft pull" as the complainant accusesWe bill on the first, if billing is declined a fee is accessed and we continue to attempt to collect our dues and fees as is clearly stated in the membership agreement that the complainant agreed toThis can all be avoided if the complainant made sure he had/has the $available to be drawn on the 1st of every month as he has agreed to

On 01/18/the complainant entered into a contractual agreement with us for a gym membershipThat agreement states that after the initial term, the member can cancel at any time with a 60-day written noticeThat written notice must be in person or by mail (we recommend certified mail return
receipt so the member has proof of receipt of cancelation)“All EZ Pay Plan Members must stop into the gym and fill out a days written notice form in order to cancel their monthly billing membership “At no time did we receive a written cancelation from the complainantThe alleged cancelation would have also been accompanied by a single charge of the remaining months dues at the time of cancelation, and not the standard monthly EFT on the 1st of the monthNo such charge exists on the complainants’ accountIf the complainant has a receipt for this they can certainly present it to us and all fees will be credited. As was stated in the first response, the contract she signed states " I agree to pay all rate guarantee fees, late fees, two additional months due upon cancellation and any damage I or my guests may cause to the gym." This means at the time of cancellationSo the complainant did in fact need to pay thenIf the complainants billing goes through on 10/01/and the complainant comes in by 10/01/and pays the other month, I will honor the complainants cancellation at that time

Here at World Gym Greece all members agree to at least a year commitment in order to gain access to our facilityWhat that means is that within the first year a customer cannot cancel unless they are moving or more miles away, can prove said move, and can pay a $buy-out fee to compensate
for the contract that has been breachedThis is all in accordance with NYS lawAfter a customer has met their one year commitment and would like to cancel they must stop by their home facility and provide us with a day written notice for cancellation as well as payment for those days upfront (including the Bi-annual $rate guarantee fee if it is due during the day cancelation time period.)Once we receive this we will no longer deduct any money from the customer’s account and they will still retain access to the club and their amenities until the end of that day time period*** *** Joined our Greece facility on 1/18/under the $per month membership which gave her access to all of the equipment as group fitness classes for at least one yearIf a customer feels as though they need access to a wider range of amenities such as tanning or childcare they have the option to upgrade their current membership to one that suits their needsAt the time of an upgrade the customer is required to sign a brand new contract that not only solidifies their access to various amenities but restarts their one year commitment from the day that they upgrade. *** exercised that right on 2/23/buy upgrading from the monthly membership to the $monthly membership. At the time that Mrs*** inquired about cancellation we would have required her to pay both February and March dues as well as the $rate guarantee fee which would have cost her a total of $Mrs*** was unwilling to comply with our policy, as a result we refused to take any money that may have been offered and her membership has not been cancelled

the ability of people to refuse automatic re-occuring credit card charges at any timeThis is our policy and is clearly stated on the contract Ms*** agreed toThe applicable section is highlighted on her attached contract

The gym I am filing a complaint against is World Gym It is located at Greece Ridge Center Drive, Rochester, NY It is inside of The Mall at Greece Ridge It is
fairly new, and was not on your list of gyms yet I put it under the "other" heading The RAC Gym I am speaking of is located at West Ridge Road, Rochester, NY, It is lin Stoneridge Plaza

I did go into the gym and completed the paperwork as instructedAt NO TIME did the young lady (wIth long, straight brown hair) at the front desk ask me for my card in order to process a one time fee of two extra monthsShe NEVER advised me that was the proper protocolI was under the impression that the months were taken out as usual paymentsI would have had no problem with thatShe took my paperwork and said "Thank you". That was itIt is not my fault that the people who are covering the front desk were not properly trained on the contacts and not responsible enough to process the paperwork properly. With that said, I have spoken with a past Manager at World Gym Greece (Who worked there while I was a member) and according to her they have MANY complaints that former gym members cancellations have not been appropriately processed by the gym. She stated she tried to clean up the mess behind the scenes, but was unsuccessfulThe past Manager even suggested a class action lawsuitI really am not interested in a class action lawsuit, but just want the fees waived- period. The contract that we attached in our original response was the ACTUAL contract that the complainant was offered for review and then accepted, thus joining our fitness facilityBy accepting it the complainant agreed to the terms of the contractSince it is an online document, the complainants acceptance is in lieu of their actual initials and signatureThis holds true for millions of purchases made on-line everydayThe complainant is correct that the image they included in their rejection of our response is from our on-line join portal, but before the section where you input your informationHowever, every person who joins is given an image of the contract with their information and our terms of service to review or reject before they officially join and their credit card is charged for the first timeI also do not refute the fact the the complainant came in to our facility in person to cancel, but when she refused to pay the day notice, it nullified their cancellation

The terms of the membership are clearly stated in the MEMBERSHIP AGREEMENT. What she is stating is not true I called in to go over membership exp dats and if we wnated to have myself and daugher join. At no time did the rep tell me my cc did not go through otherwise I would have taken care of that then. Also I never gave my sons emails address because he does not have one so I dont know what she is talking about. The first time this happen that is what she tried to say until I said thats not ture the only email address we have is mine and they never contacted me.

aware (due to his credit card declining for non sufficient funds multiple times and is clearly stated in the membership agreement) that a $35.00 fee will be accessed for all rejected credit card and/or bank account debits. Further more it clearly states in the complainants membership agreement with us that we reserve the right to charge debit/credit cards or bank accounts for all overdue balances and late fees. There is no "soft pull" as the complainant accuses. We bill on the first, if billing is declined a fee is accessed and we continue to attempt to collect our dues and fees as is clearly stated in the membership agreement that the complainant agreed to. This can all be avoided if the complainant made sure he had/has the $8.99 available to be drawn on the 1st of every month as he has agreed to.
